10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
The following findings have been made in order to approve the Administrative Redevelopment Permit
and Coastal Development Permit for an outdoor awning on private property for Gregorio's
restaurant:
1. The Housing and Redevelopment Director has determined that the project is consistent with all
applicable development standards and land use policies set forth within the Village Master Plan
and Design Manual and Village Redevelopment Plan.
2. The Housing and Redevelopment Director has determined that the project is consistent with the
certified local coastal program and the goals and objectives of the Coastal Commission for the
portion ofthe Village Redevelopment Area which lies within the Coastal Zone Boundaries.
3. The Housing and Redevelopment Director has determined that the project is consistent with the
policies, goals and action programs set forth within the Carlsbad General Plan.
4. The Housing & Redevelopment Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section 15303 of the State
CEQA Guidelines and will not have an adverse significant impact on the environment.

The following conditions have been approved for the subject project:
1. This approved permit serves as the required redevelopment permit and coastal development
permit for the outdoor awning on private property.
2. The project shall be completed according to, and be consistent with, the plans approved by the
Housing and Redevelopment Director on the date noted above. The approved plans have been
stamped by the Housing and Redevelopment Director and indicate the approval date of August 1,
2005.
3. The applicant shall obtain all appropriate building permits prior to construction of the tenant
improvements associated with the use.
4. The project must comply with the latest State Disabled access regulations for existing buildings.
5. Temporary plastic drop cloths will not be permitted on the outdoor patio area.
6. This permit shall be subject to revocation by the Housing and Redevelopment Director if the
applicant fails to conform to any of the above conditions of approval.

GREGORIO'S AWNING RP 05-06/CDP 05-30
VILLAGE FAIRE PARKING ANALYSIS
Gregorios Restaurant, requests an Administrative Redevelopment Permit (RP 05-06) to
allow an awning to be placed over their outdoor dining area. The purpose of processing
an Administrative Redevelopment Permit is because the placement of the awning over a
portion of the outdoor patio could be considered an intensification of the existing use.
Since the size of the restaurant is near or at 2,000 square feet parking must be analyzed\
After much consideration, the Housing & Redevelopment Department determined that no
additional parking is necessary at the Village Faire to accommodate the proposed outdoor
dining area because the outdoor seating is less than the indoor seating. The outdoor
eating area is parked as an Outdoor Cafe therefore no additional parking is required.
' As a condition of approval of RP 87-11, Condition No. 23 of Design Review Board
Resolution No. 106 specifically limits any food service in the Village Faire center (with
the exception ofthe existing Neimans restaurant) to 2,000 square feet.
