FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2 The following findincis have been made in order to approve the Administrative Redevelopment Permit for the addition of outdoor tables and chairs within the existing patio area on the west side of Pizza Port restaurant: 1. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. 2. The Housing and Redevelopment Director has determined that the project is consistent with all applicable development standards and land use policies set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan. 3. The Housing and Redevelopment Director has determined that the project is consistent with the certified local coastal program and the goals and objectives of the Coastal Commission for the portion of the Village Redevelopment Area which lies within the Coastal Zone Boundaries. The Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines and will not have an adverse significant impact on the environment. The following conditions have been approved for the subject project: 1. This approved permit serves as the required redevelopment and coastal development permits for the subject project. 2. The project shall be completed according to, and be consistent with, the plans approved by the Housing and Redevelopment Director on the date noted above. The approved plans have been stamped by the Housing and Redevelopment Director and indicate the approval date of T/SICO. 3. This permit allows the applicant to provide a total of 137 seats inside the subject restaurant and a maximum of 66 seats within the outdoor patio area. 4. The applicant shall acquire necessary building permits for the reconstruction of the patio cover in accordance with the approved plans. Prior to the placement of tables and chairs within the existing patio area, reconstruction of the patio cover shall be completed and a final inspection secured for the permit. 5. Exiting systems for the new gates and table placement must be completed to the satisfaction of the Building Inspector and Deputy Fire Marshall prior to occupancy of the patio area. 6. The project must comply with the latest State Disabled access regulations for the existing building. 7. Acceptable furniture has been approved as part of this application. This furniture shall not change without prior written approval from the Housing and Redevelopment Director. 8. The umbrellas shall be constructed of a wood or metal framework and shall be covered with a fabric material. No vinyl umbrellas shajl be permitted. There shall be no advertising on the umbrellas. 9. The outdoor patio area shall be maintained in a clean and sanitary manner. The area shall be kept free of all litter. 10. The applicant shall obtain a license from the State Department of Alcohol and Beverage Control to serve alcoholic beverages within the outdoor patio area. 11. The City of Carlsbad and the Carlsbad Redevelopment Agency reserve the right to modify the hours of operation of the outdoor patio area at any time based on citizen complaints, and/or health, safety, or public welfare concerns. 12.
