Indemnification and Insurance Requirement for Village Area Administrative Permit
Certification Statement:
I Certify that I am the Legal Business Owner of the subject business and that all of the above information is true
and correct to the best of my knowledge. I agree to accept and abide by any conditions placed on the subject
project as a result of approval of this application. I agree to indemnify, hold harmless, and defend the City of
Carlsbad and its officers and employees from all claims, damage or liability to persons or property arising from or
caused directly or indirectly by the installation or placement of the subject property on the public sidewalk and/or
the operation of the subject business on the public sidewalk pursuant to this permit unless the damage or liability
was caused by the sole active negligence of the City of Cadsbad or its officers or employees. I have submitted a
Certificate of Insurance to the City of Carlsbad in the amount of one million dollars issued by a company which
has a rating in the latest "Best's Rating Guide" of "A-" or better and a financial size of $50-$100 (currently class
Vll) or better which lists the City of Carlsbad as "additional insured" and provides primary coverage to the City.
I also agree to notify the City of Carlsbad thirty days prior to any cancellation or expiration of the policy. The

The insurance shall remain in effect for as long as the property is placed on the public sidewalk or the business
is operated on the public sidewalk. This agreement is a condition of the issuance of this administrative permit for
the subject of this permit on the public sidewalk. I understand that an approved administrative permit shall
remain in effect for as long as outdoor displays are permitted within the Village Review Area and the permittee
remains irrcorppliance with the subject approved permit.

Project Description and Justification
Project Description
There are currently (2) panel antennas per sector (3 sectors) at this site for a total of (6)
antennas. There are (2) sectors behind FRP screening on top ofthe building. The third sector is
on the fagade ofthe building but mostly hidden from view due to architectural elements in
front of it.
For this modification. Sprint proposes to remove all 6 existing (obsolete) antennas. Sprint will
then install (3) antennas per sector for a total of (9) antennas and also (3) RRHs per sector for a
total of (9) RRHs. The FRP screen in Sectors B and C will need to be raised in order to maintain a
stealth installation with the new, longer antennas. Sprint proposes to extend the screen
upward by 2 feet, changing the height ofthe structure from 42 feet above ground level to 44
feet above.
Sprint also proposes to install (1) new growth cabinet and (1) Top Hat cabinet extension to an
existing cabinet. Also proposed is a microwave dish (24" diameter).
Proiect Obiectives
The proposed site maintenance and technology upgrade is intended to provide the residents of
Carlsbad who are served by this facility, the latest in wireless technology by improving call
quality, data transmission and speed.
Statement of Justification/Findings
The project site is located in a Village Review zone, serving a great number of homes as well as
businesses in the surrounding area. Wireless telecommunication is now an indispensable part
of everyday life and wireless customers expect to be provided nearly flawless radio coverage at
all locations, at all times. The proposed project will provide improved radio coverage, improved
data reception and transmission and improved data download speeds within the surrounding
area to the benefit ofthe general health, safety, welfare and convenience ofthe public in the
vicinity of this facility.
The proposed project is in conformance with the City General Plan goals by furthering the
health, safety, welfare and convenience ofthe City's residents with the improvement and
continued operation ofthe wireless telecommunication facility in an area ofthe City currently
experiencing diminished wireless service. The proposed project is in conformance with all
Federal Communications Commission (FCC) regulations and for wireless telecommunication
facilities as documented in the attached FCC RF Report. All height, site and screening
requirements have been met by this project. Additionally, the installation is emergency 911
compatible with all wireless carriers.
Sprint is authorized and regulated bythe Federal Communications Commission (FCC) to operate
their wireless systems in the Southern California market area. Transmit is typically between 100

