While the Carisbad Village Redevelopment Master Plan & Design Manual does not presently address this issue for private property, the Housing & Redevelopment Director agreed to allow outdoor displays on private property on an interim basis, until such time as the Housing & Redevelopment Commission adopts permanent regulations. This letter will serve as temporary approval for your outdoor display on private property until such time as permanent regulations are adopted. Please note, this approval allows an outdoor display as described and depicted on the corresponding site plan that is attached. Upon the adoption of permanent regulations for outdoor displays on private property you may be required to modify your outdoor display to be consistent with the new standards. A Certificate of Insurance is not required as long as the outdoor display remains on private property. Most importantly, to retain vour temporary approval your outcioor display must be placed within the area as shown on the attached site plan. Each individual business that has private property located between the front of their building and the public right-of-way (sidewalk) shall be allowed an outdoor business display on the private property outside the walls of the subject business. The display may include, but is not limited to: • Various business-related items sold within the building; • A rack of various items; • A rack of clothing or accessory items; or • A flower or craft display cart. These business displays shall iiot contain any information which would routinely be placed on a business sign located on the building such as the name or type of business, hours of operation, business logo, brand name information, etc. The business display may include a sign that indicates the price of the display item(s) or simply indicates a "sale" on the item(s). 2. The outdoor business display shall be placed adjacent to and parallel to the subject business building on private property. These displays shall not be placed on public property. 3. The outdoor display area shall not exceed 10% of the gross floor area of the business inside the building. 4. The outdoor business display may consist of several individual business items, without a rack, cart, table or shelf of some type. However, the various display items must be placed in front of and adjacent to the subject business building. The display items shall be displayed in a manner to fit within an area that does not exceed 10% of the interior floor area of the business, as noted on a site plan. 5. If a business has outdoor tables and chairs located within the public right-of-way, no additional business display shall be permitted. 6. All outdoor business displays shall be located in a manner that does not cause an obstruction for pedestrians and/or site distance problems for vehicles. 7. No outdoor business display shall obscure or interfere with any official notice or public safety sign or device. 8. All outdoor business displays shall be placed outside during business hours only. No permanent outdoor business displays shall be permitted. 9. All outdoor business displays shall be continuously maintained in a state of order, security, safety and repair. The display surface shall be kept clean, neatly painted, and free of rust, corrosion, protruding tacks, nails and/or wires. Any cracked, broken surfaces, or other un-maintained or damaged portion of a display shall be repaired or replaced or removed within thirty (30) days. 10. All outdoor business displays shall be tasteful and assist in creating a top-quality shopping environment. No display shall contain obscene, indecent or immoral matter. 11. The outdoor business display must be self-supporting, stable and weighted or constructed to withstand overtuming by wind or contact.
