10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 3
The following findings have been made in order to approve the Administrative Redevelopment Permit
for property located at 2589 State Street:
1. The Housing and Redevelopment Director has determined that the project is consistent with the
policies, goals and action programs set forth within the Carlsbad General Plan.
2. The Housing and Redevelopment Director has determined that the project is consistent with all
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan.
3. The Housing and Redevelopment Director has determined that the project is exempt from the
requirements of the California Environmental Ouaiity Act (CEQA) per Section 15303 of the State
CEQA Guidelines and will not have an adverse significant impact on the environment

1. This approved permit serves as the required redevelopment permit for the subject projecL The
applicant has received approval for the conversion of the building to a retail use with an outdoor
display area and associated parking lot improvements as described in the permit.
2. The project shall be completed according to, and consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of 5 Illicit.
3. The property may be used for retail purposes only.
4. No outdoor storage of equipment or supplies is permitted. All business must be conducted
within the enclosed building or the outdoor display area as shown on the approved site plan.
5. All accessory buildings currently existing on-site and not shown on the approved site plan shall
be removed in their entirety.
6. The applicant shall obtain appropriate building permits for the demolition of all accessory
structures, including the accessory building along the rear property line and the two sheds in
back of the main building along the side property line. The applicant shall also obtain required
building permits for all tenant improvements to the main building.
7. All parking shall be completed according to the approved plans and installed prior to final
inspection of the tenant improvements. Parking spaces are for retail customers and employees
of the retail operation only.
8. The applicant shall acquire a sign permit prior to installation of any signage on the subject
property. All signage shall be consistent with the sign regulations set forth in the Village
Redevelopment Master Plan and Design Manual.
9. Prior to the issuance of the business license and operation of this use as set forth in this
approved redevelopment permit, the existing 5-foot high chain link fence proposed to remain
along the front of the property facing State Street shall be removed in its entirety. If the applicant
chooses, a decorative wrought iron fence may be installed along the front of the property
between the north property line and the building. The fence must be designed in such a way as
to allow access to the parking lot during all hours of operation.
10. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project. Developer shall apply for and obtain approval from, the City Engineer for the
proposed haul route.
11. Prior to issuance of any building permit. Developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formally established
by the City.
12. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permiL Developer shall provide improvements constructed
pursuant to best management practices as referenced in the "California Storm Water Best
Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be submitted to and subject to
the approval of the City Engineer. Said plans shall include but not be limited to notifying
prospective owners and tenants of the following:

A. All owners and tenants shall coordinate efforts to establish or work with established
disposal programs to remove and properly dispose of toxic and hazardous waste
products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze,
solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be
discharged into any street, public or private, or into storm drain or storm water
conveyance systems. Use and disposal of pesticides, fungicides, herbicides,
insecticides, fertilizers and other such chemical treatments shall meet Federal, State,
County and City requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface pollutants when
planning any changes to the landscaping and surface improvements.
10. The Average Daily Trips (ADT) and floor area contained in the permit and shown on the site plan
are for planning purposes only. Developer shall pay traffic impact and sewer Impact fees based
on Section 18.42 and Section 13.10 of the City of Carlsbad Municipal Code, respectively.
11. This permit shall be subject to revocation if the applicant fails to conform to any of the above
conditions of approval.
