All items needed for engineering review are provided for determining the application as complete. Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1. Per Table 13.10.020(c) of the Carlsbad Municipal Code, seats allowed in outdoor cafes or sidewalk cafes as defined by the Village Master Plan and Design Manual do not count toward generation of sewer impact fees. Therefore, if the Redevelopment Department determines that the proposed outdoor seating is defined to be within an "outdoor cafe", no sewer fees will be assessed. 2. If the applicant will need to increase the water meter size then the difference between the cost of the existing meter and the proposed meter must be paid for the potable connection fee, the meter fee, and the SDCWA fee. The applicant should contact the Carlsbad Municipal Water District early in the process to determine if a larger meter is necessary. The fees for the meters are attached. 3. On the site plan: a) show the dimensions of the patio area; b) add the sewer and water district serving the property; c) add the Average Daily Trips generated by the proposed project (300 ADT per the square footage of the patio) and the existing project (300 ADT per the building square footage); d) add the owner's, applicant's and architect's name, address and phone number; e) provide a scale. 4. Do the patio and landscaped boxes exist? Are the proposed tables and chairs fixated onto the patio? Indicate the answers on the site plan, 5. The questionnaire that the applicant completed states that the water, gas and electric utilities will be extended to serve the outdoor area. The Housing and Redevelopment Department, together with other appropriate City departments has reviewed your Administrative Redevelopment Permit, application no. RPOO-02 and Coastal Development Permit, application no. CDPOO-12, as to their completeness for processing. This letter is intended as a follow-up to our meeting of March 17, 2000 in which we met to discuss issues raised by the Building Department and Housing & Redevelopment Department in relation to the above referenced project. As we discussed, the applications are incomplete as submitted. The purpose of this letter is to provide you with a written copy of those issues discussed in our meeting as well as additional comments received from other City departments. Attached are two lists. The first list is information which must be submitted to complete your application. This list of items must be submitted directly to the Redevelopment Office. All list items must be submitted simultaneously and a copy of this list must be included with your submittal. No processing of your application can occur until the application is determined to be complete. The second list represents issues of concern to staff. When all required materials are submitted to the Redevelopment Office, the City has an additional thirty (30) days to make a determination of completeness. If the application is determined to be complete, processing for a decision on the application will be initiated. In addition, please note that you have six months from the date the application was initially filed, March 3, 2000, to either resubmit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed to constitute withdrawal of the application* If an application is withdrawn or deemed withdrawn, a new application must be submitted. The application and plans submitted for this project are incomplete and unsuitable for further review due to the following missing or incomplete items: 1. Please include and/or clarify the following information on the floor plan: a. Show exact location of outdoor tables and chairs, include umbrellas if they are proposed. b. Provide a picture or drawing showing the design, materials and colors of the proposed outdoor furniture. Furniture should be of a uniform color and design and of substantial construction to withstand outdoor use. Umbrellas should be made of a wood or metal framework and should be covered with fabric. c. Modify floor plan to reflect actual layout of existing restaurant. d. Clarify if existing fencing along the front of the patio is to remain and if a gate will be added. Indicate height of fencing on plans. e. Indicate 42" high fencing along the back of the patio is proposed. Clarify if a gate or alternative opening is proposed at the back of the patio. Building Department: The Building Department has completed its review of the subject project for application completeness. The application and plans submitted for this project are incomplete and unsuitable for further review due to the following missing or incomplete items: 1. The existing wood patio cover was built too close to the adjacent property line and is classified as an existing code violation. Since the area was not intended or permitted to be used, the structure was not required to be removed or modified at that time. Use of the patio area now requires that the structure be brought into conformance. The support posts of the patio cover must be setback at least ten feet (10') from the westerly property line. A two foot (2') overhang is permitted into the 10' setback area. Please indicate on the revised plans if some other material is proposed for the patio cover. This will require further review by the Building Department. 