to 500 watts per antenna sector, transmitting and receiving at a frequency of 1850.0-1930-
1945.0 MHz. These levels are well below safety standards established by the FCC and no health
impacts are anticipated with this project in conformance with City goals for telecommunication
uses.
Sprint Companv Information
Sprint is one ofthe fastest growing nationwide service providers offering all digital voice,
messaging and high-speed data services to nearly 30 million customers in the United States.
Sprint is a "telephone corporation", licensed by the Federal Communications Commission (FCC)
to operate in the 1850.0-1865.0, and 1930.0-1945.0 MHz frequencies, and a state regulated
Public Utility subject to the California Public Utilities Commission (CPUC). The CPUC has
established that the term "telephone corporation" can be extended to wireless carriers, even
though they transmit signals without the use of telephone lines.
Sprint will continue to operate this facility in full compliance with the regulations and licensing
requirements ofthe FCC, Federal Aviation Administration (FAA) and the CPUC, as governed by
the Telecommunications Act of 1996, and subsequent modifications, the Middle Class Tax Relief
and Job Creation Act of 2012 (Section 6409) and other applicable laws.
The submitted application is presented for your consideration. Sprint requests a favorable
determination and approval to modify its existing wireless facility. Please contact me with any

EXECUTIVE SUMMARY
Purpose of Report
EnviroBusiness Inc. (dba EBl Consulting) has been contracted by Sprint to conduct radio frequency
electromagnetic (RF-EME) monitoring and modeling for Sprint Site SD36XC284 located at 2333 State
Street in Carlsbad, California to determine RF-EME exposure levels from existing and proposed Sprint
wireless communications equipment at this site. As described in greater detail in Section 11.0 of this
report, the Federal Communications Commission (FCC) has developed Maximum Permissible Exposure
(MPE) Limits for general public exposures and occupational exposures. This report summarizes the
results of RF-EME monitoring and modeling in relation to relevant FCC RF-EME compliance standards
for limiting human exposure to RF-EME fields.
EBl field personnel visited this site on December 02, 2013. This report contains a detailed summary of
the RF EME anal/sis for the site.
This document addresses the compliance of Sprint's proposed transmitting facilities independently at the
site.
Modeling results included in this report are based on drawings dated 8/12/2014 as provided to EBl
Consulting. Subsequent changes to the drawings or site design may yield changes in the MPE levels or
FCC Compliance recommendations.

and ground-level walking/working surface related to Sprint's existing and proposed equipment in the
area that exceed the FCC's occupational and/or general public exposure limits at this site. As such, the
existing and proposed Sprint project is in compliance with FCC rules and regulations.
Signage has been installed at the site as presented in Section 9.0. Posting of the signage brings the site
into compliance with FCC rules and regulations.

1.0 LOCATION OF ALL EXISTING ANTENNAS AND FACILITIES AND EXISTING RF LEVELS
Sprint proposes the addition of three (3) wireless telecommunication antennas on a rooftop in Carlsbad,
California. Additionally, there are six (6) existing Sprint antennas that are proposed to remain
unchanged. The proposed modification will result in a total of nine (9) Sprint antennas at the site. There
are three sectors (A, B and C) proposed at the site, with two (2) existing antennas and one (I)
proposed antenna per sector.
EBl conducted a site visit on December 02, 2013. At the time of the site visit, there were no other
wireless antennas collocated with the Sprint antennas on the rooftop located at 2333 State Street in
Carlsbad, California. Measurements were taken at the rooftop and ground to record RF-EME levels
resulting from the existing Sprint antennas prior to the installation of Sprint's proposed equipment.
During the survey, no spatially averaged power density readings above 0.5454% of the FCC's
occupational MPE (2.7270% of the general public MPE) were encountered on any rooftop surface. In
addition, no spatially averaged power density readings greater than 0.4920% of the FCC's uncontrolled
or general public MPE were encountered at ground level.
Monitoring results are presented in Appendix C.
2.0 LOCATION OF ALL APPROVED (BUT NOT INSTALLED) ANTENNAS AND FACILITIES AND
EXPECTED RF LEVELS FROM THE APPROVED FACILITIES
There are no antennas or facilities that are approved and not installed based on information provided to
EBl and Sprint at the time of this report.
3.0 NUMBER AND TYPES OF WIRELESS TELECOMMUNICATION SITES (WTS) WITHIN 100
FEET OF THE EXISTING AND PROPOSED SITE
There are no other VVireless Telecommunication Service (WTS) sites observed within 100 feet of the
proposed site.
4.0 LOCATION AND NUMBER OF THE SPRINT ANTENNAS AND BACK-UP FACILITIES PER
STRUCTURE AND NUMBER AND LOCATION OF OTHER TELECOMMUNICATION
FACILITIES ON THE PROPERTY
Sprint proposes the addition ofthree (3) wireless telecommunication antennas on a rooftop in Carlsbad,
California. Additionally, there are six (6) existing Sprint antennas that are proposed to remain
unchanged. The proposed modification will result in a total of nine (9) Sprint antennas at the site. There
are three sectors (A, B and C) proposed at the site, with two (2) existing antennas and one (I)
proposed antenna per sector. In each sector, there is proposed to be one antenna transmitting in the
2500 MHz frequency range and two existing antennas transmitting in the 1900 MHz frequency range.
The Sector A antennas will be oriented 325° from true north. The Sector B antennas will be oriented
70° from true north. The Sector C antennas will be oriented 180° from true north. The bottoms of the
Sector A antennas will be 7.7 feet (proposed) and 8.7 feet (existing) above the mezzanine. The bottoms
of the Sector B and C antennas will be 34.7 feet (proposed) and 35.7 feet (existing) above ground level.

