In a letter to you, dated September 8, 2004, Administrative Redevelopment Permit (RP 04-05)
was determined complete for further processing by the City of Carlsbad.
The purpose of this letter is to follow-up on remaining issues of concern raised by various
departments following a detailed review of the revised project plans. A list of remaining issues
is attached for your review. These issues must be addressed prior to staff making a formal
recommendation on the project.

ISSUES OF CONCERN
RP 04-05
Staff has completed a review of the subject project for issues of concern. The following items
need to be resolved or adequately addressed prior to staff making a final determination on the
proposed project: (Please note, the issues are listed under the department which identified
them as an area of concern.)
Housing & Redevelopment:
1. Please indicate how the trash bin area is to be screened from the alley public right-of-way.
Identify the height of the trash bin area and whether or not the trash bin will include doors for
screening purposes. An elevation may be helpful to demonstrate the height and visual
appearance.
2. Please identify the height of the decorative wall next to parking space number five (#5).
3. Public Notification Package The public notification package shall include the following
information:
a. A typewritten list of the names and addresses of all property owners within a 300'
radius of subject property (including the applicant and/or owner). The list shall
include the San Diego County Assessor's parcel number from the latest
assessment rolls.
b. 300' Radius Map: A map to scale not less than 1" = 200' showing each lot within
300' of the exterior boundaries of the subject property. Each of these lots shall
be consecutively numbered and correspond with the property owners list.
c. Two (2) separate sets of mailing labels of the property owners within a 300'
radius of the subject property. The list must be typed in all CAPITAL LETTERS,
left justified, void of punctuation. For any address other than single-family
residence, an apartment, suite or building number must be included on a
separate line. DO NOT include it in the street address line. DO NOT TYPE
ASSESSOR'S PARCEL NUMBER ON LABELS. DO NOT provide addressed
envelopes - PROVIDE LABELS ONLY.

General

and pavement marking shall be installed to delineate One Way Traffic as approved by
the City Engineer. The contractor or developer shall submit a revised construction,

The Engineering Department has completed its review of the above referenced project for
previously determined issues. Please add the following conditions of approval to the approving
resolution or letter:
ENGINEERING CONDITIONS
NOTE: Unless specifically stated in the condition, all of the following conditions, upon the approval of this
proposed site development plan, must be met prior to approval of a grading or building permit, whichever
occurs first.
1. Prior to hauling dirt or construction materials to or from any proposed construction site within this
project, Developer shall apply for and obtain approval from, the City Engineer for the proposed
haul route.
2. The parking plan as submitted is specifically approved for 9 spaces. Additional signage
and pavement marking shall be installed to delineate One Way Traffic as approved by the
City Engineer. The contractor or developer shall submit a revised construction, paving or
parking plan to delineate the approved design.

43. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer shall
submit for City approval a "Storm Water Management Plan (SWMP)." The SWMP shall
demonstrate compliance with the City of Carlsbad Standard Urban Stormwater Mitigation Plan
(SUSMP), Order 2001-01 issued by the San Diego Region of the California Regional Water
Quality Control Board and City of Carlsbad Municipal Code. The SWMP shall address measures
to avoid contact or filter said pollutants from storm water, to the maximum extent practicable, for
the post-construction stage of the project. At a minimum, the SWMP shall:
a. identify existing and post-development on-site pollutants-of-concern;
b. identify the hydrologic unit this project contributes to and impaired water bodies that could be
impacted by this project;
c. recommend source controls and treatment controls that will be implemented with this project
to avoid contact or filter said pollutants from storm water to the maximum extent practicable
before discharging to City right-of-way;
d. establish specific procedures for handling spills and routine clean up. Special considerations
and effort shall be applied to (RESIDENT/EMPLOYEE) education on the proper procedures
for handling clean up and disposal of pollutants;
e. ensure long-term maintenance of all post construct BMPs in perpetuity; and
f. identify how post-development runoff rates and velocities from the site will not exceed the pre-
development runoff rates and velocities to the maximum extent practicable.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to the
following:
A. Developer shall exercise special care during the construction phase of this project to prevent
offsite siltation. Planting and erosion control shall be provided in accordance with Carlsbad
Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction of the City Engineer.

