The following items need to be resolved or adequately addressed prior to staff making a final determination on the proposed project: (Please note, the issues are listed under the department which identified them as an area of concern.) Housing & Redevelopment: 1. Please indicate how the trash bin area is to be screened from the alley public right-of-way. Identify the height of the trash bin area and whether or not the trash bin will include doors for screening purposes. An elevation may be helpful to demonstrate the height and visual appearance. 2. Please identify the height of the decorative wall next to parking space number five (#5). 3. Public Notification Package The public notification package shall include the following information: a. A typewritten list of the names and addresses of all property owners within a 300' radius of subject property (including the applicant and/or owner). Please add the following conditions of approval to the approving resolution or letter: ENGINEERING CONDITIONS NOTE: Unless specifically stated in the condition, all of the following conditions, upon the approval of this proposed site development plan, must be met prior to approval of a grading or building permit, whichever occurs first. 1. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, Developer shall apply for and obtain approval from, the City Engineer for the proposed haul route. 2. The SWMP shall address measures to avoid contact or filter said pollutants from storm water, to the maximum extent practicable, for the post-construction stage of the project. At a minimum, the SWMP shall: a. identify existing and post-development on-site pollutants-of-concern; b. identify the hydrologic unit this project contributes to and impaired water bodies that could be impacted by this project; c. recommend source controls and treatment controls that will be implemented with this project to avoid contact or filter said pollutants from storm water to the maximum extent practicable before discharging to City right-of-way; d. establish specific procedures for handling spills and routine clean up. Special considerations and effort shall be applied to (RESIDENT/EMPLOYEE) education on the proper procedures for handling clean up and disposal of pollutants; e. ensure long-term maintenance of all post construct BMPs in perpetuity; and f. identify how post-development runoff rates and velocities from the site will not exceed the pre- development runoff rates and velocities to the maximum extent practicable. Code Reminder The project is subject to all applicable provisions of local ordinances, including but not limited to the following: A. Developer shall exercise special care during the construction phase of this project to prevent offsite siltation. According to the information enclosed with your reply (see Engineering, item No. 2) we have been approved for a total of eight (8) parking spaces and asked to eliminate space # 1 and space #6 (see Engineering, Item No. 3.) Space #1 was eliminated because it was in the front yard setback area. (Housing and Redevelopment, Item No. 1.) Subsequently, we have moved space #1 up so that it is completely out of the front setback area. By eliminating the trash bin area at the northwest comer, there is ample room for five (5) parallel parking spaces as shown on the attached plan and a buffer zone of two (2) feet. As per your request, we have eliminated space #6 to accommodate a dumpster. As you can see from the plan, we have placed the trash bin area in space # 6 at a distance of seven (7) feet from the building as there is an existing eight foot door into the building as shown on the attached plan. The trash bin area is according to the size and location of the new bin area for the recently completed Carlsbad Animal Hospital, the plans for which I recently picked up from your office. This project is approved upon the express condition that building permits will not be issued for the development of the subject property, unless the District Engineer has determined that adequate water and sewer facilities are available at the time of occupancy. The flow of traffic will be one- way from State Street through the property to the alley. There will be no changes to the existing building or site. The building has been in existence in its present form since 1975. We will not be removing and replacing any asphalt or concrete currently in existence. The only change we foresee in the near future is removal of the chain link fencing and, subsequent to approval, stripping for the parking plan. At this property there is a 50% availability of "in lieu of spaces according to Housing and Redevelopment's Craig Ruiz. We are looking at the possibility of using this program in the fiiture. We hope this will clarify our request. Our apologies for having confused the issue in our previous request of Febmary 24, 2004. Please provide existing and proposed floor plans, and landscape plans for a complete review. 2. Provide a building elevation indicating proposed fagade improvements to the building. 3. Width of existing driveway from building to parking spaces. 4. Based on the proposed 1500 square feet of retail space, 930.30 square feet for the second story unit, and 3933.40 square feet of wholesale/warehouse space, a total of eleven (11) parking spaces are required. One of the eleven (11) required parking spaces shall meet the van accessible parking stall requirement. This may impact the number of spaces provided on site. You may possibly need to explore other parking options or reduce the proposed retail square footage to meet the required parking. Please see enclosure regarding this requirement. 5. Parking is to be avoided in the front setback area. Parking spaces 1 thru 5 should be moved westerly such that space number 5 is at the western property line, or a few feet back. If allowed, the end parking spaces of parallel spaces may be 20 feet in length, rather than 24 feet shown (space 1 and 5). 