Based on the information provided to EBl, the proposed sector A antennas are to be pipe-mounted
under the rooftop overhang and the sector B and C antennas are to be pipe-mounted on the rooftop
and operating in the directions, frequencies, and heights mentioned in section 4.0 above. There is a large
building approximately 62 feet southeast of the proposed site that appears to be of commercial use.
8.0 ESTIMATED AMBIENT RADIO FREQUENCY FIELDS FOR THE EXISTING AND PROPOSED
SITE
Based on worst-case predictive modeling, there are no modeled exposures on any accessible mezzanine
and ground-level walking/working surface related to Sprint's existing and proposed equipment in the
area that exceed the FCC's occupational and/or general public exposure limits at this site. As such, the
existing and proposed Sprint project is in compliance with FCC rules and regulations.

9.0 SIGNAGE AT THE FACILITY IDENTIFYING ALL WTS EQUIPMENT AND SAFETY
PRECAUTIONS FOR PEOPLE NEARING THE EQUIPMENT AS MAY BE REQUIRED BY THE
APPLICABLE FCC ADOPTED STANDARDS (DISCUSS SIGNAGE FOR THOSE WHO SPEAK
LANGUAGES OTHER THAN ENGLISH)
Signs are the primary means for control of access to areas where RF exposure levels may potentially
exceed the MPE. It is recommended that Notice signs be installed for the new antennas making people
aware of the antennas locations. There are no exposures above the FCC limits in front of the existing
and proposed antennas and therefore barriers are not recommended.
yVorkers that are elevated above the mezzanine and ground may be exposed to power densities greater
than the occupational limit. VVorkers should be informed about the presence of antennas and their
associated fields and practice RF Safety Procedures.
At the time of the site survey, it was noted that there was a blue "Notice" sign located on the interior
of the roof access hatch and on the interior of the mezzanine access door.
Access to this site is accomplished via an access hatch located on the main roof and an access door
located at the 4^^ floor mezzanine. Both the access door and hatch are locked and, as such, the general
public is unable to access the rooftop or mezzanine.
10.0 STATEMENT ON WHO PRODUCED THIS REPORT AND QUALIFICATIONS
Please see the certifications attached in Appendix B below.
11.0 LIMITATIONS
This report was prepared for the use of Sprint. It was performed in accordance with generally accepted
practices of other consultants undertaking similar studies at the same time and in the same locale under
like circumstances. The conclusions provided by EBl are based solely on the information collected during
the site survey and provided by the client. The observations in this report are valid on the date of the
investigation. Any additional information that becomes available concerning the site should be provided
to EBl so that our conclusions may be revised and modified, if necessary. This report has been prepared
in accordance with Standard Conditions for Engagement and authorized proposal, both of which are
integral parts of this report. No other warranty, expressed or implied, is made.
12.0 SUMMARY AND CONCLUSIONS
EBl has prepared this Radiofrequency Emissions Compliance Report for the existing and proposed Sprint
telecommunications equipment at the site located at 2333 State Street in Carlsbad, California.
EBl has conducted theoretical modeling combined with on-site monitoring to estimate the worst-case
power density from existing and proposed Sprint antennas to document potential MPE levels at this
location and ensure that site control measures are adequate to meet FCC and OSHA requirements. As
presented in the preceding sections, based on worst-case predictive modeling, there are no modeled
exposures on any accessible mezzanine and ground-level walking/working surface related to Sprint's
existing and proposed equipment in the area that exceed the FCC's occupational and/or general public
exposure limits at this site. As such, the existing and proposed Sprint project is in compliance with FCC
rules and regulations.

