FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2 The following findings have been made in order to approve the Administrative Redevelopment Permit and Coastal Development Permit for the addition of outdoor tables and chairs within a fenced in patio area on the north and east sides of Knock Out Pizzeria Restaurant: 1. The Housing and Redevelopment Director has determined that the project is consistent with all applicable development standards and land use policies set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan. 2. The Housing and Redevelopment Director has determmed that the project is consistent with the certified local coastal program and the goals and objectives of the Coastal Commission for the portion of the Village Redevelopment Area which lies within the Coastal Zone Boundaries. 3. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. 4. The Housing & Redevelopment Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301 (e), of the State CEQA Guidelines and will not have an adverse significant Impact on the environment. Page 2 of 2 w The following conditions have been approved for the subject project: 1. This approved permit serves as the required redevelopment permit and coastal development permit for the subject project (outdoor dining). 2. The project shall be completed according to, and be consistent with, the plans approved by the Housing and Redevelopment Director on the date noted above. The approved plans have been stamped by the Housing and Redevelopment Director and indicate the approval date of 2J\H|PI 3. The project must comply with the latest State Disabled access regulations for existing buildings. 4. This permit allows the applicant to provide a total of 2 tables and 4 chairs inside the subject restaurant and a maximum of 8 tables and 24 chairs outside the restaurant, within the identified patio area. 5. A clear area of at least five feet In width must be maintained to the building entries at all times. 6. Prior to the Issuance of the permit, the applicant shall be required to pay Traffic Impact Fees based on the current fee schedule set forth by the resolution of the City of Carlsbad. 7. This permit shall be subject to revocation by the Housing and Redevelopment Director if the applicant fails to conform to any of the above conditions of approval.
