The clarity and accuracy of the information you provide is critical for purposes of quickly determining the specific environmental effects of your project. Recent judicial decisions have held that a "naked checklist," that is checklist that is merely checked "yes" or "no," is insufficient to comply with the requirements of the Califomia Environmental Quality act. Each "yes" or "no" answer must be accompanied by a written explanation justifying the "yes" or "no" answer. This is especially important when a Negative Declaration is being sought. The Environmental Impact Assessment appears in. the following pages in the form of a checklist. This checklist identifies any physical, biological and human factors that might be impacted by the proposed project and provides the City with information to use as the basis for deciding whether to prepare an Environmental Impact Report (EIR), Negative Declaration, or to rely on a previously approved EIR or Negative Declaration. • A brief explanation is required for all answers except "No Impact" answers that are adequately supported by an information source cited in the parentheses following each question. A "Nb Impact" answer is adequately supported if the referenced information sources show that the impact simply does not apply to projects like the one involved. A "No Impact" answer should be explained when there is no source document to refer to, or it is based on project-specific factors as well as general standards. • "Less Than Significant Impact" applies where there is supporting evidence that the potential impact is not adversely significant, and the impact does not exceed adopted general standards and policies. * * ' . ' • "Potentially Significant Unless Mitigation Incorporated" applies where the incorporation of mitigation measures has reduced an effect firom "Potentially Significant Impact" to a "Less Than Significant Impact." The developer must agree to the mitigation, and the City must describe the mitigation measures, and briefly explain how they reduce the effect to a less than significant level. "Potentially Significant Impacf is appropriate if there is substantial evidence that an effect is significant. Based on an "EIA-Part II", if a proposed project could have a potentially significant effect on the environment, but all potentially significant effects (a) have been analyzed adequately in an earlier EIR or Mitigated Negative Declaration pursuant to applicable standards and (b) have been avoided or mitigated pursuant to that earlier EIR or Mitigated Negative Declaration, including revisions or mitigation measures that are imposed upon the proposed project, and none of the circumstances requiring a supplement to or supplemental EIR are present and all the mitigation measures required by the prior environmental document have been incorporated into this project, then no additional environmental document is required (Prior Compliance). When "Potentially Significant Impact" is checked the project is not necessarily required to prepare an EIR if the significant effect has been analyzed adequately in an earlier EIR pursuant to applicable standards and the effect will be mitigated, or a "Statement of Overriding Considerations" has been made pursuant to that earlier EIR. A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or any of its aspects may cause a significant effect on the environment. Rev. 03/28/96 • If there are one or more potentially significant effects, the City may avoid preparing an EIR if there are mitigation measures to clearly reduce impacts to less than significant, and those mitigation measures are agreed to by the developer prior to public review. In this case, the appropriate "Potentially Significant Impact Unless Mitigation Incorporated" may be checked and a Mitigated Negative Declaration may be prepared. • An EIR must be prepared if "Potentially Significant Impact" is checked, and including but not limited to the following circumstances: (1) the potentially significant effect has not been discussed or mitigated in an Earlier EIR pursuant to applicable standards, and the developer does not agree to mitigation measures that reduce the impact to less than significant; (2) a "Statement of Overriding Considerations" for the significant impact has not been made pursuant to an earlier EIR; (3) proposed mitigation measures do not reduce the impact to less than significant, or; (4) through the EIA-Part II analysis it is not possible to determine the level of significance for £l potentially adverse effect, or determine the effectiveness of a mitigation measure in reducing a potentially significant effect to below a level of significance. A discussion of potential impacts and the proposed mitigation measures appears at the end of the form under DISCUSSION OF ENVIRONMENTAL EVALUATION. Particular attention should be given to discussing mitigation for impacts which would otherwise be determined significant. Section 15063(c)(3)(D). In this case a discussion should identify the following on attached sheets: a) Earlier analyses used. Identify earlier analyses and state where they are available for review. b) Impacts adequately addressed. Identify which effects from the above checkiist were within the scope of and adequately analyzed in an earlier document pursuant to applicable legal standards, and state whether such effects were addressed by mitigation measures based on the earlier analysis. c) Mifigation measures. For effects that are "Less than Significant with Mitigation Incorporated," describe the mitigation measures which were incorporated or refined from the earlier document and the extent to which they address site- specific conditions for the project. Rev. 03/28/96 DISCUSSION OF ENVIRONMENTAL EVALUATION Please use this area to discuss any of the environmental factors that were checked "No impact" yet lack any information citations and any factors that were checked "Potentially Significant Impact" ot "Potentially Sigmficant Impact Unless Mitigation Incorporated." The City has adopted a "Statement of Overriding Consideration" with regard to air quality and circulation impacts resulting from the normal buildout according to the General Plan. The following sample text is intended to guide your discussion ofthe impacts to these environmental factors. AIR OUALITY: The implementation of subsequent projects that are consistent with and included in the updated 1994 General Plan will result in increased gas and electric power consumption and vehicle miles traveled. These subsequently result in increases in the emission of carbon monoxide, reactive organic gases, oxides of nitrogen and sulfur, and suspended particulates. These aerosols are the major contributors to air pollution in the City as well as in the San Diego Air Basin. Since the San Diego Air Basin is a "non-attainment basin", any additional air emissions are considered cumulatively significant: therefore, continued development to buildout as proposed in the updated General Plan will have cumulative significant impacts on the air quality of the region. To lessen or minimize the impact on air quality associated with General Plan buildout, a variety of mitigation measures are recommended in the Final Master EIR. These include: 1) provisions for roadway and intersection improvements prior to or concurrent with development; 2) measures to reduce vehicle trips through the implementation of Congestion and Transportation Demand Management; 3) provisions to encourage altemative modes of transportation including mass transit services; 4) conditions to promote energy efficient building and site design; and 5) participation in regional growth management strategies when adopted. The applicable and appropriate General Plan air quality mitigation measures have either been incorporated into the design of the project or are included as conditions of project approval. Operation-related emissions are considered cumulatively significant because the project is located within a "non-attainment basin", therefore, the "Initial Study" checklist is marked "Potentially Significant Impacf. This project is consistent with the General Plan, therefore, the preparation of an EIR is not required because the certification of Final Master EIR 93-01, by City Council Resolufion No. 94-246, included a "Statement Of Overriding Considerations" for air quality impacts. This "Statement Of Overriding Considerations" applies to all subsequent projects covered by the General Plan's Final Master EIR, including this project, therefore, no further environmental review of air quality impacts is required. This document is available at the Planning Department. CIRCULATION: The implementation of subsequent projects that are consistent with and included in the updated 1994 General Plan will result in increased traffic volumes. Roadway segments will be adequate to accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely impacted by regional through-traffic over which the City has no jurisdictional control. These generally include all freeway interchange areas and major intersections along Carlsbad Boulevard. Even with the implementation of roadway improvements, a number of intersections are projected to fail the City's adopted Growth Management performance standards at buildout. Rev. 03/28/96 To lessen or minimize the impact on circulation associated with General Plan buildout, numerous mitigation measures have been recommended in the Final Master EIR. These include 1) measures to ensure the provision of circulation facilities concurrent with need; 2) provisions to develop altemative modes of transportafion such as trails, bicycle routes, additional sidewalks, pedestrian linkages, and commuter rail systems; and 3) participation in regional circulation strategies when adopted. The diversion of regional through-traffic from a failing Interstate or State Highway onto City streets creates impacts that are not within the jurisdiction of the City to control. The applicable and appropriate General Plan circulation mitigation measures have either been incorporated into the design of the project or are included as conditions of project approval. Regional related circulation impacts are considered cumulatively significant because of the failure of intersections at buildout of the General Plan due to regional through-traffic, therefore, the "Initial Study" checklist is marked "Potentially Significant Impact". This project is consistent with the General Plan, therefore, the preparation of an EIR is not required because the recent certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for circulation impacts. This report has been prepared in accordance with ASTM Standard Practice E-1527. The subject property is comprised of six (6) parcels (204-070-02 to 204-070-07). The subject property is currently divided into two (2) portions. The eastem portion is currently occupied by a vehicle towing company, and the westem portion is currently unoccupied (Figure 2). The ESA results are summarized as follows: • The subject property may have been developed for agricultural production prior to 1947. Several residences were apparently constructed at the subject property in the late 1940s to early 1950s. The subject property was later developed for commercial use in the late 1970s. Historical tenants of the subject property include a vehicle towing company, a concrete cutting company, and a rod iron fabricating facility. • The western portion of the subject property is currently unoccupied. This portion of the property consists of a vacant warehouse and an asphalt and gravel parking area. The eastem portion of the subject property is currently occupied by a vehicle towing facility. Small quantities of hazardous materials and/or regulated substances were observed at the vehicle towing facility, however no evidence of significant spillage and/or leakage was observed in connection with these items. Potential asbestos-containing materials (ACMs) were observed within the existing buildings at the subject property. An unauthorized release of cutting and machining oils occurred at the property located immediately north of the subject property. The plume of petroleum-impacted soil at the property located at 3235 Tyler Street appears to extend onto the northwest portion of the subject property. In PIC's judgement, adverse impacts to the subject property are negligible. Furthermore, any future assessment and/or mitigation requirements with regards to the unauthorized release are the responsibility of the ovmer of the property at 3235 Tyler Street, Soil Organic Solution, Inc. PIC recommends No Further Action at this time regarding environmental site assessment and/or mitigation at the subject property. PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carlsbad, Califomia Page 3 2.0 INTRODUCTION 2.1 Purpose of Investigation PIC Environmental Services (PIC) was contracted by Oceanside Glasstile, a prospective buyer, to perform a Phase I Environmental Site Assessment (ESA) for the property located at 3251 - 3281 Tyler Street in Carlsbad, Califomia (Figure 1). The objective ofthis investigation was to determine the potential for hazardous materials contamination from past or current uses of the subject site, or from operations at adjacent and nearby properties. 2.2 Involved Parties This ESA was authorized by and/or prepared on behalf of the following parties and any lenders providing fimding to the prospective buyer(s): PROPERTY OWNER(S): Mr. Jeff Vieyra PROSPECTIVE BUYER(S): Oceanside Glassfile 3235 Tyler Street Cadsbad, CA 92008 2.3 Scope of Work This Phase I Environmental Site Assessment was performed in general accordance with ASTM Standard Practice E-1527. The scope of this investigation included: Site inspection and appropriate interviews; Reconnaissance inspection of adjacent and nearby properties; Review of federal, state, and local regulatory agency records; Review of historical aerial photographs; and Review of topographic, geologic, and hydrologic information. A visual inspection for potential asbestos containing materials (ACMs) was performed, however building material samples were not collected and analyzed for ACMs or lead. An assessment of radon was performed on the basis of published literature. Site specific testing for radon was not performed. The scope of this investigation did not include a review of chain-of-title information (historical recorded title documents) regarding the subject property. PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carlsbad, Califomia Page 4 3.0 HISTORICAL OWNERSHIP AND USE Historical ovmership and use of the subject property was evaluated on the basis of personal interviews with current property owner and operator and 10 historical aerial photographs ranging in age from 1947 to 1999, reviewed at Aerial Fotobank of San Diego, Califomia. The six (6) parcels which comprise the subject property are currently owned by Jeff Vieyra, who purchased the property in October 1998. Jobe and Claudia Gay reportedly purchased the various parcels at the subject property between approximately 1975 and 1990, and Mr. and Mrs. Gay reportedly owned the property until 1998. The subject property and site vicinity may have been developed for agricultural use prior to 1947. The subject property appeared to be developed for residential use between 1947 and 1953. Approximately six (6) small residential buildings were