The FCC has established Maximum Permissible Exposure (MPE) limits for human exposure to
Radiofrequency Electromagnetic (RF-EME) energy fields, based on exposure limits recommended by the
National Council on Radiation Protection and Measurements (NCRP) and, over a wide range of
frequencies, the exposure limits developed by the Institute of Electrical and Electronics Engineers, Inc.
(IEEE) and adopted by the American National Standards Institute (ANSI) to replace the 1982 ANSI
guidelines. Limits for localized absorption are based on recommendations of both ANSI/IEEE and NCRP.
The FCC guidelines incorporate two separate tiers of exposure limits that are based upon
occupational/controlled exposure limits (for workers) and general public/uncontrolled exposure limits
for members of the general public.
Occupatiortallcontrolled exposure Umits apply to situations in which persons are exposed as a
consequence of their employment and in which those persons who are exposed have been made fully
aware of the potential for exposure and can exercise control over their exposure. Occupational/
controlled exposure limits also apply where exposure is of a transient nature as a result of incidental
passage through a location where exposure levels may be above general public/uncontrolled limits (see
below), as long as the exposed person has been made fully aware of the potential for exposure and can
exercise control over his or her exposure by leaving the area or by some other appropriate means.
General publicluncontrolled exposure Umits apply to situations in which the general public may be
exposed or in which persons who are exposed as a consequence of their employment may not be made
fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore,
members of the general public would always be considered under this category when exposure is not
employment-related, for example, in the case of a telecommunications tower that exposes persons in a
nearby residential area.
Table I and Figure 1 (below), which are included within the FCC's OET Bulletin 65, summarize the MPE
limits for RF emissions. These limits are designed to provide a substantial margin of safety. They vary by
frequency to take into account the different types of equipment that may be in operation at a particular
facility and are "time-averaged" limits to reflect different durations resulting from controlled and
uncontrolled exposures.
The FCC's MPEs are measured in terms of power (mW) over a unit surface area (cm^). Known as the
power density, the FCC has established an occupational MPE of 5 milliwatts per square centimeter
(mW/cm^) and an uncontrolled MPE of I mW/cm2 for equipment operating in the 1900 MHz and 2500
MHz frequency ranges. For the Sprint equipment operating at 800 MHz, the FCC's occupational MPE is
2.66 mW/cm^ and an uncontrolled MPE of 0.53 mW/cm^. These limits are considered protective of
these populations.