6. Project is exempt from CEQA and it's not in the coastal zone. Engineering: Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1. Please submit the proposed development on a standard 24"X36" site plan. Specifically, items that Engineering is interested in: Right of Way for streets (widths and improvements), location of utilities (sewer, water gas & elect, etc.), fire hydrants, drainage improvements, existing storm drains & inlets. From this site plan vehicle circulation and conflicts with adjacent driveways is reviewed. Onsite operation, parking, trash receptacle locations, trash truck access, loading areas (not in public streets) are all part of our review. Existing topography and the proposed design, grading including earthwork quantities are equally important for a complete review. 2. A preliminary grading/drainage plan (This information may be included as part of your site plan). Provide grading quantities, spot elevations and slope grades. 3. Preliminary Title Report current within the last six months. 4. Show location of trash receptacle as well as access, preferably without blocking public streets or alleys. 5. Show names, widths and improvements for State Street, Street identified along the north side of the project, and the (Public?) alley behind the project. Include existing and proposed improvement (new driveways, planters, curb & gutter) information. Application Items RP04-05 Page 2 6. On the preliminary grading plan, provide additional spot elevations or topography at least 25-feet outside the property line. This information should clearly demonstrate existing drainage patterns. 7. This project qualifies as a "priority" project pursuant to new regulations issued by the Regional Water Quality Control Board. Please clarify how this project minimizes impervious area and maximizes infiltration to the maximum extend practical for storm run-off. One suggestion may be for the water discharged from the parking lot to flow over a grass or landscaped swale along the side of the structure to allow for some infiltration before being discharged to City right-of-way. 8. The legal description for this project is not clear. Please submit a title report to validate the ownership and easement information of the proposed development. 9. Revise the site plan to list the correct ADT (traffic), EDU (sewer), and GPD (water) required or generated by this project. 10. Parking space #1 is located within the City Right of way (move back, clear of State Street R/W. 11. Revise the site plan and preliminary grading plan to incorporate stalls at least 10-feet wide when located next to solid walls (parking space 11). This is required so vehicles may open their doors. 12. Identify the location of the nearest fire hydrant. Also, if fire sprinklers are required, add a separate water line and double detector check valve for the sprinkler system. Locate the DDC Valve on private property but in a location accessible to the Fire Department. A redlined check print is enclosed for the applicants use in making the requested revisions. This check print must be returned with the plan revisions to facilitate continued staff review. Also attached is a copy of a Redevelopment Permit for Carisbad Animal Hospital, as an example of a site plan. Building: Based on the submitted documentation, the Building Department had the following comments: 1. Change of use to retail and a dwelling unit will require a building permit after acquisition of a Redevelopment Permit. 2. Parking for retail has to provide a van accessible parking stall. This should be the closest stall and provide an 8 foot loading / unloading zone and a path of travel to the main entrance to the retail component. 3. The residential unit has to have an occupancy separation between the retail and residence (fire resistive assembly). Preliminary Title Report current within the last six months. 4. Show location of trash receptacle as well as access, preferably without blocking public streets or alleys. 5. Show names, widths and improvements for State Street, Street identified along the north side of the project, and the (Public?) alley behind the project. Include existing and proposed improvement (new driveways, planters, curb & gutter) information. 6. On the preliminary grading plan, provide additional spot elevations or topography at least 25-feet outside the property line. This information should clearly demonstrate existing drainage patterns. 7. This project qualifies as a "priority" project pursuant to new regulations issued by the Regional Water Quality Control Board. Please clarify how this project minimizes impervious area and maximizes infiltration to the maximum extend practical for storm run-off. One suggestion may be for the water discharged from the parking lot to flow over a grass or landscaped swale along the side of the structure to allow for some infiltration before being discharged to City right-of-way. 8. The legal description for this project is not clear. Please submit a title report to validate the ownership and easement information of the proposed development. 9. Revise the site plan to list the correct ADT (traffic), EDU (sewer), and GPD (water) required or generated by this project. 10. Parking space #1 is located within the City Right of way (move back, clear of State Street R/W. 11. Revise the site plan and preliminary grading plan to incorporate stalls at least 10-feet wide when located next to solid walls. This is required so vehicles may open their doors. 12. Identify the location of the nearest fire hydrant. Also, if fire sprinklers are required, add a separate water line and double detector check valve for the sprinkler system. Locate the DDC Valve on private property but in a location accessible to the Fire Department. A redlined check print is enclosed for the applicants use in making the requested revisions. If this is viable, future plans to remodel the building with a more pleasing facade than the current outdated look are anticipated. An upscale facade change will create better eye appeal and furter enhance the Village atmosphere on North State Street.
