FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Pagel of2 The following findings have been made in order to approve the Administrative Redevelopment Permit for the expansion of an existing outdoor dining area within a fenced in patio on the east side of Polios Maria Restaurant located at 3055 Harding Street in Land Use District 2 of the Village Redevelopment Area: 1. The Housing and Redevelopment Director has determined that the project is consistent with all applicable development standards and land use policies set forth within the Village Master Plan and Design Manual and Viiiage Redevelopment Plan. 2. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. 3. The Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15332, of the State CEQA Guidelines and will not have an adverse significant impact on the environment. Page 2 of 2 The following conditions have been approved for the subject project: 1. This approved permit serves as the required redevelopment permit for the subject project (outdoor dining). 2. The project shall be completed according to, and be consistent with, the plans approved by the Housing and Redevelopment Director on the date noted above. The approved plans have been stamped by the Housing and Redevelopment Director and indicate the approval date of 8/30/02. 3. The project must comply with the latest State Disabled access regulations for existing buildings. 4. This permit allows the applicant to provide a total of 20 seats inside the subject restaurant and a maximum of 20 seats outside the restaurant, within the identified patio area. 5. A clear area of at least five feet in width must be maintained to the building entries at all times. 6. The applicant shall acquire a right-of-way permit from the Carlsbad Engineering Department prior to the commencement of work within the public right-of-way for the replacement of the existing driveway apron with curb, gutter and sidewalk improvements. 7. Developer shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. Developer shall provide improvements constructed pursuant to best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be submitted to and subject to the approval of the City Engineer. Said plans shall include but not be limited to notifying prospective owners and tenants of the following: A. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fiuids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. 8. The "10 ft. X18 ft. back-up space" located south of the building shall be designated as such by the use of pavement graphics and/or signs. 9. This permit shall be subject to revocation by the Housing and Redevelopment Director if the applicant fails to conform to any of the above conditions of approval.