2. The rear exit of the building may not be impeded in any way. Six feet (6') of clearance is required in front of the doorway. 3. A legal exit must be provided from the patio area. One gate with appropriate hardware will serve this purpose. I'll have to give you some background first. The original tenant, Brett, recieved the tenant improvement permit with the woodednpatio cover on the west elevation. This cover extends all the way to the property line and is a code vioaltion. Since Brett did not have permits to use the space, it was not required to be removed or modified at that time. Now is the time it appears. The patio cover must be setback at least ten (10) feet from the west property line. This is achievable even though it will be a moderate expense for Vince and Gina. It could overhang into that space 2 feet if they choose. No other modifcations are necessary if it is going to be an open lattice cover. If they want it weatherproof, I think I'd like to take a more in depth look at the structural aspects of it. Their application documents ought to resolve this setback issue now. The fencing is needed to meet ABC requirements. However, the rear exit from the restaurant cannot be impeded in any way (same as the Boar Crossin'). If fencing is installed per their plan, it will definitely impede egress. Perhaps we can sit down with them and problem solve the fence and gate issues before they get in too deep. At first glance it looks like if the fenced right across the front of the H'cap parking space, thwey'd be ok as far as the restaurant exit is concerned. They will also have to have a legal exit from the patio area (one gate with the appropriate door hardware. As noted above, this project is feasible; it just needs some adjusting. The new h'cap parking spot wasn't shown however. Presumably, it'll be on the final site plan somewhere on site. We discussed having it closer to the public sidewalk near the grain tower. The building code assigns an occupant load of 24" per person for fixed bench seating. So it looks like there are about 58 additional occupants outside (6 people per six foot picnic table and one per bar seat). The restaurant looks like it has about 137 seats in it now. (6 per 6 foot table, 4 per 4 foot table and one per bar seat). As I recall, the outdoor seating cannot exceed the indoor seating, at least in Redev. The revised patio cover is a positive improvement The footings look a little small if we use the Clity standard detail sheet (attached) Feel free to forward this to the Marsaglia's if you wish. By the way, a lot of our front counter handouts are on the Faraday Community drive if you guys have access to that data base. Thanks for including some old "stuff' into this project. It's nice to clean up an old sore spot once in while. Project plans should be revised to include and/or address the following: a. Location of new disabled parking space with proper dimensions shown. Please note the location of the new disabled parking space cannot result in the loss of existing landscape area. b. Show dimensions of modified parking space located adjacent to outdoor dining area. Standard parking space is 8'-6" x 20'. Compact space is 8' x 15'. A maximum of 40% of the total parking can be compact spaces. c. Include a table on the plans showing the total number of seats inside the restaurant and the total number of seats outside the restaurant. In accordance with the Building Code, 24" of fixed bench seating is equivalent to one seat (i.e. 6 seats per 6 foot table, 4 seats per 4 foot table, and one per bar seat). d. Label umbrellas and existing planters on the site plan. e. Dimension 6-foot clearance between rear exit and proposed wrought iron fence. f. Is there a fence or gate proposed between the outdoor dining area and the outdoor dining area? 2. The standards for outdoor dining do not allow any other fixtures other than tables and chairs. Therefore, the proposed bar area cannot be approved without being considered an expansion of the existing use, which will require additional parking. Staff recommends the removal of the bar area from the pians. Fire Department 1. Provide the following note on the plans: All doors and gates must be equipped with panic hardware and no other locking device. Building Department 1. Revised patio cover is a big improvement. However, the proposed footings appear to be too small. Please see attached standard detail sheet for appropriate footing size. Engineering Department 1. Revise the average daily trip counts as shown on the corrected site plan. A redlined check print set has been included with this letter to graphically depict the comments discussed above. Cross slopes of walking surfaces shall be the mimmum possible and shall not exceed inch (6 mm) perfoot (2.083% gradient). The slope ofany appreciably warped walking