The Improvement Plancheck process has been completed for the project noted above. The
improvements reflected on these improvement plans indicate that you must obtain a right-of-way
permit prior to initiating vour construction activities. The following information will assist you in
obtaining this no-fee right-of-way permit.
Please do not begin construction until vou have received vour right-of-way permit from
the Public Works Inspector.
Prior to issuing a right-of-way permit, the City must approve the following items. If you have not
already done so, please submit these items to the Engineering Development Services counter at
1635 Faraday Avenue.
1. Completed right-of-way permit application package (enclosed) submitted within 18
months of the date of mylar signing (see www.carlsbadca.gov/engineering for current version
of forms). Requirements for completing the application package include:
a. Contractors state license number and class
b. City of Carlsbad business license number
c. Certificate of insurance as described in the application package
d. Traffic control plan (if not included in the improvement plans)
2. Five copies (three full-size and two 11" x 17") of the signed improvement plans
3. A copy of this letter
In addition to the requirements listed above, if your project requires a grading permit, you
must complete the items listed on the Completion of Grading Plancheck letter and receive
approval for a grading permit prior to or concurrently with the issuance of the right-of-way
permit.
After complying with the requirements listed above, you will be provided with contact information
for scheduling the preconstruction meeting with a Public Works Inspector. The Inspector will
give you your copy of the right-of-way permit at the preconstruction meeting.

The following additional items may be required during the construction of your project. Please
coordinate the timing of these items with your Inspector.
1. Application with the appropriate utilities department(s) to tap into sewer, water, and/or
reclaimed water lines
2. An approved Haul Route Permit prior to hauling any construction equipment or materials
onsite or offsite
3. A Retaining Wall Permit from the Building Department
As part of the Improvement Plancheck process, the City Engineer signed the improvement plans
for the project noted above. These plans are now the property of the City of Carlsbad and have
been filed for permanent record with this office. You may obtain copies and other reproductions
at your cost through one of several City-approved reprographic firms in the area.
The approval of these plans by the City of Carlsbad does not authorize the applicant to violate
any federal, state, or city laws, ordinances, regulations, or policies.
Also, issuance of your right-of-way permit is subject to the limitations and requirements of City
ordinances, policies, and regulations; your conditions of approval, if any; and all permits and
approvals required by state and federal agencies including, but not limited to, the California
Department of Fish and Game, United States Fish and Wildlife Service, California Coastal
Commission, and San Diego Regional Water Quality Control Board.

PROPOSED MINOR SUBDIVISION NO. MS 04-17 MADISON SQUARE
The City Engineer has made a preliminary decision pursuant to Section 20.24.120 of the City of
Carlsbad Municipal Code, to approve the tentative parcel map of the proposed minor
subdivision subject to conditions that follow in this letter.
Unless specifically stated in the condition, all of the following conditions, upon the approval of
this tentative parcel map, must be met priorto approval of a final parcel map.
1. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project. Developer shall apply for and obtain approval from, the City Engineer
for the proposed haul route.
2. Prior to issuance of any building permit. Developer shall comply with the requirements of
the City's anti-graffiti program for wall treatments if and when such a program is formally
established by the City.
3. Developer shall submit to the City Engineer, a reproducible 24" x 36", mylar copy of the
tentative parcel map and a digital copy of said map (in AutoCAD format, latest version)
reflecting the conditions approved by the final decision making body. The reproducible
shall be submitted to the City engineer, reviewed and, if acceptable, signed by the City's
project engineer and project planner prior to submittal of the building plans, final map,
improvement or grading plans, whichever occurs first. The digital file copy shall be
submitted in a format as approved by the City Engineer.
4. Developer shall and does hereby agree to indemnify, protect, defend and hold harmless
the City of Carlsbad, its Council members, agents, officers, and representatives, from
and against any and all liabilities, losses, damages, demands, claim and costs, including
court costs and attorney's fees incurred by the City arising, directly or indirectly, from (a)
City's approval and issuance of this tentative parcel map, (b) City's approval or issuance
of any permit or action, whether discretionary or non-discretionary, in connection with the
use contemplated herein, including an action filed within the time period specified in
Government Code Section 66499.37 and (c) Developer's installation and operation of
the facility permitted hereby, including without limitation, any and all liabilities arising
from the emission by the facility of electromagnetic fields or other energy waves or
emissions.
5. Developer shall provide to the City Engineer, an acceptable means, CC&Rs and/or other
recorded document, for maintaining the private easements within the subdivision and all
the private improvements: streets, sidewalks, street lights, and storm drain facilities
located therein and to distribute the costs of such maintenance in an equitable manner