MPE limits are designed to provide a substantial margin of safety. These limits apply for continuous
exposures and are intended to provide a prudent margin of safety for all persons, regardless of age,
gender, size, or health.
Personal Communication (PCS) facilities used by Sprint in this area operate within a frequency range of
800-1900 MHz. Facilities typically consist of: I) electronic transceivers (the radios or cabinets)
connected to wired telephone lines; and 2) antennas that send the wireless signals created by the
transceivers to be received by individual subscriber units (PCS telephones). Transceivers are typically
connected to antennas by coaxial cables.
Advanced Wireless Services (AWS) facilities used by Sprint in this area operate within a frequency range
of 2496 - 2690 MHz. Facilities typically consist of: 1) electronic transceivers (the radios or cabinets); and

2) antennas that send the wireless signals created by the transceivers to be received by individual
subscriber units. Transceivers are typically connected to antennas by coaxial cables.
Because of the short wavelength of PCS/AWS services, the antennas require line-of-site paths for good
propagation, and are typically installed above ground level. Antennas are constructed to concentrate
energy towards the horizon, with as little energy as possible scattered towards the ground or the sky.
This design, combined with the low power of PCS facilities, generally results in no possibility for
exposure to approach Maximum Permissible Exposure (MPE) levels, with the exception of areas directly
in front of the antennas.
FCC Compliance Requirement
A site is considered out of compliance with FCC regulations if there are areas that exceed the FCC
exposure limits arid there are no RF hazard mitigation measures in place. Any carrier which has an
installation that contributes more than 5% of the applicable MPE must participate in mitigating these RF
hazards.

AND MINOR COASTAL DEVELOPMENT PERMIT AMENDMENT
Notice is hereby given that a Review Permit Amendment (RP) and Coastal Development Permit
Amendment (CDP) have been applied for to allow modifications to an existing Sprint Wireless
Telecommunication Facility (WCF) that includes replacing six older and outdated Sprint antennas
with 9 newer and longer antennas, add 9 remote radio heads (RRH's), install one new equipment
cabinet and one Top Hat extension to an existing cabinet and increase the roof top screen
materials by two feet (from 42' to 44') to help hide the antennas. The project is located at 2333
State Street.
If you have any objections to the granting of this RP/CDP or wish to have an administrative hearing
to discuss the requested RP/CDP, please notify the Planning Division, 1635 Faraday Avenue,
Carlsbad, California 92008, in writing within 10 calendar days of the date of this notice. If you

CONDITIONS
Land Development Engineering has completed its review of the above referenced project for
application completeness and has determined that the application and plans submitted for this
project are complete and suitable for continued review. Engineering staff does not have any
comments to add to the project. Please add the following conditions to the approving
resolution/letter:
1. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution treatment practices or devices, erosion control to
prevent silt runoff during construction, general housekeeping practices, pollution
prevention and educational practices, maintenance procedures, and other management
practices or devices to prevent or reduce the discharge of pollutants to stormwater,
receiving water or stormwater conveyance system to the maximum extent practicable.
Developer shall notify prospective owners and tenants ofthe above requirements.

STATE - Request for approval of an Administrative Review Permit Amendment (RP 00-18(B))
and Minor Coastal Development Permit Amendment (CDP 00-57(B)) to allow the modification
of an existing wireless communication facility at 2333 State Street, in the Village Review (V-R)
Zone, Village Segment of the Certified Local Coastal Program and in Local Facilities
Management Zone 1.
Dear Mr. Vuong,
The City Planner has completed a review of your application for an Administrative Review Permit
Amendment and Minor Coastal Development Permit Amendment RP 00-18(B)/CDP 00-57(B) for the
modification of an existing wireless communication facility consisting of the removal of six obsolete
antennas and the installation of nine panel antennas, nine (6 new & 3 relocated) Remote Radio Heads
(RRH), and one microwave dish located partially behind existing rooftop parapet walls and mounted to
the building facade with associated equipment (Sprint Growth Cabinet) located within an existing
equipment room at 2333 State Street. A notice was sent to property owners within a 300' radius of the
subject property requesting comments regarding the above request. No comments were received within
the ten day notice period (ending on May 2, 2015). After careful consideration of the circumstances
surrounding this request, the City Planner has determined that the findings required for granting an
Administrative Review Permit Amendment and Minor Coastal Development Permit Amendment can be
made and therefore, APPROVES this request based on the following findings and conditions.
Findings:
Review Permit:
1. That the requested use is necessary or desirable for the development of the community, and is in
harmony with the various elements and objectives of the general plan, including, if applicable, the
certified local coastal program, specific plan or master plan in that (a) the use is necessary and
desirable for the development of the community because of the benefit and demand for digital
communications and data transmissions for businesses, individuals, public agencies and emergency
service systems in this part ofthe City; (b) the proposed use is consistent with the General Plan and
Village Segment ofthe Certified Local Coastal Program in that the Village (V) Land Use designation
does not preclude the provision of Wireless Communication Facility (WCF) uses. The WCF plan has
been found to be consistent with City Council Policy No. 64, Wireless Communication Facilities, in
that it is in a preferred non-residential location (commercial building) and has a stealth design as
discussed in finding number five below. The project's location and stealth design comply with
General Plan objectives that seek to maintain and enhance Carlsbad's appearance.

