In converting the front patio into livable space, facade improvements to the front of the
residential unit would be required. Attached is a copy of the Carlsbad Village Redevelopment
Master Plan's design guidelines for residential properties that lists examples of facade
improvements. Please show on the plans the facade improvements that will enhance the
remodel changes to the front elevation of the residential unit.

Engineering Department staff has completed a review of the above-referenced project for
application completeness and have determined that the application and plans submitted for the
project are Incomplete and unsuitable for continued review due to the following
Incomplete Items:
1. Submit a site plan showing the property line with bearings and distances. Include the
project number in the upper right hand corner. Also include sewer and water districts
providing service to the project.
2. Submit a title report for the property. It may be a copy of the report obtained when the
property was purchased. Show existing easements, if any, in the site plan.
3. Show existing and proposed contours or spot elevations of the site and surrounding
area.
4. Show full width of Roosevelt Street. Include a cross-section of the street in the site plan.
5. Show existing sewer and water laterals.
6. Show closest fire hydrant.
7. Project is subject to National Pollutant Discharge Elimination System (NPDES)
requirements. Submit a completed "Storm Water Requirements Applicability Checklist"
and required documents per the City's "Standard Urban Storm Water Mitigation Plan"

submitted. Among the issues that will be determined are whether a grading permit will be
required for the proposed work, the legal status of the site, and storm water requirements.

Housing & Redevelopment staff has completed a review of the above-referenced project for
application completeness and have determined that the application and plans submitted for the
project are Incomplete and unsuitable for continued review due to the following
Incomplete Items:
1. In order for the proposed new garage to be approved it will need to comply with the
development standards for District 5, which requires a minimum side yard setback of
five (5) feet. Additionally, the interior space of the garage must comply with city
ordinance requiring an interior space of 20 feet by 20 feet. Currently the plans indicate
an exterior dimension of 20 feet for the proposed garage.
2. The existing garage does not have a permit on file with the City of Carisbad Building
Department and is presumed to be an illegal and nonconforming use. It is the burden of
the property owner to prove othen/vise. In order for this structure to be created into
habitable space it will need to comply with the current development standards, which
requires a side yard setback of five (5) feet. Additionally, since the existing garage is
presumed to have been built without a permit it is advised that you contact the Building
Department in order to determine whether the existing structure can be easily converted
into habitable space that would be safe for persons to occupy.
3. In converting the front patio into livable space, facade improvements to the front of the
residential unit would be required. Attached is a copy of the Carisbad Village

Please include the following information on the revised site plan:
1. A site plan showing all existing structures on the property. State the existing structures
current description. For example, state that the structure shown as the existing garage has
been converted to habitable space. Show and label all existing patios, tents, and covered
structures.
2. A site plan showing the proposed remodel stating the proposed additions. State which
existing structures will remain on the property.
3. The proposed new garage is continuing the nonconforming side yard setback of three feet,
eight inches (3', 8"). The side yard setback requirement is five to ten (5-10) feet. Thus, the
proposed reduced setback will require a Variance. Before a Variance may be granted, the
Design Review Board will be required to make the following findings:
a. That because of special circumstances applicable to the subject property, including size,
shape, topography, location or surroundings, the strict application of the development
standards deprives such property of privileges enjoyed by other property in the vicinity
and under identical zoning classification;
b. That the variance shall not constitute a grant of special privileges inconsistent with the
limitations upon other properties in the vicinity and zone in which the subject property is
located and is subject to any conditions necessary to assure compliance with this
finding;
c. That the variance does not authorize a use or activity which is not otherwise expressly
authorized by the zone regulation governing the subject property;
d. That the variance is consistent with the general purpose and intent of the general plan
and any applicable specific or master plans;
Please submit a letter explaining how the granting of the Variance complies with each of the
above listed findings.
4. State the height of the structure on the plans.

COMPLETENESS REVIEW
The Planning Department has completed its review of the subject project for application
completeness. Staff has conducted a preliminary review of the project for issues of concern.
The issues should be adequately addressed prior to making a determination:
1. The proposed remodel cumulatively increases the useable living are by more than 40%.
Such a design must meet and incorporate the architectural design guidelines of Council
Policy 44. Does the project show compliance with this policy OR are deviations from the
policy justifiable?
2. Make sure that the proposed remodel is in conformance to the Redevelopment Master
Plan and Design Manual development standards for Zone 5. Is it permissible to allow
remodel improvements to an existing structure when the addition is so close to the
property line?
Pursuant to Chapter 21.48.080, a non-conforming use or building shall not alter or
intensify the floor space by more than 40% of the existing floor area prior to
enlargement.
In addition, no nonconforming building, structure, or use shall be changed to any other
non-conforming building, structure, or use. The site plan shows the conversion of a
detached garage to the living area of the main structure.
3. Construction or conversion of a small facility is categorically exempt.

RE: Additions of New Living Areas and New Garage at 2705 Madison Street - CB042125
Dear Mr. & Mrs. Friedrichs:
Our office received the building plans for the above referenced additions. This letter is to inform you that
the proposed additions require an administrative redevelopment permit prior to the issuance of the building
permit. Your property is located in District 5 within the Redevelopment Area. The Carisbad Village
Redevelopment Master Plan and Design Manual governs the Redevelopment Area and states the
development standards for all properties located in the Redevelopment area. Therefore, your building
plans were fonwarded to the Housing and Redevelopment Department for review. After reviewing the
building plans, a determination was made for requiring a redevelopment permit for the following reasons:
1. Additions to existing structures which result in a cumulative increase of more than 10% of the
internal floor area require an administrative redevelopment permit; and
2. New construction or addition(s) to the building footprint, which have a building permit valuation,
which is equal to or less than $60,000 require an administrative redevelopment permit.
In addition, the proposed setbacks mentioned on the building plans do not meet the required setbacks for
properties located within District 5. Therefore, you will need to apply for a variance to receive a
determination to reduce and exceed the setback requirements. The required setbacks for properties
located in District 5 are as follows:
Required Setbacks Proposed Setbacks
Front: 5-20 feet 16.5 feet
Side: 5-10 feet 3 feet 8 inches; 27 feet 4 inches
Rear: 5-10 feet 24 feet 4 inches
You can apply for the variance along with the administrative redevelopment permit. An administrative
redevelopment permit takes approximately 60 days to process and the filing fee is $290. If you decide to
move forward with the proposed additions, an administrative redevelopment permit is required before a
building permit can be issued. With this letter I am enclosing an administrative redevelopment permit
application, which includes the application and a list of items that need to be submitted with the application.
Please submit a complete administrative redevelopment permit application to the Housing and
Redevelopment Department.