surface shall not ex- ceed 1 unit vertical in 12 units horizontal (8.33% slope) in any di- rection. Where pedestrian grade separations cross streets or other vehicular traffic ways, and where a street level crossing can rea- sonably and safely be used by persons with physical disabilities, there shall be provided conforming curb ramps and a usable path- way. EXCEPTIONS: 1. When the grade differential of the walking sur- face ofa pedestrian grade separation exceeds 14 feet (4267 mm) due to required height clearance and grade conditions, and the enforcing agency finds that because of right-of-way restrictions, topography or natural barriers, wheelchair accessibility or equivalent facilitation would create an unreasonable hardship, such accessibility need not be provided. However, the requirements in these regulations relating to other types of mobility shall be complied with. 2. For existing facilities, this section shall not apply where, due to legal or physical constraints, the site ofthe project will not allow com- pliance with these regulations or equivalent facilitation without creat- ing an unreasonable hardship. NOTE: See Section 101.17.11, Item 4. SECTION 1129B REQUIRED ACCESSIBLE PARKING 1129B.1 General. Each lot or parking structure where parking is provided for the public as clients, guests or employees, shall provide accessible parking as required by this section. Accessible parking spaces serving a particular building shall be located on the shortest accessible route of travel from adjacent parking to an accessible entrance. In parking facilities that do not serve a par- ticular building, accessible parking shall be located on the short- est accessible route of travel to an accessible pedestrian entrance of the parking facility. In buildings with multiple accessible en- trances with adjacent parking, accessible parking spaces shall be dispersed and located closest to the accessible entrances. Table 11 B-6 establishes the number of accessible parking spaces re- quired. EXCEPTION: This subsection shall not apply to existing facilities where compliance with local ordinances precludes satisf\ing the above requirements or of providing equivalent facilitation unless a change of occupancy occurs. 1129B.2 Less Than Five Spaces. When less than five parking spaces are provided at buildings and facilities subject to these reg- ulations, one shall be 14 feet (4267 mm) wide and lined to provide a 9-foot (2743 mm) parking area and a 5-foot (1524 mm) loading and unloading area. However, there is no requirement that the space be reserved exclusively or identified for use by persons with disabilities only. II29B.3 Medical Care Outpatient Facilities. At facilities pro- viding medical care and other services for persons with mobility impairments, parking spaces complying with this section shall be provided in accordance with Table II B-6 except as follows: 1. Outpatient units and facilities. Ten percent of the total number of parking spaces provided serve each such outpatient unit or facility. 2. Units and facilities that specialize in treatment or services for persons with mobility impairments. Twenty percent ofthe to- tal number of parking spaces provided serve each such unit or facility. Accessible parking spaces shall be located as near as practical to a primary entrance and shall be sized as follows: 1. Dimensions. Where single spaces are provided, they shall be 14 feet (4267 mm) wide and outlined to provide a 9-foot (2743 mm) parking area and a 5-foot (1524 mm) loading and unloading access aisle on the passenger side ofthe vehicle. When more than one space is provided in lieu of providing a 14-foot-wide (4267 mm) space for each parking space, two spaces can be provided within a 23 foot-wide (7010 mm) area lined to provide a 9foot (2743 mm) parking area on each side ofa 5-foot (1524 mm) load- ing and unloading access aisle in the center. The minimum length of each parking space shall be 18 feet (5486 mm). See Figure 11B-18A. 2. Van space(s). One in every eight accessible spaces, but not less than one, shall be served by an access aisle 96 inches (2438 mm) wide minimum and shall be designated van accessible as re- quired by Section 1129B.5. All such spaces may be grouped on one level ofa parking structure. 1-134.35 City of Carlsbad RESIDENTIAL PATIO COVERS Building Department Patio covers are one story, roofed structures not more than 12 feet above grade and used for outdoor recreational purposes. A Building Permit is required for patio covers attached to a residence. Residential patio covers less than 300 square feet in size and at least ten feet from any other structure on the lot do not require a building permit from the City. But all patio covers, permitted or not, must comply with the setback requirements in this handout. This hand out describes what plans are necessary to secure a patio cover permit. To assist you, there is a sample of a plot plan, span tables for joists, and beams, and there is a footing schedule for foundation requirements. There are also connection details to use