To view the SUSMP. refer to the Engineering Standards (Volume 4. Chapter 2) at www.carlsbadca.gov/standards. Initially this questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary pennits and/or construction permits). The results of the questionnaire determine the level of storni water standards that must be applied to a proposed development or redevelopment project. Depending on the outcome, your project will either be subject to 'Standard Stonnwater Requirements' or be subject to additional criteria called 'Priority Development Project Requirements'. Many aspects of project site design are dependent upon the storm water standards applied to a project. Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent stomn water standards than initially assessed by you. this will result in the return ofthe development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City. This Exclusion 1(a) does not modify or limit the coverage provided under Covered Risk 5. (b) Any govemmental police power. This Exclusion 1(b) does not modify or limit the coverage provided under Covered Risk 6. 2. Rights of eminent domain. The RH General Plan Land Use designation has a density range of 15 - 23 dwelling units/acre and a Growth Management Control Point (GMCP) of 19 dwelling units/acre which is used for the purpose of calculating the City's compliance with Government Code Section 65863. The project site at 0.23 acres would yield 4 units/lots (0.23 ac x 19 = 4.3 du's rounded down to 4) at the GMCP and a project density of 17.39 du/ac. This density of 17.39 du/ac is above the minimum density (15 du/ac) required for the RH General Plan Land Use designation and would be supported by staff. As such, please redesign the project by adding an additional unit (4-units total) so that the proposed density will comply with the site's RH General Plan Land Use designation and California Government Code Section 65863. For separate ownership, this may be accomplished by proposing an attached condominium project designed consistent with the development standards contained within Tables C & E of the Planned Development Ordinance (Chapter 21.45.060 & 21.45.080 of the CMC). The comment reads as follows: The Landscape Manual indicates that landscape plans are to feature ground cover, shrubs, and trees to screen elements of unsightliness and screen/soften new improvements. The Landscape Manual also indicates that landscaping shall be used to accentuate and enhance architecture. Please provide plantings to include trees, shrubs and/or vines as appropriate to soften and enhance the northeast, southeast and southwest perimeter building elevations. I did not provide suggestions for any of the plantings as I leave that up to the landscape architect. However my thoughts would be possibly adding Palms that would provide softening but minimally affect views. 1 feel that something needs to be added as the views from the south look right up to this site. The building elevations need to be softened. The landscape architect did call me and indicated that the applicant was concerned about Coastal Commission not looking favorably on plantings in the rear that might obstruct views. It is my thought that a few Palm additions (1 am open to other suggestions) to meet Landscape Manual requirements would not be a problem for Coastal Commission; however I cannot speak for the Commission. 1 would think that the building would be more of an obstruction than any proposed plantings. I asked the landscape architect to provide a few tall trees/palms to address Landscape Manual requirements and indicated that they should be positioned to minimize obstructing views from the new building and views across the property. It is my opinion that this requirement can be met without causing problems. I assume that the applicant has no problems with providing for this requirement on the northeast and southeast ofthe project. The site is located within the Agua Hedionda Lagoon Segment of the Local Coastal Program - Area of Deferred Certification and is subject to the Agua Hedionda Land Use Plan. 2. The project would require the following permits to allow for the proposed subdivision: a. Minor Subdivision/Tentative Parcel Map; b. Site Development Plan; c. Planned Development Permit; and d. Coastal Development Permit. A Coastal Development Permit issued by the California Coastal Commission (CCC) is required forthe project. All applications must be submitted to tbe City concurrently. The Planning Commission will be the final decision maker for all of the applications except for the Coastal Development Permit unless appealed to the City Council. The following information is based on the RH General Plan Land Use designation for the project site. The RH General Plan Land Use designation has a density range of 15 - 23 dwelling units/acre and a Growth Management Control Point (GMCP) of 19 dwelling units/acre which is used for the purpose of calculating the City's compliance with Government Code Section 65863. The project site at 0.23 acres would yield 4 units (0.23 ac x 19 = 4.37 DUs rounded down to 4) at the GMCP and a project density of 17.39 du/ac. At the minimum end of the density range (15 du/ac) for the RH General Plan Land Use designation, the project would yield 3 units (0.23 ac x 15 = 3.45 DUs rounded down to 3) and a project density of 13.04 du/ac. Pursuant to Carlsbad Municipal Code Section 21.53.230, Table A, at the minimum density, the unit yield may be rounded down. Unit yields rounded down pursuant to this provision that result in a density below the minimum density of the applicable land use designation shall be considered consistent with the General Plan. Therefore, staff is supportive of the development of three dwelling units with a density of 13.04 dwelling units per acre on this site. 4. As shown on the site plan, the preliminary review application is for three detached residential condominium units (One-family dwellings) located on one common lot. Pursuant to Section 21.45.040 (Table A) of the Carlsbad Municipal Code, One-family dwellings within a Condominium Project are a permitted residential use in the RD-M zone. Therefore, staff supports the proposed residential use subject to compliance with all applicable development standards contained within Chapter 21.45 (Planned Development Ordinance) of the CMC. The general development standards are listed in Section 21.45.060 (Table C) of the CMC and the specific development standards for Condominium Projects are listed in Section 21.45.080 (E) of the CMC. 5. Inclusionary Housing. Please be aware that all residential projects including the conversion of apartments to airspace condominiums are subject to the City's Inclusionary Housing Ordinance, Chapter 21.85 ofthe Carlsbad Municipal Code. Per City Ordinance, 15% of the total housing units constructed must be affordable to low iricome households. Projects consisting of six or fewer market rate units may pay an in-lieu fee ratherthan constructing a unit. 6. As part of a formal submittal, the project will require a detailed Site Plan, Floor Plans, Roof Plan, and Building Elevations. The minimum information required to be provided on these plans is listed on Form P-2. 