Date of Notice: January 20, 2004 NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Director of the City of Carlsbad has made a final decision to APPROVE an Administrative Redevelopment Permit (RP03-18) to provide clarification to the original land use permit for the property. The permit clarifies that retail and/or office uses are permitted on the ground floor of the existing building. This permit does not change any existing structures or uses on the property; it merely provides clarification to the original land use permit and is in keeping with the historical uses on the property. The property is located on the south side of Carlsbad Village Drive between Roosevelt and State Street. The assessor parcel number is 203-297-01. The proposed project is located within the Coastal Zone, but is not within the "appealable" area of the Coastal Zone. The proposed project includes a change in use from "retail" to "retail and/or office". In Land Use District 1, retail is a permitted use and office is classified as a provisional use under the Carlsbad Village Redevelopment Master Plan; therefore, an administrative redevelopment permit is required to include office as a permitted ground floor use. The intent of the land use standards for this district is to reinforce the pedestrian shopping environment, encourage mutually supportive uses, and provide a major activity focus for Carlsbad Village and the City as a whole. Staff supports the issuance of the redevelopment permit for the following reasons: the combination of retail and office on the ground floor is not likely to negatively impact existing or planned retail continuity in the area; the property has adequate parking available on-site to accommodate the proposed mixture of uses, and the combination of uses provide goods and services for residents and visitors alike. If you wish to appeal the decision of the Housing and Redevelopment Director on this matter to the Design Review Board, you must file a written appeal with the Housing and Redevelopment Department within ten (10) calendar days of the date of this decision/notice. The written appeal must be submitted no later than 5:00pm on January 30, 2004. Appeal forms are available at the Housing and Redevelopment Department located at 2965 Roosevelt Street, Suite B.