With reference to your reply of September 8, 2004 in regard to our application for a land use
permit for paricing for the above referenced property please fmd enclosed a revised "Parking
Detail" plan for a total of nine (9) parking spaces.
According to the information enclosed with your reply (see Engineering, item No. 2) we have
been approved for a total of eight (8) parking spaces and asked to eliminate space # 1 and space
#6 (see Engineering, Item No. 3.) Space #1 was eliminated because it was in the front yard
setback area. (Housing and Redevelopment, Item No. 1.)
Subsequently, we have moved space #1 up so that it is completely out of the front setback area.
By eliminating the trash bin area at the northwest comer, there is ample room for five (5) parallel
parking spaces as shown on the attached plan and a buffer zone of two (2) feet.
As per your request, we have eliminated space #6 to accommodate a dumpster. As you can see
from the plan, we have placed the trash bin area in space # 6 at a distance of seven (7) feet from
the building as there is an existing eight foot door into the building as shown on the attached
plan. The trash bin area is according to the size and location of the new bin area for the recently
completed Carlsbad Animal Hospital, the plans for which I recently picked up from your office.
Our thanks and appreciation for the help and information received in this process from your
office and from Mr. Clyde Wickham at City of Carlsbad Engineering.
It is our request that we be approved for the nine (9) parking spaces as per the attached plan.

landscape improvements on plans. Plans must show the types of plants and location within
the existing landscaped dirt strip.

4. Developer shall install sight distance corridors at alt street / Alley intersections in
accordance with Engineering Standards.
Type I
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above
the street level may be placed or permitted to encroach within the area identified
as a sight distance corridor in accordance with City Standard Public Street-
Design Criteria, Section 8.B.3.
The limits of these sight distance corridors shall be reflected on any Paving,
Improvement, or Landscape Plan prepared in association with this development.
5. Prior to the issuance of grading permit or building permit, whichever occurs first,

6. Prior to approval of improvement plans or final map. Developer shall meet with the Fire
Marshal to determine if fire protection measures (fire flows, fire hydrant locations,
building sprinklers) are required to serve the project. Fire hydrants, if proposed, shall be
considered public improvements and shall be served by public water mains to the
satisfaction of the District Engineer.
7. This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the District Engineer has
determined that adequate water and sewer facilities are available at the time of
occupancy.

In reply to your letter of March 25, 2004, please fmd the attached parking revision proposal that is for ten
spaces including one that is van accessible at the above referenced address. The flow of traffic will be one-
way from State Street through the property to the alley. There will be no changes to the existing building or
site. The building has been in existence in its present form since 1975.
We will not be removing and replacing any asphalt or concrete currently in existence. The only change we
foresee in the near future is removal of the chain link fencing and, subsequent to approval, stripping for the
parking plan.
At this property there is a 50% availability of "in lieu of spaces according to Housing and
Redevelopment's Craig Ruiz. We are looking at the possibility of using this program in the fiiture.
We hope this will clarify our request. Our apologies for having confused the issue in our previous request of
Febmary 24, 2004.
Hopefully this will be the first step toward establishing a higher and better use for this property in the
future.