2. That the requested use is not detrimental to existing uses or to uses specifically permitted in the zone
in which the proposed use is to be located in that the proposed WCF is located within a preferred
non-residential location (commercial building) as listed in Location Guideline A.l.b. of City Council
Policy Statement No. 64, and all aspects ofthe WCF exhibit stealth design and are hidden by existing
improvements. The WCF use is not precluded by the project site's Village Review (V-R) zoning.
Furthermore, the placement of the antennas and associated WCF equipment will not result in any
additional building coverage, does not atter the %xisting site or building design, and does not
interfere with nor is it visible to other surrounding uses. The project has been conditioned to
maintain compliance with FCC RF Exposure Guidelines.
3. That the site for the proposed conditional use is adequate in size and shape to accommodate the
yards, setbacks, walls, fences, parking, loading facilities, buffer areas, landscaping and other
development features prescribed in this code and required by the City Planner in order to integrate
the use with other uses in the neighborhood in that the proposed antennas are partially located on
the rooftop of an existing commercial/office building behind parapet walls and mounted to the
building facade, and the equipment cabinet is located within an existing equipment room thereby
exhibiting stealth design techniques. When completed, the installation of the new antennas and
associated WCF equipment will not change the appearance ofthe three story office building as only
minor modifications will be necessary.
4. That the street system serving the proposed use is adequate to properly handle all traffic generated
by the proposed use in that the proposed unmanned WCF use would require, on average, only
monthly maintenance visits and occasional visits in response to operational problems.
5. That the proposed WCF is consistent with City Council Policy No. 64 in that it is located in a preferred
location ("commercial zone") as listed in Location Guideline A.l.b. of City Council Policy Statement
No. 64 and exhibits stealth design, as the new antennas are partially located behind existing rooftop
parapet walls which use RF transparent material painted and textured to match the existing
commercial building and partially facade mounted which are screened by existing architectural
elements. The proposed equipment cabinet is located within the commercial building thereby
exhibiting stealth design techniques.
6. The City Planner has determined that the project is consistent with Chapter 21.35 (Village Review
Zone) ofthe Carlsbad Municipal Code and all applicable development standards and land use policies
set forth within the Village Master Plan and Design Manual in that the WCF is located within an
existing three story commercial building containing office uses. The project consists of replacing
obsolete antennas with modern antennas on an existing WCF that will help better serve the existing
residential and business community and region as a whole, including emergency services.
Coastal Development Permit:
7. The proposal is in conformity with the public access and recreation policies of Chapter 3 ofthe Coastal
Act in that the project is located outside of the coastal shoreline development overlay zone.
Therefore, compliance with the pubtic access and recreation policies of Chapter 3 of the Coastal Act
is not required.
8. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter
21.203 ofthe Zoning Ordinance) in that project which consists of updating an existing WCF with new
antennas and associated equipment will adhere to the City's Master Drainage Plan, Chapter 15.16 -

