FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 3 The following findings have been made in order to approve the Administrative Redevelopment Permit for property located at 2615 State Street: 1. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. 2. The Housing and Redevelopment Director has determined that the project is consistent with all applicable deveiopment standards and land use policies set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan. 3. The Housing and Redevelopment Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines and will not have an adverse significant impact on the environment. Page 2 of 3 The foilowing conditions have b^^ approved for the subject project: 1. This approved permit serves as the required redevelopment permit for the subject project. The applicant has received approval to convert the buiiding from automotive repair to retail tire sales and associated auto service. 2. The project shall be completed according to, and consistent with, the plans approved by the Housing and Redevelopment Director on the date noted above. The approved plans have been stamped by the Housing and Redevelopment Director and indicate the approval date of l/zlO'h. 3. The property may be used for retail purposes only. 4. No outdoor storage of equipment or supplies is permitted. All business must be conducted within the enclosed building area as shown on the approved site plan. 5. Ail accessory structures not shown on the approved site plan shall be removed in their entirety. 6. The appiicant shall obtain required building permits for all tenant improvements to the buiiding. 7. All parking shali be completed according to the approved plans and installed prior to final inspection of the tenant improvements. Parking spaces are for retail customers and employees of the retail operation only. 8. The applicant shall acquire a sign permit prior to installation of any signage on the subject property. All signage shall be consistent with the sign regulations set forth in the Village Redevelopment Master Plan and Design Manual. All awnings shall be of a fabric material, no vinyl awnings will be permitted. Awnings may not be backlit or internally illuminated. As part of the sign permit approval the existing pole sign shail be removed. 9. If the approved A-frame sign is placed within the pubiic right-of-way, a Certificate of Insurance in the amount of $1 million, naming the City of Carisbad and the Carlsbad Redevelopment Agency as additional insured, shall be submitted to the Housing and Redevelopment Department. A clear area of five feet (5') in width must be maintained for pedestrian use over the entire length of the sidewalk in front of the business. 10. Prior to the issuance of the business license and operation of this use as set forth in this approved redevelopment permit, the existing chain link fence along the front of the property facing State Street shall be removed in its entirety and all existing barbed wire shail be removed from the remaining chain link fences. If the applicant chooses, a decorative wrought iron fence may be installed along the front of the property. The fence must be designed in such a way as to allow access to the parking lot during all hours of operation. 11. Fire Department Condition: The storage of rubber tires shali not exceed 72 inches in height anywhere they are stored. The area in which tires may be stored is unlimited. 12. Prior to hauling dirt or construction materials to or from any proposed construction site within this project. Developer shall apply for and obtain approvai from, the City Engineer for the proposed haul route. 13. Prior to issuance of any buiiding permit. Developer shall compiy with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. Page 3 of 3 |l4. Prior to approvai of any grading or buiiding permits for this project. Developer shali cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 and/or to the formation or annexation into an additional Street Lighting and Landscaping District. Said written consent shall be on a form provided by the City Engineer. |l5. No grading for private improvements shali occur outside the limits of this approval uniess Developer obtains, records and submits a recorded copy to the City Engineer a grading or slope easement or agreement from the owners of the affected properties. If Developer is unable to obtain the grading or slope easement, or agreement, no grading permit will be issued. In that case Developer must either apply for and obtain an amendment of this approvai or modify the plans so grading will not occur outside the project and apply for and obtain a finding of substantial conformance from both the City Engineer and Pianning Director. {l6. Developer shall comply with the City's requirements of the Nationai Pollutant Discharge Elimination System (NPDES) permit, latest version. Developer shall provide improvements constructed pursuant to best management practices as referenced in the "California Storm Water Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas or City right-of-way. Pians for such improvements shail be submitted to and subject to the approval of the City Engineer. Said plans shail inciude but not be limited to notifying prospective owners and tenants of the following: A. Aii owners and tenants shail coordinate efforts to establish or work with established disposal programs to remove and properly dispose of toxic and hazardous waste products. B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze, solvents, paints, paint thinners, wood preservatives, and other such fiuids shali not be discharged into any street, public or private, or into storm drain or storm water conveyance systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers and other such chemical treatments shaii meet Federal, State, County and City requirements as prescribed in their respective containers. C. Best Management Practices shali be used to eliminate or reduce surface pollutants when planning any changes to the landscaping and surface improvements. |l2. V\^ithin 12 months after the approval of this application, Developer shall install all treatment control Best Management Practices (BMP's) as outlined in the "Storm Water Manangement Plan (SWMP)" for Big O" Tires, dated June 12, 2003 to ensure storm water is treated in accordance with State regulations and the City of Carlsbad Standard Urban Stormwater Management Plan. 13. The project is subject to all applicable provisions of local ordinances, including but not limited to the following: Developer shall exercise speciai care during the construction phase of this project to prevent offsite siltation. Planting and erosion controi shail be provided in accordance with Carlsbad Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction of the City Engineer. 14. This permit shail be subject to revocation if the appiicant fails to conform to any of the above conditions of approval.