Thank you for applying for a Land Use Permit in the City of Carisbad. The Housing and
Redevelopment Department, together with other appropriate City departments has reviewed
your Administrative Redevelopment Permit, application No. RP 04-05, as to its completeness

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION

Please submit to the Housing and Redevelopment Department six (6) copies of the revised site
plan showing the following information:
Housing & Redevelopment:
Please include the following information on the revised site plan:
1. Please provide existing and proposed floor plans, and landscape plans for a complete
review.
2. Provide a building elevation indicating proposed fagade improvements to the building.
3. Width of existing driveway from building to parking spaces.
4. Based on the proposed 1500 square feet of retail space, 930.30 square feet for the second
story unit, and 3933.40 square feet of wholesale/warehouse space, a total of eleven (11)
parking spaces are required. One of the eleven (11) required parking spaces shall meet the
van accessible parking stall requirement. This may impact the number of spaces provided
on site. You may possibly need to explore other parking options or reduce the proposed
retail square footage to meet the required parking. Please see enclosure regarding this
requirement.
5. Parking is to be avoided in the front setback area. Parking spaces 1 thru 5 should be
moved westerly such that space number 5 is at the western property line, or a few feet
back. If allowed, the end parking spaces of parallel spaces may be 20 feet in length, rather
than 24 feet shown (space 1 and 5).
6. Project is exempt from CEQA and it's not in the coastal zone.
Engineering:
Engineering issues which need to be resolved or adequately addressed prior to staff making a
determination on the proposed project are as follows:
1. Please submit the proposed development on a standard 24"X36" site plan. Specifically,
items that Engineering is interested in: Right of Way for streets (widths and
improvements), location of utilities (sewer, water gas & elect, etc.), fire hydrants,
drainage improvements, existing storm drains & inlets. From this site plan vehicle
circulation and conflicts with adjacent driveways is reviewed. Onsite operation, parking,
trash receptacle locations, trash truck access, loading areas (not in public streets) are all
part of our review. Existing topography and the proposed design, grading including
earthwork quantities are equally important for a complete review.
2. A preliminary grading/drainage plan (This information may be included as part of your
site plan). Provide grading quantities, spot elevations and slope grades.
3. Preliminary Title Report current within the last six months.
4. Show location of trash receptacle as well as access, preferably without blocking public
streets or alleys.
5. Show names, widths and improvements for State Street, Street identified along the
north side of the project, and the (Public?) alley behind the project. Include existing and
proposed improvement (new driveways, planters, curb & gutter) information.

6. On the preliminary grading plan, provide additional spot elevations or topography at
least 25-feet outside the property line. This information should clearly demonstrate
existing drainage patterns.
7. This project qualifies as a "priority" project pursuant to new regulations issued by the
Regional Water Quality Control Board. Please clarify how this project minimizes
impervious area and maximizes infiltration to the maximum extend practical for storm
run-off. One suggestion may be for the water discharged from the parking lot to flow
over a grass or landscaped swale along the side of the structure to allow for some
infiltration before being discharged to City right-of-way.
8. The legal description for this project is not clear. Please submit a title report to validate
the ownership and easement information of the proposed development.
9. Revise the site plan to list the correct ADT (traffic), EDU (sewer), and GPD (water)
required or generated by this project.
10. Parking space #1 is located within the City Right of way (move back, clear of State
Street R/W.
11. Revise the site plan and preliminary grading plan to incorporate stalls at least 10-feet
wide when located next to solid walls (parking space 11). This is required so vehicles
may open their doors.
12. Identify the location of the nearest fire hydrant. Also, if fire sprinklers are required, add
a separate water line and double detector check valve for the sprinkler system. Locate
the DDC Valve on private property but in a location accessible to the Fire Department.
A redlined check print is enclosed for the applicants use in making the requested
revisions. This check print must be returned with the plan revisions to facilitate
continued staff review. Also attached is a copy of a Redevelopment Permit for
Carisbad Animal Hospital, as an example of a site plan.

Building:
Based on the submitted documentation, the Building Department had the following comments:
1. Change of use to retail and a dwelling unit will require a building permit after acquisition
of a Redevelopment Permit.
2. Parking for retail has to provide a van accessible parking stall. This should be the
closest stall and provide an 8 foot loading / unloading zone and a path of travel to the
main entrance to the retail component.
3. The residential unit has to have an occupancy separation between the retail and
residence (fire resistive assembly). The entrance/exit from the residence cannot
terminate inside the retail store.