among the owners of the properties within the subdivision.
6. Developer shall cause property owner to execute and submit to the City Engineer for
recordation the City's standard form Drainage Hold Harmless Agreement regarding
drainage across the adjacent property.
7. Prior to approval of any grading or building permits for this project. Developer shall
cause Owner to give written consent to the City Engineer to the annexation of the area
shown within the boundaries of the subdivision into the existing City of Carlsbad Street
Lighting and Landscaping District No. 1 and/or to the formation or annexation Into an
additional Street Lighting and Landscaping District Said written consent shall be
on a form provided by the City Engineer.
8. Based upon a review of the proposed grading and the grading quantities shown on the
tentative parcel map, a grading pennit for this project is required. Developer shall apply
for and obtain a grading permit from the City Engineer prior to issuance of a building
permit for the project.
9. Developer shall execute and record a City standard Subdivision Improvement
Agreement to install and secure with appropriate security as provided by law, public
improvements shown on the tentative parcel map; and the following improvements
including, but not limited to paving, base, sidewalks, curb and gutter, grading, clearing
and grubbing, sewer, and water to City Standards to the satisfaction of the City
Engineer. The improvements are:
a) Street improvements to Madison Street as shown on the tentative
parcel map.
A list of the above shall be placed on an additional map sheet on the Parcel Map per the
provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above
shall be constructed within 18 months of approval of the subdivision or development
improvement agreement or such other time as provided in said agreement.
10. Madison Street shall be dedicated by Owner along the project frontage based on a
center line to right-of-way width of thirty (30) feet and in conformance with City of
Carlsbad Standards.
11. Developer shall have the entire drainage system designed, submitted to and approved
by the City Engineer, to ensure that runoff resulting from 10-year frequency storms of 6
hours and 24 hours duration under developed conditions, are equal to or less than the
runoff from a storm of the same frequency and duration under existing developed
conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the
detention basin capacities necessary to accomplish the desired results.
12. Prior to the issuance of grading permit or building permit, whichever occurs first,
Developer shall submit for City approval a "Storm Water Management Plan
(SWMP)." The SWMP shall demonstrate compliance with the City of Carlsbad
Standard Urban Stormwater Mitigation Plan (SUSMP), Order 2001-01 issued by the
San Diego Region of the California Regional Water Quality Control Board and City
of Carlsbad Municipal Code. The SWMP shall address measures to avoid contact

or filter said pollutants from storm water, to the maximum extent practicable, for
the post-construction stage ofthe project At a minimum, the SWMP shall:
a. identify existing and post-development on-site pollutants-of-concern;
b. identify the hydrologic unit this project contributes to and impaired water bodies that
could be impacted by this project;
c. recommend source controls and treatment controls that will be implemented with this
project to avoid contact or filter said pollutants from stomri water to the maximum
extent practicable before discharging to City right-of-way;
d. establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to resident education on the proper
procedures for handling clean up and disposal of pollutants;
e. ensure long-term maintenance of all post construct BMPs in perpetuity; and
f identify how post-development runoff rates and velocities from the site will not
exceed the pre-development runoff rates and velocities to the maximum extent
practicable.
13. The Average Daily Trips (ADT) and floor area contained in the staff report and shown on
the tentative parcel map are for planning purposes only. Developer shall pay traffic
impact and sewer impact fees based on Section 18.42 and Section 13.10 of the City of
Carlsbad Municipal Code, respectively.
14. Prior to approval of improvement plans or final map. Developer shall meet with the Fire
Marshal to determine if fire protection measures (fire flows, fire hydrant locations,
building sprinklers) are required to serve the project. Fire hydrants, if proposed, shall be
considered public improvements and shall be served by public water mains to the
satisfaction of the District Engineer.
15. The Developer shall design and construct public facilities within public right-of-way or
within minimum 20-feet wide easements granted to the District or the City of Carlsbad.
At the discretion ofthe District Engineer, wider easements may be required for adequate
maintenance, access and/or joint utility purposes.
16. Prior to issuance of building permits. Developer shall pay all fees, deposits, and charges
for connection to public facilities. Developer shall pay the San Diego Countv Water
Authoritv capacitv charqe(s) prior to issuance of Building Permits.
17. The Developer shall install potable water services and meters at a location approved by
the District Engineer. The locations of said services shall be reflected on public
improvement plans.
18. The Developer shall install sewer laterals and clean-outs at a location approved by the
District Engineer. The locations of sewer laterals shall be reflected on public
improvement plans.
19. The Developer shall design and construct public water, sewer, and recycled water
facilities substantially as shown on the tentative parcel map to the satisfaction of the
District Engineer. Proposed public facilities shall be reflected on public improvement
plans.
20. The Developer shall provide separate potable water meters for each separately owned
unit.

