In regard to the Administrative Redevelopment Permit application no. RPOO-04 permitting the installation of Internet antennas on the Carisbad Inn, both your verbal and written comments were received following completion of the 10-day public review period and Housing and Redevelopment Director's approval of the project, but prior to the expiration of the appeal period. All administrative decisions are appealable to the Design Review Board. Therefore, if you wish to appeal the Housing and Redevelopment Director's decision on the subject project, the proper application and filing fee must be submitted to the Housing and Redevelopment Office by 5:00 p.m. on Monday, June 5, 2000. I have enclosed the appeal application for your use. The appeal fee is $400, plus noticing costs. Administrative Redevelopment Permit application no. RP99-17 also requested the installation of cellular antennas on the Carlsbad Inn. Both your verbal and written comments were received and considered prior to the Housing and Redevelopment Director rendering a final decision to approve the subject application. The appeal period for RP99-17 expires at 5:00 p.m. on June 12, 2000. If you wish to appeal the Housing and Redevelopment Director's decision on the project, the proper application and corresponding filing fee, as described above, must be submitted prior to the expiration date to the Housing and Redevelopment Department, 2965 Roosevelt Street, Suite B, Carlsbad, CA 92008. The subject applications were approved in accordance with the Federal Telecommunications Act which prohibits local jurisdictions from regulating the placement, construction, and modification of personal wireless service facilities on the basis of environmental effects of radio frequency emissions to the extent that such facilities comply with the Federal Communications Commission's (FCC) regulations concerning such emissions. The FCC is the designated body ensuring that such facilities comply with established standards. The site-by-site licensing process that the telecommunications carriers must go through with the FCC includes verification of compliance with adopted emissions standards. A local jurisdiction is limited to zoning laws that regulate the location and placement of wireless service facilities on the basis of conformance with established development standards and design guidelines applicable to the entire area. We believe that all current research is showing that all free radicals are extremely dangerous to humans and animals and antennas would most certainly fall into this category. Cell phones are currently being proven to cause brain tumors. Putting these antennas in such a densely populated (or in any populated area) area can be extremely hazardous to human health. As you know, the tail frequently wags the dog while parenting. Couple days at the academy of higher learning was actually ok. It was kind of interesting by comparison to other days. They discussed ethics and risk taking. Yikes! Comments re: the Antannae project: The conduit runs across the roof appear contrary to Building Department Policy 80-6 (attached). Perhaps they can find another route for the conduit other than across the roof surface. Otherwise, it requires a building permit after the RP is approved. A. Maintain roof integrity. B. Prevent hazardous condition to firemen who must fight fire on the roof. C. Provide an installation that is aesthetically sensitive to the building and the adjoining properties. POLICY: 1. All equipment shall be concealed from view and the design* shall meet the approval of the Planning Department. 2. All equipment shall be specifically designed and approved for exterior use and shall be approved by the City of Carisbad Building Department. 3. All roof mounted equipment shall be on a platform which shall be an integral part of the roof-flashed and waterproofed. When a screen is approved, it shall have as few roof connections as possible and be structurally adequate. 4. All electrical, plumbing, mechanical duct work and related piping shall be inside the building and not on the roof. All connections related to equipment shall be made in the same roof opening on the platform or have the prior approval from the building official. 5. Sewer vents shall be brought to one main vent below the roof and have one penetration where restrooms or other plumbing fixtures are back to back or in the general proximity. Air exhaust fans and other equipment shall be within the building and use the same roof opening where restrooms and other equipment are back to back or in general proximity. 6. Existing buildings and equipment, remodel or replacement, shall meet the above regulations or shall have the prior approval from the building official. 7. Where new equipment is installed, unused or abandoned equipment, including all roof mounted piping, electrical, mechanical, duct, and other related appurtenances shall be removed from roof and unused openings properiy sealed to maintain roof integrity. *The architect should, through design, conceal the heating/AC unit and other equipment whether they are on the roof or elsewhere.
