Dear Ms. Cabo:
As you requested, please find enclosed information regarding the Parking In-lieu Fee
Program for the Carisbad Village Area. As the information indicates, your property at
2568 State Street is located within Zone 2 of the Program Area. Properties within Zone 2
may be permitted to make an In-lieu Fee payment for up to fifty percent of their on-site
requirement. The current fee for the Program is $11,240 per parking space.
Also as we discussed, the above referenced application for a change in use has been
incomplete for over eighteen (18) months. A decision will be needed within the next
thirty (30) days to determine if you wish to proceed with the processing of the
application. If you wish to proceed, please provide the information requested in the
attached letter that was previously sent to you on January 6, 2003. Failure to resubmit
the materials necessary to determine your application complete by August 12, 2004,
shall be deemed to constitute withdrawal of the application. If an application is
withdrawn or deemed withdrawn, a new application must be submitted.

SUBJECT: ANA CABO STUDIO (RP 02-50)
Thank you for applying for a Land Use Permit in the City of Carisbad. The Housing and
Redevelopment Department has reviewed your Administrative Redevelopment Permit,
application no. RP 02-50, as to its completeness for processing. Before the application is
routed to other City Departments the parking needs to be resolved.
The last known use to occupy the site was a contractor's office (1,353 square feet) with on-site
storage of materials and supplies within the existing warehouse space (1,772 square feet). The
office use was considered a conforming use in Land Use District 4, because it is listed as a
provisional use in Village Master Plan. However, the warehouse space is considered a light
industrial use and was classified as a nonconforming use in District 4. The Village Master Plan
and Design Manual prohibits the conversion from one nonconforming use to another
nonconforming use. Therefore, in order to approve your use we must find that it is a permitted
use under the Village Master Plan.
It is our understanding that you intend to use the front portion of the building as an office/retail
use for your art gallery and the back portion as workshop space. An art gallery is a permitted
use in District 4 and while the Village Master Plan is silent on the use of workshop space, this
use has been permitted in conjunction with adjacent retail uses. In order to approve the
proposed use change, the new use would be classified as an art gallery and associated
workshop space. Under this use classification the parking requirement is one parking space for
every 300 square feet of gross floor area for the office/retail space and one parking space for
every 650 square feet of gross floor area for the workshop space. Based on these parking
ratios, 8 parking spaces are required for the proposed use. Please modify the site plan to show
the 8 required parking spaces. The dimensions of all parking spaces and drive aisles should be
clearly delineated on the site plan.
