The Planning Department has reviewed your Planned Development Permit, application no. PUD 88-04(M), as to its completeness for processing. The application is complete, as submitted. Although the initial processing of your application may have already begun,/ the technical acceptance date is acknowledged by the date of this communication. The City may, in the course of processing the application, request that you clarify, amplify, correct, or otherwise, supplement the basic information required for the application. In addition, you should also be aware that various design issues may exist. These issues must be addressed before this application can be scheduled for a hearing. The Planning Department will begin processing your application as of the date of this communication. At this time you may proceed with the construction. Please remember that installation must conform to the approved plans and a "Notice of Completion" shall be submitted within 30 days. The following comments are specific to the submitted plan. As a consultant to the Architectural Committee, I have reviewed the plans for compliance to the project CC&R's, dated March 26, 1998 and the Architectural Guidelines dated August 13, 1998. The Lightfoot Planning Group is not approving the means nor methods of the construction, installation, or guarantee to you or the Master Association. This is your sole responsibility and that of your contractor. The Lightfoot Planning Group is not responsible for reviewing, nor shall our approval of any plans or design be deemed approval of any plan or design from the standpoint of adequacy of drainage, structural safety, view impacts or conformance with building or other applicable codes. The applicant shall maintain and protect all existing walls and fences during construction. No existing walls and fences shall be filled against or altered in any way. Any vines or plants which are attached to or planted adjacent to La Costa Valley Master Association fencing shall be detached or removed by you when fencing maintenance is required. Any plant damage that occurs during any fence maintenance operation by the La Costa Valley Master Association is your sole responsibility. All existing drainage patterns shall be maintained per the CC&R's. The CC&R's shall take precedence in all situations. The plan as submitted, contains plans for front and rear yard landscape, hardscape, BBQ, water feature and architectural plans for a side and rear yard room additions. Based on my review of the plans and the Architectural Guidelines and CC&R's, the plan as designed is hi conformance to the Architectural Guidelines and CC&R's. Please note the following conditions of approval: 1. Existing walls and fences cannot be filled against or used as retaining walls. 2. All City of Carlsbad required setbacks must be met. 3. All trees must be planted a minimum of 3 feet from property lines. 4. All architectural details, materials and colors must match those of the existing residence. Mr. and Mrs. Reynolds July 11,2006 Page 2 As indicated above, all means of construction and implementation of the landscape plan is your sole responsibility and that of your contractor. All improvements shall meet the minimum requirements of the La Costa Valley Master Association CC&R's and Architectural Guidelines. If construction work requires the use of common area or access from property not owned by the applicant for any purpose of construction of this plan, the applicant shall obtain written permission prior to beginning construction, from the Master Association or property owner for die right to enter during construction. Please send a "Notice of Completion" form to Professional Community Management once you have completed the project so that I can verify that the improvements have been installed in conformance with the approved plan. Our recommendation of approval and approval of the Board does not take precedence over the requirements and regulations of the City of Carlsbad.