21. This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the District Engineer has
determined that adequate water and sewer facilities are available at the time of
occupancy. A note to this effect shall be placed on the Final Parcel Map, as non-
mapping data.
22. Prior to Final Parcel Map approval. Developer shall install a total of 5 water meters for
the project. Developer shall install 4 potable water meter(s) for residential use and 1
irrigation meter to irrigate the common areas (Homeowner's Association).
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
A. The tentative parcel map shall expire twenty-four (24) months from the date this tentative
map approval becomes final.
B. Developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with Carlsbad Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction
of the City Engineer.
Developer may request a review of the preliminary decision with the City Engineer in writing
within ten (10) days of the date of this letter. Upon such written request the City Engineer shall
arrange a time and place with Developer for such review.
The City Engineer has reviewed each of the exactions imposed on Developer contained in
these conditions of approval, and hereby finds, in this case, that the exactions are imposed to
mitigate impacts caused by or reasonably related to the project, and the extent and degree of
the exaction is in rough proportionality to the impact caused by the project.

HOUSING AND REDEVELOPMENT
1. Staff is pleased with the project design, however a color & materials board must be
submitted prior to staff making a final recommendation on the project. Please submit a
color & materials board.
2. Please draw the property lines on all floor plans and indicate setbacks to the property
lines on all floor plans.
3. Please indicate the percentage of the site to be landscaped.
4. Please indicate under "Project Information #11", language that identifies that 2 guest
spaces are provided.
5. Clearly indicate building height on all elevations and section detail.
6. Identify existing and finished grade on all elevations.
7. Please complete the early Public Notification Package. Staff can email you a word
document, which contains the format of the early public notification sign, for your
convenience.

application no. RP 04-24 complete have been received and reviewed by the Housing &
Redevelopment Department and all other appropriate departments. It has been

ISSUES OF CONCERN

HOUSING AND REDEVELOPMENT
1. Please clearly indicate the height of the planter wall in the front yard setback area.
2. Please indicate what the rectangular object depicted on sheet A-1 is, which is in the rear
yard setback area.
3. Please note that a 6-foot masonry wall is required between residential and commercial
uses. Please indicate this on the plans.
4. Please indicate on the plans the south side yard setback.
5. Please provide a sample of the enhanced paving material that is proposed.
6. Please correct General Note #2 on Sheet A-1. It should read "Zoning V-R, District 1".
7. Please place the project application numbers in the lower right hand corner of all the
sheets. The project application numbers are RP 04-24 and MS 04-17.
8. Please note that each unit requires a minimum of 480 cubic feet of storage space. The
Planned Development Ordinance requires separate storage space of at least four
hundred eighty (480) cubic feet for each unit. If all the storage for each unit is provided
in one area, this requirement may be reduced to three hundred ninety two (392) cubic
feet. Please revise the plans accordingly.
9. Please indicate the locations of the water heaters for each unit.
10. Please indicate the locations of the trash area and how trash will be serviced.
11. Staff can support the proposed project design and understands that the narrow width of
the property affects the proposed project design. However, please be ready to respond
to any questions and/or concerns raised (if any) at a public hearing with relation to the
massing of the building at upper levels.
ENGINEERING:
Engineering Department comments are forthcoming and will be sent under separate
correspondence with comments related to MS04-17.

7. Review Madison Street to the north of this project to determine if offset sidewalks
wouldn't be a better fit, and might allow saving some of the existing trees. Provide a
review ofthe rest of Madison Street and the configuration ofthe existing sidewalks.
8. Address comments on hydrology report. Project is proposing to divert drainage, and
must show the adequacy of all downstream drainage facilities, or propose an alternate
solution.
9. Address comments on the concept Stoim Water Management Plan.
10. Address minor redlined comments on the Tentative Parcel Map.

7. Check locations of existing utilities, and show proposed sewer lateral, proposed water
service(s) and proposed fire protection stub for fire sprinklers.
8. Show EDUs(sewer) and GPM(water) requirements of the project.
9. Add short legal descriptions and/or APNs for adjacent properties.
10. Submit two copies of a preliminary Storm Water Management Plan (SWMP).
11. Submit two copies of a preliminary Drainage Study to show that the proposed
development is not impacting existing drainage patterns and quantities.
12. See additional minor comments on redlined checkprint of tentative parcel map.

