Findings of Exemption (attach as necessary):
The City of Carlsbad Planning Department has completed an Environmental Initial
Study for the above referenced property, including evaluation of the proposed
project's potential for adverse environmental impacts on fish and wildlife resources.
Based on the completed Environmental Initial Study, the City of Carlsbad Planning
Department finds there is no evidence before the City of Carlsbad that the proposal
will have potential for an adverse effect on wild life resources or the habitat upon
which the wildlife depends.
The City of Carlsbad has on the basis of substantial evidence, rebutted the
presumption of adverse effect contained in AB 3158 Chapter 1706 Section 753.5(d).

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a significant effect on the environment.
The Environmental Impact Assessment appears in the following pages in the form of a checklist. This checklist
8 identifies any physical, biological and human factors that might be impacted by the proposed project and
provides the City with information to use as the basis for deciding whether to prepare an Environmental
Impact Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or
any of its aspects may cause a significant effect on the environment. On the checklist, "NO" will be checked
to indicate this determination.
* An EIR must be prepared if the City determines that there is substantial evidence that any aspect of the
project may cause a significant effect on the environment. The project may qualify for a Negative
Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed
insignificant. These findings are shown in the checklist under the headings "YES-sig" and "YES-insig"
respectively.
A discussion of potential impacts and the proposed mitigation measures appears at the end of the form under
DISCUSSION OF ENVIRONMENTAL EVALUATION. Particular attention should be given to discussing
mitigation for impacts which would otherwise be determined significant.

DISCUSSION OF ENVIRONMENTAL EVALUATION
The proposed development involves a four lot, three unit single family subdivision on a 1.1 acre lot, located
on the northern shore of the Agua Hedionda Lagoon. The parcel is currently undeveloped and the lower
portion is occasionally used for boat trailer parking. The site slopes from Adams Street towards the lagoon
and the floodplain lies approximately 320 feet from the street. The lot directly to the east is vacant and the
lot to the west contains a private boat club and an intermittently operating restaurant.
The proposed development involves 4,125 cubic yards of grading, with 3,675 cubic yards of import and 450
cubic yards of cut. The proposed grading form two pad areas, generally following the existing terrain, and
a 30 foot wide private street. Two of the single family homes will be two story and all will be Spanish
Colonial style with varied roof lines and patios. To preserve lagoon view, the elevation of the homes will be
below the centerline elevation of Adams Street, as required by the Local Coastal Program. The proposal
includes an open space easement which creates an over 100 foot wide buffer between any development and
the floodplain. A public access easement traverses the site within this buffer to allow pedestrian access along
the lagoon's northern shore.
Based upon field investigations, and after review of the proposed development, it has been determined that
no significant environmental features exist on the site and the proposed development will no cause any
significant adverse environmental impacts.
PHYSICAL ENVIRONMENT
1. No existing geologic hazards exist on site and the proposed grading will meet compaction and
stability standards. The in-fill project will not result in unstable earth conditions or increase the
exposure of people or property to geologic hazards.
2. The proposed development will follow the sloping topography and there are no unique physical
features on the site, therefore, no topographic impacts will result.
3. All standard erosion control practices shall be implemented during grading and construction of the
proposal and no erosion on or off-site should occur.
4. The area of development, including construction operations,

5. Construction and occupation of the three dwelling units will result in an incremental increase in
the production of aerosols, however this short-term, incremental increase is not considered
significant.
6. The site surface will be altered, thereby changing the surface moisture and temperature
characteristics, however no substantial changes in air movement, odor, moisture, or temperature
should result form this in-fill project.
7. While the project borders on Agua Hedionda Lagoon, and a portion of the site is within the 100-
year floodplain, the area of development is at least 100 feet from such waters and no alteration in
the course or flow of water will result.

