Date of Notice: January 20, 2005 NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Director of the City of Carlsbad has made a final decision to APPROVE an Administrative Redevelopment Permit (RP04-25) for Lucid Sleep Inc. located at 785 Grand Avenue Suite 100. The property is located on the south side of Grand Avenue at the corner of Grand Avenue and Jefferson Street. The assessor parcel number is 203-303-28-00. The proposed project is not located within the Coastal Zone. Lucid Sleep Inc. is requesting an Administrative Redevelopment Permit to allow a sleep diagnostic testing center in an office complex. The testing center will perform diagnostic testing on persons while they sleep to determine possible sleep disorders. Testing is limited to two persons per night seven days a week with an attendant on site to assure that persons are safe in the event of an emergency. The redevelopment permit will establish project related conditions for the use and permit the use with a condition requiring for an attendant to be on site while patients sleep. The overall square footage of the office complex will not change and the property has adequate parking available on-site to accommodate the proposed use. The proposed use is a special/provisional use that is currently not addressed in the Carlsbad Village Redevelopment Master Plan; therefore, an administrative redevelopment permit is required. In order for a redevelopment permit to be issued the following findings must be made: 1. The use must be compatible with the land use district and adjacent development. 2. The use will not adversely affect retail intensity or retail continuity in the Village. 3. Adequate parking exists to serve the needs of this use. If you wish to appeal the decision of the Housing and Redevelopment Director on this matter to the Design Review Board, you must file a written appeal with the Housing and Redevelopment Department within ten (10) calendar days of the date of this decision/notice. The written appeal must be submitted no later than 5:00pm on January 30, 2005. Appeal forms are available at the Housing and Redevelopment Department located at 2965 Roosevelt Street, Suite B.