present at the subject property from prior to 1953 until sometime between 1975 and 1980. Land use at the subject property appeared to become primarily commercial and/or industrial prior to 1980, and the warehouse building in the western portion of the property was apparently constructed between 1975 and 1980. The subject property has been reportedly occupied by a vehicle towing company, a concrete cutting company, and a rod iron fabricating company. Land use in the site vicinity appeared to be primarily agricultural and/or residential prior to the late 1950s to early 1960s, at which time the properties adjacent to the subject property to the north and south appeared to be developed for commercial/industrial use. Land use at the adjacent facilities appears to have remained commercial/industrial from prior to 1965 until present. PIC ENVIRONMENTAL SERVICES I I I I I Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carisbad, California Page 5 4.0 SITE SURVEY 4.1 Location The subject property is located on the west side of Tyler Street, north of the intersection of Tyler Street and Walnut Avenue, in Carlsbad, Califomia (Figure 1). 4.2 Site Description On June 11, 1999, PIC representatives conducted an inspection of the subject property. The subject property is comprised of six (6) parcels (204-070-02 to 204-070-07). The subject property is currently divided into two (2) portions with an access easement servicing the rear portion (Figure 2). The eastem portion of the property is currently occupied by a small office structure (former residence), a storage shed, a small storeroom, and a gravel parking area. The westem portion of the property is occupied by a commercial/industrial warehouse and asphalt and gravel parking areas. The eastem portion of the propert}' is currently operated by a towing company, and the westem portion of the property is currently vacant. Small quantities (typically less than one (1) gallon) of motor oil, coolant, and miscellaneous automotive fluids were observwed throughout the towing facility. No evidence of spillage or leakage was observed in association with these items. Several areas of minor staining were observed on the asphalt and gravel parking areas at the subject property. The source ofthe staining appeared to be motor oil which leaked from parked vehicles. The staining appeared surficial and it appears unlikely that the subsurface soil and/or groundwater beneath the subject property has been significantly impacted in association with the staining. No other evidence of hazardous material and/or regulated substance storage or release was observed. 4.3 Underground Storage Tanks & Containment Structures No underground storage tanks (USTs), above ground storage tanks (ASTs), sumps, ponds, clarifiers, berms, or other structures used to contain hazardous or regulated substances were observed on the subject property. 4.4 Asbestos Containing Materials A visual inspection was performed to identify' potential asbestos-containing materials (ACMs) on the subject property on June 11, 1999. ACMs commonly occur within the following types of building materials: Floor tile and floor tile mastic Wallboard composite PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21, 1999 RE: 3251-3281 Tyler Street, Carisbad, Califomia Page 6 • Acoustic ceiling material • Pipe and/or duct insulation • Textured paints and plasters This inspection did not include inspection of roofing materials nor did it include sample collection or laboratory analyses. Potential ACMs were observed within the office structure located in the southeast portion of the property. Potential ACMs include acoustic ceiling material, wall boards, and insulation. In addition, floor tiles were observed on a concrete slab west of the subject property. If friable or potentially friable ACMs are to be removed or disturbed for demolition or renovation, a licensed, Cal-OSHA registered asbestos abatement contractor must be used. All work must conform to EPA regulations Title 40 CFR 61, Final Rule, and OSHA regulations Title 29 CFR 1926.1101 and 1910.1001. 4.5 Polychlorinated Biphenyl Containing Equipment Transformers in the immediate site vicinity appear to be primarily pole-mounted. Pole-mounted transformers were observed along the southem limit ofthe access easement (Figure 2). In addition, one (1) pad-mounted transformer was observed in the northwest portion of the property. No evidence of leakage was observed on the ground surface around the transformers. The transformers did not contain stickers indicating "No PCB Content"; however, according to SDG&E personnel, transformers purchased and operated by SDG&E were not specified to contain polychlorinated biphenyls (PCBs). Less than 10% of the transformers operated by SDG&E contain fluid contaminated with PCBs. Furthermore, SDG&E assumes responsibility for operation and maintenance of transformers in compliance with all applicable federal, state, and local regulations goveming PCB-containing fluids. 