8. Construction and occupation of the three unit project will produce an incremental increase in water
consumption, however this small increase is considered insignificant and no adverse affect on the
quantity and quality or surface water, ground water or public water supply shall occur.
9-10. An incremental increase in the consumption of fossil fuels will result during construction and
occupation of the residential project, however this short-term incremental increase is not considered
significant.
11. Based upon field visits, no significant archeological, paleontological or historic resources exist with
the previously disturbed project area and, therefore, no significant impacts to such resources are
anticipated.
12-13. The project area is currently disturbed and does not contain a significant diversity of plants. The
proposed new species of plants are typical for those in the developed area of the City and no
significant adverse impacts to flora should result.
14. No agricultural crops are grown nor does any farmland exist within the project site, therefore no
adverse impacts to such are anticipated.
15-16. The project area is currently disturbed. No significant diversity of animals exist on the project site
and the project does not propose to introduce any new species of animals. No significant adverse
impacts to fauna should result.
HUMAN ENVIRONMENT
17. This three unit residential project is consistent with the underlying land use designation and no
alteration to planned land use is proposed or required.
18. The project will incrementally increase the demand for public utilities, schools, police, fire,
emergency and other public services, however this incremental increase can be accommodated with
the existing systems and services, as required by the City's Growth Management Ordinance.
19. No new or modified waste systems will be required due to the project and no adverse impacts to
existing facilities are expected.
20. An incremental increase in noise levels will occur during construction and occupation of the project,
however this short-term increase in noise is considered insignificant.
21. No new significant sources of light or glare will be introduced with the project therefore no adverse
impacts are anticipated.
22. No significant risk of explosions exist and no hazardous substances are proposed to be included in
the project. No significant impacts are anticipated.
23-24. The three unit residential project will not substantially alter the density or human population, nor
will it affect existing housing, as the property is designated for residential development of this scale.

25-26. The approximately 30 additional average daily trips generated by the project can easily be
accommodated by the existing road system and all required parking will be contained on site. No
adverse impacts to existing parking facilities should result from the project.
27. No present patterns of circulation traverse the site and the additional traffic generated by the
project will not adversely impact existing transportation systems.
28. No waterborne, rail or air traffic use the project area therefore no impacts to such will exist.
29. Standard traffic safety signage and protection measures will be incorporated into the project and,
therefore, no significant traffic hazards to motor vehicles, bicyclists or pedestrians should occur.
30. No emergency response or emergency evacuation plans involve the project area, therefore no
impacts to such are expected.
31. The residential development is designed in accordance with the Agua Hedionda Land Use Plan, thus
preserving lagoon views from Adams Street. The project will, therefore, not obstruct a scenic vista
nor create an aesthetically offensive public view.
32. No recreational opportunities exist within the area of construction and an easement will be
dedicated to provide for a lateral lagoon access trail. No adverse affects to the quality or quantity
of existing recreational opportunities will result.
33. The proposed project does not encroach into any undisturbed areas or areas of environmental
significance, therefore it will not degrade the quality of the environment or any ecosystem, nor will
it eliminate any examples at California history or prehistory.
34. No significant long-term adverse environmental affects are anticipated with the construction and
occupation of this in-fill residential project.
35. All affects of this project are all below the level of significance, therefore they are not cumulatively
considerable and no cumulative adverse impacts are expected.
36. The project will provide housing in a residentially-designated neighborhood and all construction
must follow all required safety practices, therefore, no substantial adverse effects on human beings
is anticipated.

ANALYSIS OF VIABLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS:
a) Phased development of the project,
b) alternate site designs,
c) alternate scale of development,
d) alternate uses for the site,
e) development at some future time rather than now,
f) alternate sites for the proposed, and
g) no project alternative.
a) Since the entire project is integrated with respect to grading, phasing is not logical nor is it
environmentally advantageous.
b) The project has been designed with over 100 foot separation from the lagoon and with building heights
that continue to allow scenic views. Alternate site designs would not offer the same environmental
advantages.
c) The scale of the proposed development fits within the constraints of the property and is in keeping with
surrounding development.
d) The site is designated for residential uses and alternate uses may increase the opportunity for
environmental impacts.
e) Since the site is a vacant, infill project, no advantages would be gained by postponing development.

On the basis of this initial evaluation:
