10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
1. The construction and installation of small new equipment facilities or structures is a Class 3
Categorical Exemption under the California Environmental Quality Act (CEQA) State Guidelines
section 15303. The Federal Communications Commission (FCC) requires compliance with radio
frequency power density standards (ANSI/IEEE C95.1-1992) for the general public; therefore, the
project would not have a significant impact on the environment. In light of the above, a Notice of
Exemption will be filed upon final project determination.
The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment and coastal development permits
for the subject project. The applicant has received approval to install a 13' x 15' cellular
equipment facility within the existing underground parking structure and twelve (12) panel
antennas on the interior side of the existing parapet wall on the roof of Carlsbad By The Sea
Retirement Community located at 2855 Carlsbad Blvd.

2. The project shall be completed according to, and consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of T/I^IOQ.
3. No signage advertising the proposed use shall be permitted on the subject building.
4. The applicant shall obtain all appropriate building and electrical permits from the Carlsbad
Building Department prior to installation of the cellular antenna facility. Similarly, the applicant
shall secure all appropriate permits from the Office of Statewide Health Planning and
Development (OSHPD) for the antenna array and screening.
5. Colors and materials used to screen panel antennas shali match colors and materials of the
existing building. The panel antennas shall be covered by a fiberglass material that matches the
stucco of the existing structure.
6. The panel antennas shall not extend above the height of the existing parapet wall nor change the
exterior appearance of the parapet wall in any way.
7. The existing bicycle racks shall be relocated to another location within the underground parking
structure that does not impact existing parking or loading areas. Engineering staff has
confirmed a suitable location is available along the southeast wall.
8. Housing and Redevelopment staff shall conduct a final inspection of the antenna array and
associated screening prior to final inspection by the City Building Inspector.
9. This permit shall be subject to revocation if the applicant fails to conform to any of the above
conditions of approval.