ISSUES
13. Check earthwork quantities, the number show looks low for the proposed work.
14. Obtain permission from the Parks Department for removal of the existing tree within the
public right-of-way.
15. Proposed curb grades shown create ponding. Provide additional street cross-sections
and/or elevation data to provide a solution that works.
16. Locate proposed water meters behind the sidewalk rather than in it. Show one new
connection to the water main, unless the existing service is large enough to serve all four
units. From one service, manifold into four meters. An additional meter may be needed
for irrigation - check with the landscape architect and applicant.
17. Please submit an additional copy of a current title report.
18. Show location of proposed trash enclosure.
19. Obtain a letter from the soils engineer with an opinion on the 1% swale close to the
building wall.
20. Review Madison Street to the north of this project to determine if offset sidewalks
wouldn't be a better fit, and might allow saving some of the existing trees. Provide a
review of the rest of Madison Street and the configuration of the existing sidewalks.

ISSUES OF CONCERN
Staff has completed a review of the subject project for issues of concern. The following items
need to be resolved or adequately addressed prior to staff formulating a recommendation on
the proposed project: (Please note, the issues are listed under the department which identified
them as an area of concern.)
HOUSING AND REDEVELOPMENT
1. The scale of the plans (Sheets A-2 & A-3) makes it difficult for the various Departments
to review them. Staff suggests that plans be provided in a different scale.
2. The project must be consistent with the 10 design principles outlined in the Village
Design Guidelines to be approved. Some suggestions from the Design Guidelines are
as follows:
• Building facades shall be enriched with architectural features and projects shall
incorporate quality designed fences and walls. Staff has a concern about the
appearance of the visible horizontal support beam on the east and west elevations
and the support/building wall at property line on the south elevation. Staff
recommends that the support beams and the support/building wall be configured so
they appear as an open-air trellis. This will require the support/building wall on the
south elevation to be changed to support beams. All support beams would then
need to be covered with a wood like material and painted to appear as a trellis. Staff
believes this architectural design will help enhance the appearance of the building
elevations. The applicant may propose alternatives to staff's suggestions to address
the appearance of the visible support beams and support/building wall.
• Incorporate an abundance of landscaping into the project. Proposed landscaping is
minimal. Landscaping should be personalized to the specifics of the building and
the site. Colorful flowers in planter boxes and pot, in planting beds, on trellises and
on flowering trees adds richness to the site.
2. Submit a color and materials board with the next submittal.
ENGINEERING:
Engineering Department comments are forthcoming and will be sent under a separate cover.
BUILDING:
Building Department staff has completed a review of the above-referenced project. Building
issues that need to be resolved or adequately addressed prior to staff making a determination
on the proposed project are as follows:
1. Driveway covered w/ floor beams overhead will need to provide an occupancy
separation from the units overhanging above. Open beams supported by P/L retaining
walls may not work for this. I suggest the architect meet with structural plan checkers

preliminarily to review this item. The structural plan checkers are EsGil Corporation in
San Diego - (858) 560-1468.
2. These beams are supported by a P/L wall which will have to extend 30" above these
same essentially floor beams as a parapet would. This makes that P/L masonry wall
over 14 feet tall at the P/L. That wall section shown on sheet A-1 is likely to change
dramatically when it is finally engineered.
3. Maximum space on the third level is served by one exit and is therefore limited to 500
square feet. Please identify the available space on the third floor (including the exterior
deck, storage and Vi the floor area of the stairs). Proposed project might exceed the
500 square feet limitation but it is difficult to calculate with a scale.
4. If the aggregate floor area of the building (including garage spaces) exceeds 10,000 sf,
an automatic sprinkler system will be required.

must be returned with the next project submittal.

Cliff:
The Redevelopment Manual says the project should comply with the PD Ordinance, so most of
these comments are PD related.
Why does the project have a CT when it should be processing a CP and MS for four units? I
guess the RP covers the CP, but the CT is incorrect and should be withdrawn and the project
reapplied for as a Minor Subdivision.
The project is not going to meet the setback requirements for the PD Ordinance. 11 feet
required to the front porch where five feet is provided. 15 feet front yard setback to the structure
where 10 feet is provided. Garage setbacks should be 5 feet from driveway and none is
provided.
Please specify on the landscape plan the type of enhanced paving that will be provided for the
driveway. Have you sent the landscape plans to our Landscape Consultant Larry Black? He is
in our office. Let me know and I can fonward then on for you if you like.
The project is CEQA exempt. Section 15303, for the construction of four or less multi-family
units in an urbanized area.
Planning is concerned over the height of the masonry wall along the southern property line and
resulting aesthetics. Would it be possible to reduce the height of the masonry unit?

Van