4.6 Radon Radon is a colorless, odorless radioactive gas which comes from the natural breakdown of radium, which is itself a decay product of uranium. Uranium and radium are both common elements in soil. Based on available data, the major sources of high levels of radon is soil containing uranium, granite, shale and phosphate. Radon gas can enter structures through dirt floors, hollow-block walls, cracks in the foundation, floor, and walls, and openings around floor drains and pipes. In 1990, the Califomia Department of Health Services participated in the U.S. Environmental Protection Agency (USEPA's) State Radon Survey. According to the Califomia Statewide Radon Survey Interim Results report, no regions having highly elevated concentrations of radon were found during the survey. Of the 34 states surveyed to date, Califomia ranks as low as number 32 in terms of quantity of radon found. The only way to determine the amount of radon present in a particular building is to test it for radon using a radon detector. Radon assessment using detection equipment does not appear warranted at the subject site. 4.7 Adjacent Properties The subject property is bounded to the east by Tyler Street, to the north by multi-tenant industrial facility, to the west by a railroad easement, and to the south by a commercial/industrial facility. The area east of the subject property, across Tyler Street, is occupied by a residences, an automotive repair facility, and a graded parcel occupied by two (2) trailers. Land use at adjacent properties and within the immediate site vicinity is illustrated on Figure 2. No evidence of hazardous or regulated substances spillage or contamination was observed on adjacent or nearby properties. 4.8 Area Reconnaissance The immediate site vicinity and site are comprised primarily of commercial, industrial, and residential properties. A visual reconnaissance survey of nearby properties revealed no evidence of surface hazardous substances contamination threatening the subject property. Grade on the site generally slopes gently to the west towards an unlined drainage channel located immediately west ofthe subject property (USGS, 1968). 5.2 Soils/Geology The subject property is depicted on published geologic maps as being underlain by Pleistocene aged marine and marine terrace sediments which are underlain by the Tertiary aged Santiago Formation (CDMG, 1996). The Santiago Formation is characterized by light colored, poorly- bedded, poorly-indurated, fine-to medium-grained sandstone interbedded with landslide-prone siltstone and claystone. 5.3 Surface Water Hydrology Surface water runoff at the subject property appears to flow westerly towards an unlined drainage channel located immediately west of the subject property. Surface waters within the drainage channel flow southeast to the Agua Hedionda Lagoon which empties into the Pacific Ocean in Carlsbad, Califomia. 5.4 Wetlands There are no wetlands on the subject property, adjacent to the subject property, or in the immediate vicinity of the subject property. 5.5 Hydrogeology The site is located in the El Salto Hydrologic Subarea of the Buena Vista Creek Hydrologic Area, within the Carlsbad Hydrologic Unit. The groundwater within the immediate site vicinity is exempted from beneficial uses (Califomia Regional Water Quality Control Board, Water Quality Control Plan for the San Diego Basin (9), 1994). There are no water production wells depicted on the USGS topographic map within one (1) mile of the subject property. The depth to groundwater is estimated to be approximately 10 feet bgs, based on the results of groundwater monitoring operations at an adjacent facility. Information regarding the groundwater gradient direction was unavailable; however, the groundwater in the immediate site vicinity most likely flows towards west-southwest, based on local and regional topography. PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carlsbad, Califomia Page 9 6.0 REGULATORY AGENCY RECORDS REVIEW 6.1 Subject Property A search of current Federal, State, and Local regulatory agency databases was conducted by VISTA Information Solutions, Inc., San Diego, Califomia. The subject property (3281 Tyler Street) was listed as a RCRA small quantity generator. Jobe Gay Concrete Sawing reportedly generated 100 kg/month, but less than 1,000 kg/month, of non-acutely hazardous waste. The subject property was not listed in any of the other databases searched in the VISTA Site Assessment Plus report. 6.2 Properties in the Site Vicinity A search of current Federal, State, and Local regulatory agency databases was conducted by VISTA Information Solutions, Inc., San Diego, California for nearby properties in accordance with distances outlined in ASTM Standard Practice E-1527 guidelines. According to the VISTA Site Assessment Plus report, several sites within one (1) mile of the subject property were identified as potential environmental concems. Fifteen (15) sites with leaking underground storage tanks (LUST) sites were identified. At nine (9) of these sites the problem has been resolved and no further action is required. At six (6) of these sites, investigation and/or remediation work is underway. The nearest active LLIST case is located at 3235 Tyler Street, which is located adjacent