for typical connections. You may use this handout in lieu of a separate design when the patio cover is attached to the house on one complete side. If you design the patio cover yourself, or your patio cover is either free-standing or outside the span table limits in this handout, please provide a foundation plan, framing details, and other details and elevations to show the extent of the proposed work. A lateral analysis may be required for free-standing patio covers. If you use the attached tables and plans please submit: 1. Two Identical Site Plans showing: a) Property lines with dimensions. b) Proposed roof area of the patio cover. c) Distances from posts to property lines. d) All existing structures on the property. e) Indicate the dimensions ofthe patio cover and the total roofed area. f) Any easements on the property. g) Show slopes or topography of the lot 2. A Building Permit Application with the following: a. Name of the property owner. b. Home Phone Number c. Site address, assessor's parcel number, lot number, subdivision name or number. d. Contractor's name. State License Number and City Business License Number; or an Owner-Builder Declaration Form (Available atthe Building Department Counter). e. Concrete a) All concrete for footings must be a minimum of 2,000 psi. 2. Lumber a) Lumber must be Douglas Fir-larch No.2 or Better. Lumber must be grade marked. All posts must be a minimum of 4x4 and may be required to be protected from decay and termites if within 6" of finish grade. 3. Connections a) Post anchorage shall be accomplished with a standard manufactured post base installed per the manufacturer's instructions. Footings are required when the post supports a load exceeding 750 pounds. For lesser loads, a 3 V-T slab on grade section may be substituted for required footings. b) When the house is used to support one end of the patio cover, the main beam may be replaced on the side attached to the house by a ledger. The ledger shall be the same size as the rafters and fastened to the structural frame of the house by x 5" lag screws spaced at 32" on center for rafters up to a 10' span. Lag screws must be spaced at 16" on center for rafters between 10'1" and 20'. Rafters may not be solely supported by the existing rafter tails or facia of the house. 4. Patio Enclosures a) Patios may be enclosed as long as the following criteria is followed: 1) The enclosure walls may have any configuration provided the open area of the longer wall and one additional wall is equal to at least 65% of the area below 6'8" of each wall as measured form the floor (see City of San Diego Building Newsletter 31- 2) Openings may be enclosed with insect screening or plastic that is readily removable translucent or transparent plastic not more than 1/8" in thickness. ( See figures 3 and 4 above) 3) A patio enclosure requires a permit. The permit may be issued as part of the original patio cover permit, or it may be obtained at a later time. Enclosures may be used for outdoor recreational purposes only . Patio enclosures may not be used as habitable space. 5. Tables a) The above span and footing tables make the following assumptions: 1) Roof live load is 10 psf 2) Roof dead load is 7 psf 3) All lumber is Douglas fir-larch No.2 or Better; Fb = 825 psi Fv = 90 psi E = 1,200,000 psi Repetitive member use All posts are 4x4 minimum Soil bearing pressure is 1000 psf minimum 6. Electrical a) All electrical work in a patio cover or enclosure shall be weather tight as for exterior installations. 7. Inspections 1) Normally two inspections of a patio cover are required: 1) When footings have been excavated but before concrete has been placed, (note: photographs of footings are not an acceptable substitute for an inspection of required footings). 2) When all structural framing is completed. If solid roof sheathing is installed over the framing, a roof nailing inspection is required prior to placing the roof covering. Note: The project is not legally complete until the inspector of record signs the space on the job record card as final. 3) The job record card and approved plans must be available for all inspections. The job record card and approved plans should then be retained by the owner as a record of the approved construction. 8. Patio covers in PUD's and Condominium projects a) All patio covers must comply with the above requirements. b) Posts supporting the patio cover cannot be located closer than 3' to the property line unless they are protected by one-hour construction (e.g. stucco) c) The patio cover roof may only project one foot into the three foot setback area. It must also have one hour protection as noted above. d) Proof of HOA architectural approval must be shown. e) For the property lines of a project, all applicable setback requirements for the underlying zone shall be complied with. If the underlying zone is P-C, the setback requirements of the PUD ordinance shall be complied with. Setbacks for PUD's and P-C Zones may be more restrictive than typical R-1 setbacks or minimum Building Code setbacks.
