The decision of the Housing and Redevelopment Director is subject to a ten (10) day appeal period. The appeal period has elapsed and no appeals were filed. Attached is a copy of the approved permit authorizing the change in land use to convert the previously existing laundromat to a retail use for the sale of pond related products and to provide a fenced in outdoor display area with in-ground ponds for the display of fish. Please review all conditions carefully. Violation of the conditions could result in revocation of this permit. Having completed the land use review process, you may now proceed with acquiring the necessary building permit for the tenant improvements. Please check with the Building Department on the process for acquiring the building permit. The Housing and Redevelopment Department, together with other appropriate City departments, has reviewed your Major Redevelopment Permit, application no. RP 03-01, as to its completeness for processing. The application is incomplete, as submitted. The attached list includes information that must be submitted to complete your application. This list of items must be submitted directly to the Housing & Redevelopment Office. All list items must be submitted simultaneously and a copy of this list must be included with your submittal. No processing of your application can occur until the application is determined to be complete. When ali required materials are submitted to the Redevelopment Office, the City has an additional thirty (30) days to make a determination of completeness. If the application is determined to be complete, processing for a decision on the application will be initiated. In addition, please note that you have six months from the date the application was initially filed, February 14, 2003, to either resubmit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed to constitute withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new application must be submitted. B • Carlsbad, CA 92008-2389 • (760) 434-2810/2811 • FAX (760) 720-2037 @ UST OF ITEMS NEEDED TO COMPLETE THE APPUCATION No. RP 03-01 Housing & Redevelopment: Submit five (5) sets of revised plans to the Housing & Redevelopment Department with the following added Information: 1. Please provide a site plan "to scale" with the following additional information: a. Scale of site plan. b. Dimensions of outdoor display area. c. Removal of the 4-foot high chain link fence on the front of the property. d. Height and materials of existing and/or proposed fencing on the sides and rear of the property. e. Width of existing driveway on State Street. f. Material of proposed 3-foot high fence around pond area. Will the pond area be fenced along the front and rear of the property? If so, please indicate location on site plan. g. Will vehicular ingress and egress to the alley be maintained? If so, please indicate on the site plan. Housing and Redevelopment staff strongly encourages access to the alley be retained. h. Based on 2,688 square feet of retail space and 800 square feet of outdoor display area, a total of 12 parking spaces are required. Since the fully enclosed 4-car garage is not accessible for customer parking, the four parking spaces will not be counted towards satisfying the on-site parking requirement. Also, if the "garage" remains fully enclosed it will constitute additional storage area and increase the on-site parking requirement by two additional spaces. i. Is a shade structure proposed for over the koi ponds? If so, please indicate location, materials, and height. j. Please indicate all proposed landscaping. 2. Provide a building elevation indicating proposed fagade improvements to the building. Please note that once the application is found complete you must provide a complete public notification package. In order to expedite this application you may submit the notification package with your revised plans. The public notification package shall include a radius map, a type written list of the names and addresses of all property owners within a 300' radius of the subject property; and two sets of mailing labels with names and addresses of all property owners within a 300' radius of the subject property. The property owner list shall include the San Diego County Assessor's parcel number from the latest assessment rolls. Except for single-family residences, the apartment or suite number must be included on the address mailing labels for property owners within a 300-foot radius of the subject property; the parcel number should not be typed on the address labels. The radius map must be provided with a scale not less than 1"=200' showing each lot within 300 feet of the exterior boundaries of the subject property. Engineering: Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1. Are the eight parking spaces proposed or existing? Please indicate and number each one. 2. Indicate the distance between the garage and the last parking stall. 3. Show property boundaries and provide a plan to scale. 4. Indicate the width of the driveway approach. 5. What is the square footage of blacktop proposed? Building: The Building Department has the following comments which must be addressed on the revised plans: 1. Proposed restroom must be accessible to the disabled. 2. One parking space must be van accessible (disabled) with an 8 foot loading zone adjacent to it. 3. There must be a designated path of travel from the accessible parking stall to the main entrance of the building, which meets disable access requirements. CITY OF CARLSBAD ENGINEERING DEPARTMENT LAND USE REVIEW April 22, 2003 TO: Lori Rosenstein - Housing and Redevelopment FROM: David Rick - Engineering Development Services COMPLETENESS REVIEW PROJECT ID: RP 03-01 POND SOURCE The Engineering Department has completed its review of the above referenced project. Engineering staff does not have any comments to add to the project. Please add the following conditions of approval to the approving resolution: ENGINEERING CONDITIONS General 1. Prior to hauling dirt or construction materials to or from any proposed construction site within this project. Developer shall apply for and obtain approval from, the City Engineer for the proposed haul route. 2. Prior to issuance of any building permit. Developer shall comply with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. 3. The existing 5 foot chain link fence proposed to remain in the front yard facing State Street shall either (1) be reduced to 30 inches in height, (2) be relocated 15 feet back from the face of curb or (3) removed entirely. DedicationsAmprovemGnts 4. Developer shall comply with the City's requirements of the National Pollutant Discharge Elimination System (NPDES) permit. Developer shall provide improvements constructed pursuant to best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be submitted to and subject to the approval of the City Engineer. Said plans shall include but not be limited to notifying prospective owners and tenants of the following: A. All owners and tenants shall coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, H:\LIBRARY\ENG\WPDATA\MISC\COMPREV antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shall meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shall be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. 5. The average Daily Trips (ADT) and floor area contained in the staff report and shown on the site plan are for planning purposes only. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and Section 13.10 of the City of Carisbad Municipal Code, respectively.
