The subject property is located at 3150 Ocean Street in the City of Carisbad, California. Originally, the site was approved for deveiopment of an 8-unit apartment project. Following construction, the 8-unit apartment building was illegally converted to 12 units under a prior owner. Last year the City's Code Enforcement staff was made aware of the violation and the current owner, Don Forester, was required to convert the 12 residential units back to the 8 residential units previously approved. Mr. Forester complied with the requirements of the Code Enforcement Department and then processed a land use permit to convert the 8-unit apartment building to a 12-unit hotel. While Mr. Forester has received approval for the land use conversion the actual conversion to a hotel use is not complete until he completes the building permit process to physically comply with building code requirements for a hotel use. To date, this has not been compieted and the property continues to operate as an 8-unit apartment project. It is important to note that at the time the 8-unit apartment project originally received land use approval for a multi-family residential use the zoning permitted said use. As a result, there are several existing multi-family residential uses in the immediate vicinity. Following the adoption of the Village Redevelopment Master Plan, the land use designation for this area was changed to Tourism Support with all permitted uses being visitor serving commercial uses. All existing residential uses then became legally existing nonconforming uses, which are permitted to remain indefinitely, but may not expand or intensify. Therefore, in order for Mr. Forester to convert the 8 units to 12 units he was required to convert the use to a conforming use, which in this case was a hotel. For all intents and purposes the project will not operate any differently than is has historically. I have enclosed said notice which must be signed and notarized according to the directions contained on the signature page. The decision of the Housing and Redevelopment Director is subject to a ten (10) day appeal period. The appeal period has elapsed and no appeals were filed. Attached is a copy of the approved permit authorizing the change in use from multi- family residential to hotel/motel. Please review all conditions carefully. Violation of the conditions could result in revocation of this permit. Having completed the land use review process, the building permit for the above referenced project may now be issued. Please check with the Building Department to make sure there are no other outstanding issues associated with the issuance of the building permit. The project appears to comply with City engineering standards and all issues have been addressed. Please add the following conditions of approval to the approving resoiution or letter: Genera/ 1. Prior to issuance of any building permit, Developer shall comply with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. 2. The Average Daily Trips (ADT) and fioor area contained in the staff report and shown on the site plan are for planning purposes only. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and Section 13.10 of the City of Carlsbad Municipal Code, respectively. 3. The property owner and/or developer shall comply with the "Storm Water Management Plan for Sea Breeze Vacation Rentals" on file with the City. Prior to the issuance of building permits, the developer shall install a filter within the existing storm drain inlet located at the west end of the driveway in accordance with said plan. 4. The applicant shall show the location of any proposed water lines and detector check valves for the fire sprinkler system on the building plans.