Grading and Erosion Control, Chapter 15.12 - Storm Water Management and Discharge Control,
Standard Urban Storm Water Mitigation Plan (SUSMP), and Jurisdictional Urban Runoff
Management Program (JURMP) to avoid increased urban runoff, pollutants, and soil erosion.
Furthermore, no evidence of landslide or slope instability is identified on the site, nor is it located
in an area susceptible to accelerated erosion, floods, or liquefaction, the site is void of steep slopes
and no native vegetation is located on the subject property.
9. That the proposed development is in conformance with the Certified Local Coastal Program and all
applicable policies in that the site is designated for commercial uses and is already disturbed and
developed with a three story office building. The project consists of updating an existing WCF with
new antennas and will not obstruct views of the coastline as seen from public lands or the public
right-of-way, nor otherwise damage the visual beauty ofthe coastal zone. No agricultural activities,
sensitive resources, geological instability, flood hazard or vertical coastal access opportunities exist
onsite. Furthermore, the WCF facility is not in an area of known geologic instability or flood hazards.
10. That the City Planner has determined that the project belongs to a class of projects that the State
Secretary for Resources has found do not have a significant impact on the environment, and it is
therefore categorically exempt from the requirement for the preparation of environmental
documents pursuant to Section 15301(k) (Existing Facilities) ofthe state CEQA Guidelines. In making
this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the
state CEQA Guidelines do not apply to this project.
11. The City Planner has reviewed each of the exactions imposed on the Developer contained in this
resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused
by or reasonably related to the project, and the extent and the degree of the exaction is in rough
proportionality to the impact caused by the project.
Conditions:
1. Approval is granted for RP 00-18(B)/CDP 00-57(B) - SPRINT SD36XC284 - STATE as shown on Exhibits
"A - J" dated July 15, 2015 on file in the Planning Division and incorporated herein by reference.
Development shall occur substantially as shown unless otherwise noted in these conditions.
2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and
maintained over time, if any of such conditions fail to be so implemented and maintained according
to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or
further condition issuance of all future building permits; deny, revoke, or further condition all
certificates of occupancy issued under the authority of approvals herein granted; record a notice of
violation on the property title; institute and prosecute litigation to compel their compliance with said
conditions or seek damages for their violation. No vested rights are gained by Developer or a
successor in interest by the City's approval of this Administrative Review Permit Amendment and
Minor Coastal Development Permit Amendment.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the RP 00-18(B)/CDP 00-57(B) documents, as necessary to make them internally
consistent and in conformity with the final action on the project. Development shall occur
substantially as shown on the approved Exhibits. Any proposed development different from this
approval shall require an amendment to this approval.

4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless
the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and
against any and all liabilities, losses, damages, demands, claims and costs, including court costs and
attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and issuance
of this Administrative Review Permit Amendment and Minor Coastal Development Permit
Amendment, (b) City's approval or issuance of any permit or action, whether discretionary or non-
discretionary, in Connection with the use contemplated herein, and (c) Developer/Operator's
installation and operation of the facility permitted hereby, including without limitation, any and all
liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or
emissions.
5. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in
effect at the time of building permit issuance.
6. This project shall comply with all conditions and mitigation measures, which are required as part of
the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the
issuance of building permits.
7. RP 00-18(B)/CDP 00-57(B) shall be reviewed by the City Planner on a yearly basis to determine if all
conditions of this permit have been met and that the use does not have a substantial negative effect
on surrounding properties or the public health, safety and general welfare. If the City Planner
determines that: 1) the minor conditional use permit was obtained by fraud or misrepresentation; or
2) the use for which such approval is granted is not being exercised; or 3) the conditions of approval
have not been met; or 4) the minor conditional use permit is being or recently has been exercised
contrary to any of the terms or conditions of approval; or 5) the use for which such approval was
granted has ceased to exist or has been suspended for one year or more; or 6) the use is in violation
of any statute, ordinance, law or regulation; or 7) the use permitted by the minor conditional use
permit is being or has been so exercised as to be detrimental to the public health, safety or welfare
or so as to constitute a nuisance, the City Planner shall hold an informal public hearing and after
providing the permittee the opportunity to be heard, the City Planner may revoke and terminate the
minor conditional use permit in whole or in part, reaffirm the minor conditional use permit, modify
the conditions or impose new conditions.
8. This Minor Conditional Use Permit Amendment is granted for a period of 10 years from July 15, 2015
through July 14, 2025. This permit may be revoked at any time after a public hearing, if it is found
that the use has a substantial detrimental effect on surrounding land uses and the public's health and
welfare, or the conditions imposed herein have not been met. This permit may be extended for a
reasonable period of time not to exceed ten (10) years upon written application of the permittee
made no less than 90 days prior to the expiration date. The Planning Commission may not grant such
extension, unless it finds that there are no substantial negative effects on surrounding land uses or
the public's health and welfare. If a substantial negative effect on surrounding land uses or the
public's health and welfare is found, the extension shall be denied or granted with conditions which
will eliminate or substantially reduce such effects. There is no limit to the number of extensions the
Planning Commission may grant.
9. This approval shall become null and void if building permits are not issued for this project within 24
months from the date of project approval.