to the northern border of the subject property. This site is listed due to an unauthorized release of lubricating oils to the subsurface soil and groundwater. A brief summary of site assessment operations and results at the property located at 3235 Tyler Street is provided below. An unknown quantity of cutting and machining oils, generated from manufacturing operations, were apparently released to the subsurface soil at 3235 Tyler Street. The source of the release, discharging oil-laden water directly to the ground surface and an earthen sump, was terminated several years ago. Based on the results of site assessment operations conducted at the site since 1992, a plume of petroleum-impacted soil and groundwater is present, primarily in the southwest portion of the site. The plume of petroleum impacted soil is well defined and appears to extend onto the northwest portion of the subject property. However, results of soil sampling operations conducted in May 1999, along the northem portion of the subject property, indicate that petroleum-impacted extends less than 25 feet onto the subject property. In addition, the groimdwater in the northem portion of the subject property is not impacted with petroleum hydrocarbons. The product detected in soil and groundwater samples recovered at 3235 Tyler Street appears to be oils that are characterized by relatively long carbon chains and does not possess toxic properties. Based on the nature and extent of impacted soil and groimdwater, the consultant for PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carlsbad, Califomia Page 10 the property located at 3235 Tyler Street, PIC Environmental Services, has recommended No Further Action with regards to site assessment and/or mitigation. A response from the County of San Diego Department of Environmental Health (DEH) is forthcoming. In PIC's judgement, impacts to the subject property as a result of the unauthorized release at 3235 Tyler Street are negligible. Furthermore, any future federal, state, and/or local assessment and/or mitigation requirements with regards to the unauthorized release are the responsibility of the owner of the property at 3235 Tyler Street, Soil Organic Solution, Inc. In PIC's judgement, it is unlikely that the subject property has been significantly impacted by releases of hazardous or regulated substances at any of the locations listed on the attached Site Assessment Plus Report (Appendix A). PIC ENVIRONMENTAL SERVICES Oceanside Glasstile June 21,1999 RE: 3251-3281 Tyler Street, Carlsbad, Califomia Page 11 7.0 RESULTS, CONCLUSIONS, AND RECOMMENDATIONS PIC Environmental Services prepared this Phase I ESA Report in general conformance with the scope and limitations of ASTM Practice E-1527. This ESA prompts the following results, conclusions, and recommendations: 1. The subject property may have been developed for agricultural production prior to 1947. Several residences were apparently constmcted at the subject property in the late 1940s to early 1950s. The subject property was later developed for commercial use in the late 1970s. Historical tenants of the subject property include a vehicle towing company, a concrete cutting company, and a rod iron fabricating facility. It appears unlikely that the subject property has been adversely impacted as a result of previous land use. 2. No evidence of significant spillage or release of hazardous or regulated substances was observed on the subject property. Small quantities of hazardous materials and/or regulated substances were observed at the subject property, however no evidence of significant spillage and/or leakage was observed in connection with these items. 3. Potential ACMs were identified within the office building in the southeast portion of the subject property and on a concrete slab located west of the office building. If friable or potentially friable materials are to be removed or disturbed for demolition or renovation, PIC recommends conducting an asbestos survey at the subject property to verify the presence or absence of ACMs at the subject property. All work should conform to EPA regulations Titie 40 CFR 61, Final Rule, and OSHA regulations Title 29 CFR 1926.1101 and 1910.1001. 4. An unauthorized release of cutting and machining oils occurred at the property located immediately north of the subject property. The plume of petroleum-impacted soil at the property located at 3235 Tyler Street appears to extend onto the northwest portion of the subject property. In PIC's judgement, adverse impacts to the subject property are negligible. Furthermore, any future assessment and/or mitigation requirements with regards to the unauthorized release are the responsibility of the owner ofthe property at 3235 Tyler Street, Dr. Soil Organic Solution, Inc. 5. It is unlikely that the subject property has been significantiy impacted by releases of h£izardous or regulated substances at any of the locations listed on the attached Site Assessment Plus Report fumished by VISTA Information Solutions, Inc. 6. PIC recommends No Further Action at this time regarding environmental site assessment and/or mitigation.
