All items needed for engineering review are provided for determining the application as complete. Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1. Provide a site plan of the entire property. Complete detail of the entire site is not needed (i.e. planter types), but the location of driveways, the drive-thru, building envelope, and parking need to be shown. Also,: a) show the existing on-site utilities, including but not limited to, the location of water lines, water meters, sewer lines, storm drain lines, fire hydrants, and gas lines. What utility does the existing manhole serve? b) Label the street names, Harding Street and Carlsbad Village Dr. c) Label all easements on the property. The existing manhole suggests that a public easement crosses the property. d) Label the public right-of-way boundary. e) indicate the height of the existing monument sign. f) provide the property owner's, applicant's and architects name, address and phone number. g) Provide property assessor parcel number, legal description, and address. h) Indicate curb face and street center line to right-of-way width. i) Correct the number of square planters from 6 to 5 on the leader note, j) Provide a north arrow. k) Average Daily Trips generated by the project. Show existing ADT and additional ADT based on the area enclosing the outdoor eating area. I) indicate the area of the outdoor eating area 2. Provide a recent title report, preferably dated within the last 6 months. 3. What type of plants will be planted in the proposed planter boxes? 4. Per Table 13.10.020(c) of the Carlsbad Municipal Code, seats allowed in outdoor cafes or sidewalk cafes as defined by the Village Master Plan and Design Manual do not count toward generation of sewer impact fees. Therefore, if the Redevelopment Department determines that the proposed outdoor seating is defined to be within an "outdoor cafe", no sewer fees will be assessed. 5. If the applicant will need to increase the water meter size then the difference between the cost of the existing meter and the proposed meter must be paid for the potable connection fee, the meter fee, and the SDCWA fee. The applicant should contact the Carlsbad Municipal Water District early in the process to determine if a larger meter is necessary. The fees for the meters are attached. Attached is a redlined site plan to forward to the applicant. Please have the applicant return this redlined plan with his second submittal. In my letter, I asked for a complete site plan. I did this in the event that this gets appealed or the public wants to discuss a problem somewhere else on the property. I don't have issues with other portions of the site, but its good to have it there if other people do (i.e. problems with the drive-thru) have issues to discuss. The incidental Outdoor dining (21.04) does not include the redevelopment area. The project does not qualify as a sidewalk cafe since it's entirely out of the right-of-way. So I don't know what or where the development standards are for this, but it still looks fine (by all the other non- applicable standards). Please let me know if there are standards. Are you going to do and exemption for this? I don't have any additional comments or conditions. The decision of the Housing and Redevelopment Director is subject to a ten (10) day appeal period. The appeal period has elapsed and no appeals were filed. B • Carlsbad, CA 92008-2389 • (760) 434-2810/2811 • FAX (760) 720-2037 April 24, 2000 TO: CITY MANAGER FROM: HOUSING AND REDEVELOPMENT DIRECTOR JACK-IN-THE-BOX ON CARLSBAD VILLAGE DRIVE As requested, the following information is provided as a status report on current staff efforts as related to improvements at the Jack-in-the-Box Restaurant located on Carlsbad Village Drive at Harding Street. Last summer (1999), the corporate office for Jack-in-the-Box contacted our office to inform us that they would be replacing their roof at the Jack-in-the-Box restaurant on Carlsbad Village Drive, and wanted to know if any type of permit from our office would be required. We told them that they would not need any type of land use permit from our office ifthe replacement was "like for like" and there were no design changes. At that time, the representative also inquired as to whether or not they could remove the planters and replace the landscaping. For several years, the planters have had only grass planted in them with no plants, trees, etc. The grass was apparently difficult to maintain in the planters, and quite honestly added nothing to the exterior of the building. Also, the planters had some structural problems. At that time, we researched the permit system to determine if there were any approved land use permits which would outline the landscaping requirements for the building. There was no record of any type of land use permit (CUP or RP) or other approvals within the permit system which would indicate the specific requirements for this property. Therefore, we informed Jack-in-the-Box that they could remove the landscape planters. However, we told them that they needed to replace the landscaping according to a plan to be approved by our office. The roof was replaced and the landscape planters were removed several months ago. The roof was replaced "like for like" as indicated. However, there was an awning added over the drive- thru window. This is the only recent addition that could be considered a "design change" in their facade. Jack-in-the-Box still needs to finish the trim paint and install the new landscaping. Recently, Jack-in-the-Box made a request to add outdoor tables and chairs to their existing establishment. Under the ViUage Master Plan and Design Manual, this addition requires an administrative redevelopment permit. As part of this administrative redevelopment permit, staff has required a new formal landscape plan for the property. Attached is a copy of correspondence to Jack-in-the-Box as related to this matter. As a result ofthe recent Council inquiry on this project, staff completed some additional research on this property. We discovered that a Conditional Use Permit (CUP) was, in fact, issued for the project in 1981. Unfortunately, this permit had not been entered into the permit system. So, we were not aware of it when we initially researched the project. We have now reviewed the CUP project file, and the permit has been entered into the system for future reference. As one of the Council members indicated, this project did have challenges when it was processed originally in Jack-in-the-Box April 24, 2000 Page 2 1980/81. These challenges were related to circulation, traffic and parking. There was no specific discussion within the report related to design of the building or landscaping. It is not apparent that the building design was a significant issue at the time. However, there are plans within the file which indicate the design which was approved as part of the CUP. A review of the originally approved building elevations and the landscaping plan indicates that there have been very few changes to the building which are different than the original plans. The building as it currently exists appears to be very similar to the building that was approved by CUP 189, with some minor changes to the roof facade. Although the plans do not indicate a color for the building, based on the project description, it is evident that the color of the building has changed since the original approval, but we do not know the precise date of that change. Jack-in- the-Box changed the "brick" color of the building to white. This action was probably taken to update and brighten the look of the building. In addition, removal of the landscape planters makes a change to the building which is different than that which was originally approved. We will continue to work with Jack-in-the-Box to ensure that the replaced landscaping is visually appealing and enhances the facade of the building. The City's Landscape Architect Consultant is working with Redevelopment staff to ensure that an enhanced landscaping plan is provided by Jack-in-the-Box. The signage is in the same location as shown in the original plans. It is important to note, however, that the current signage type, and perhaps the amount of signage, would not be allowed under existing regulations. So, if Jack-in-the-Box proposes any changes to their signage, they would be required to comply with existing standards which specifically do not allow the intemally illuminated signs currently located on the site. In past years, Jack-in-the-Box has requested to add neon lighting to the exterior of their roof structure and to fly corporate flags on the roof These requests have been denied by staff At this time, Jack-in-the-Box is proposing no changes to the signage on the subject site.