7. As part of a formal application, the project will also require the following: a. Preliminary Landscape Concept Plan b. Conceptual Water Conservation Plan c. Conceptual Landscape Maintenance Responsibility Exhibit (private or common). Please note that the conceptual landscape plans shall be prepared in accordance with the General Requirements listed in Section 3 ofthe City ofCarlsbad Landscape Manual (February 2012). The following information is in response to the specific questions listed within the preliminary review application: Parking: Each unit requires a two car garage or 2 separate one-car garages. One visitor parking space is required. Within the BAOZ, required visitor parking may be located within driveways (located in front of a unit's garage) provided that all dwelling units in the project have driveways with a depth of 20 feet or more. Please refer to Section 21.45.060 - Table C and Section 21.45.080 - Table E of the CMC for specific resident and visitor parking requirements. Views: Please review Section 8 - Visual Resources and Historical Preservation of the Agua Hedionda Land Use Plan as these Coastal Act Policies may apply to the subject site. Staff recommends that prior to the submittal of any application, that the applicant meets with the local California Coastal Commission Staff to discuss the proposed project layout. As a reminder, the coastal development permit forthe project will be issued bythe CCC. SDG&E Site: As partof the City's General Plan update which is tentatively scheduled to be completed in 2015, the City is re- designating the adjacent SDG&E owned property (AP: 206-070-16) to RD-M (Residential Density Multiple) zone so that the zoning designation is consistent with the RH General Plan Land Use designation. All necessary application forms, submittal requirements, and fee information are available at the Planning counter located in the Faraday Building at 1635 Faraday Avenue or on line at www.carlsbadca.gov. You may also access the General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Engineering: Improvements: 1. Chinquapin Avenue will be required to be improved to a thirty (30) foot half street width with pavement and base, curb and gutter, sidewalk, driveway approach(s), as well as street lights and fire hydrants as needed. The vertical datum for all public improvements should be NGVD 29. The preliminary topographic survey map submitted should be revised to use this datum, not NAVD 88. Grading: 2. A soils report is required to be submitted with any formal application. 3. The preliminary topographic survey map submitted indicates that the site drains from east to west. The site plan however shows no proposed finish elevations, grades, slopes or walls or method of drainage. Show finish grade elevations, finish floor elevations, finish contours if applicable, volume of proposed grading (cut, fill, import, export, remedial) in cubic yards and any proposed retaining walls. 4. Should the project propose the use of any unlined bio-retention or infiltration facilities to comply with storm water pollution control requirements, the soils investigation should determine the depth to ground water depth as the use ofthese facilities requires a minimum vertical distance of 10 feet from groundwater. Drainage should be directed to Chinquapin Avenue. 6. The site plan shows no storm water treatment BMPs (Best Management Practices) or Low Impact Development (LID) features. Revise the project to demonstrate compliance with city's Standard Urban Storm Water Mitigation Plan (SUSMP) requirements. 7. Complete a Stormwater Standards Questionnaire, E-34. This questionnaire will guide you and the City in determining what type of reports and storm water mitigation must be completed to satisfy state and City storm water quality requirements. The questionnaire can be printed from the following website link: http://www.carlsbadca.gov/services/building/forms/default.asp. A cursory staff review of the checklist suggests that the project is subject to priority development project requirements. This requires preparing and submitting a Storm Water Management Plan (SWMP) and integrating storm water treatment control best management practices and, if applicable, flow-control (hydromodification) requirements into the project design. Easements: 8. A Preliminary Title Report (PTR) issued within 6 months ofany formal application will be reviewed to determine if any easements of record affect the proposed development. 9. All easements of record reflected in the PTR should be shown on the site plan. Utilities: 10. Each unit/building will require a 4" private sewer lateral connected to the sewer main in Chinquapin Avenue. 11. The existing 8" VCP sewer main in Chinquapin Avenue fronts the westerly two thirds of the site. An extension may be required to serve the easterly unit/building. 12. Each unit/building will require a 1" water service and a 1" water meter. Water meters should not be located in the driveway or sidewalk. 13. There is an existing 8" PVC water line in Chinquapin fronting the site. General: 14. A three parcel map, or a one parcel three unit condominium application and a planned unit development application will be required. Coordinate with the Planning Division regarding the type of application(s) and the design/setback requirements for each. 15.