10. Developer shall report, in writing, to the City Planner within 30 days, any address change from that
which is shown on the permit application.
11. Prior to the issuance ofthe building permit. Developer shall submit to the City a Notice of Restriction
executed by the owner of the real property to be developed. Said notice is to be filed in the office of
the County Recorder, subject to the satisfaction of the City Planner, notifying all interested parties
and successors in interest that the City of Carlsbad has issued an'Administrative Review Permit
Amendment and Minor Coastal Development Permit Amendment on the property. Said Notice of
Restriction shall note the property description, location ofthe file containing complete project details
and all conditions of approval as well as any conditions or restrictions specified for inclusion in the
Notice of Restriction. The City Planner has the authority to execute and record an amendment to the
notice which modifies or terminates said notice upon a showing of good cause by the Developer or
successor in interest.
12. Developer/Operator shall comply with the Federal Communication Commission's guidelines on limits
for human exposure to radio frequency (RF) electromagnetic fields. Within six (6) months after the
issuance of occupancy, and with anytime extension or amendment request, the Developer/Operator
shall submit to the City Planner either (1) verification that the project is categorically excluded from
having to determine compliance with the RF exposure guidelines per 47 CFR 51.1307(b)(1); or (2) a
project implementation report which provides cumulative field measurements of RF emissions of all
antennas installed at the subject site. The report shall quantify the RF emissions and compare the
results with the exposure limits established by the FCC guidelines. Said report shall be subject to
review and approval by the City Planner for consistency with the Project's preliminary report on RF
exposure submitted with the initial project application and for consistency with the FCC guidelines.
If, on review, the City finds that the Project does not meet the FCC guidelines, the City may revoke or
modify this minor conditional use permit amendment and minor coastal development permit
amendment.
Engineering:
13. Developer shall comply with the City's Stormwater Regulations, latest version, and shall implement
best management practices at all times. Best management practices include but are not limited to
pollution treatment practices or devices, erosion control to prevent silt runoff during construction,
general housekeeping practices, pollution prevention and educational practices, maintenance
procedures, and other management practices or devices to prevent or reduce the discharge of
pollutants to stormwater, receiving water or stormwater conveyance system to the maximum extent
practicable. Developer shall notify prospective owners and tenants ofthe above requirements.
Code Reminders:
14. Approval of this request shall not excuse compliance with all applicable sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit issuance, except
as otherwise specifically provided herein.
15. Premise identification (addresses) shall be provided consistent with Carlsbad Municipal Code Section
18.04.320.

Please take NOTICE that approval of your project includes the "imposition" of fees, dedications,
reservations, or other exactions hereafter collectively referred to for convenience as "fees/exactions."
You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you
protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and
file the protest and any other required information with the City Manager for processing in accordance
with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any
subsequent legal action to attack, review, set aside, void, or annul their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT
APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading or other

of limitations has previously otherwise expired.
This decision may be appealed by you or any other member of the public to the Planning Commission
within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division
at 1635 Faraday Avenue in Carlsbad, along with a payment of $661.00 plus notice fees. The filing of such
appeal within such time limit shall stay the effective date of the order of the City Planner until such time