COMPLETNESS AND ISSUES REVIEW
The Engineering Department has completed a review of the above subject. We have
reviewed the application for completeness and have determined that the application and
plans submitted for the project are incomplete and unsuitable for continued review due
to the following incomplete items:
Incomplete Items
1. Please submit the proposed development on a standard 24"X36" site plan.
Specifically items that Engineering is interested in: Right of Way for streets (widths
and improvements), location of utilities (sewer, water gas & elect, etc.), fire hydrants,
drainage improvements, existing storm drains & inlets. From this site plan vehicle
circulation and conflicts with adjacent driveways is reviewed. Onsite operation,
parking, trash receptacle locations, trash truck access, loading areas (not in public
streets) are all part of our review. Existing topography and the proposed design,
grading including earthwork quantities are equally important for a complete review.
2. A preliminary grading/drainage plan (This information may be included as part of your
site plan). Provide grading quantities, spot elevations and slope grades.
3. Preliminary Title Report current within the last six months.
4. Show location of trash receptacle as well as access, preferably without blocking
public streets or alleys.
5. Show names, widths and improvements for State Street, Street identified along the
north side of the project, and the (Public?) alley behind the project. Include existing
and proposed improvement (new driveways, planters, curb & gutter) information.
6. On the preliminary grading plan, provide additional spot elevations or topography at
least 25-feet outside the property line. This information should clearly demonstrate
existing drainage patterns.
7. This project qualifies as a "priority" project pursuant to new regulations issued by the
Regional Water Quality Control Board. Please clarify how this project minimizes
impervious area and maximizes infiltration to the maximum extend practical for
storm run-off. One suggestion may be for the water discharged from the parking lot
to flow over a grass or landscaped swale along the side of the structure to allow for
some infiltration before being discharged to City right-of-way.
8. The legal description for this project is not clear. Please submit a title report to
validate the ownership and easement information of the proposed development.
9. Revise the site plan to list the correct ADT (traffic), EDU (sewer), and GPD (water)
required or generated by this project.
10. Parking space #1 is located within the City Right of way (move back, clear of State
Street R/W.
11. Revise the site plan and preliminary grading plan to incorporate stalls at least 10-feet
wide when located next to solid walls. This is required so vehicles may open their
doors.
12. Identify the location of the nearest fire hydrant. Also, if fire sprinklers are
required, add a separate water line and double detector check valve for the
sprinkler system. Locate the DDC Valve on private property but in a location
accessible to the Fire Department.
A redlined check print is enclosed for the applicants use in making the requested
revisions. This check print must be returned with the plan revisions to facilitate
continued staff review. Also attached is a copy of a Redevelopment Permit for
Carlsbad Animal Hcf^pilal, as an example of a site plan.

Dear Ms. Rosenstein,
Attached please find parking proposal for use of property located
at 2659 State Street, Carlsbad, CA.
We are requesting the following usage for the building:
(1) 1500 sq. feet of retail
(2) Approximately 930.3 sq. feet of habitation
one or two bedrooms (second floor only)
(3) Approximately 3933.4 sq. feet of wholesale/warehouse
area
We currently are using this building as warehousing and wholesale
of antiques and would like to upgrade the function of this property
thus creating higher and better usage. If this is viable, future
plans to remodel the building with a more pleasing facade than the
current outdated look are anticipated. An upscale facade change
will create better eye appeal and furter enhance the Village
atmosphere on North State Street.
We feel this will better suit not only our needs as as a long time
local business entity, but serves to create additional retail
availability and stimulate business activity on North State Street
which will happily result in increased revenue and sales tax.
With this positive change the results will include a richer, more
esthetically appealing climate for the whole community and benefit
all who visit, live, work and shop in our Village area. We are also
confident that this will increase foot traffic in the Village area.

Redevelopment view of the future for north State Street and feel
that we are within the guidelines of Housing and Redevelopment
for this change.
Having maintained a successful business in the Village for the past
