the issuance of the building permit, the developer must submit a Notice of Restriction to
be filed in the office of the County Recorder notifying all interested parties and
successors in interest that the City of Carisbad has issued a Major Redevelopment
Permit on the real property. I have enclosed said notice which must be signed and
notarized according to the directions contained on the signature page.
I am aware that you have already signed and returned this document. However, there
have been changes made to the Notice of Restriction document at the State level that
our office was not aware of. I apologize for any inconveniences this may have caused

As you are aware, on August 15, 2006 the Housing and Redevelopment Commission
conditionally approved Major Redevelopment Permit No. RP 05-09 for property
located at 3190 Roosevelt Street. Enclosed please find a signed copy of the final
resolutions of approval for the proposed apartment project. These resolutions contain
the conditions of approval for the project. I have also enclosed a stamped set of the
approved plans referenced in the resolution as Exhibits A-G.
Your next step is to obtain the appropriate grading and building permits to construct the
proposed project. Please note many of the conditions of approval must be satisfied
prior to the issuance of building permit.

ISSUES OF CONCERN

Staff has completed a review of the subject project for issues of concern. The following items
need to be resolved or adequately addressed prior to staff making a final determination on the
proposed project: (Please note, the issues are listed under the department which identified
them as an area of concem.) Please provide two (2) complete sets of plans addressing the
following:
Housing & Redevelopment:
1. Staff suggests decorative columns be incorporated into the north property line wall. Staff
suggests the wall be constructed of pre-cast concrete wall cap with a 1" overhang (reveal)
to give the wall a bit of definition.
2. Please note on Sheet A that the new land use is: Mixed Use Commercial and Residential
Apartments.
3. Staff suggests the applicant provide additional building articulation along the north elevation
that will be visible from Roosevelt Street.
4. Staff suggests the applicant provide landscaping in the area identified as existing planter,
which is in the City right-of-way. Please consult the landscape manual or City Landscape
Consultant for more information.
5. Please identify the enhanced paving areas on the preliminary grading plan.
6. As mentioned previously, staff recommends decorative wrought iron gates be placed in the
open areas of the south building wall elevation in order to enhance the look of the building
as viewed from Pine Avenue.
7. Please provide the building coverage breakdown on Sheet A.
8. Staff noticed the exterior lighting on the south building wall is below the sign area. Please
explain.
9. Once these corrections are made to the plans staff will request the noticing materials and
color elevations necessary for the public hearings.

Landscape Plan Comments:
Please make the following corrections to the plans so that they will meet the requirements of
the City of Carisbad Landscape Manual:
1. Provide the name, contact information and license number for the Landscape Architect who
prepared the drawings.
2. Provide a water conservation plan per the Manual requirements.

3. Provide the following:
Total area of landscape
Total area of turf. Note the maximum allowable amount of turf is 10% cool season and
15% warm season. Specify the type of turf to be used.
Provide sizes for ail plants.
Show and label the edge of the ROW, property lines and easements.
Show any bio-swales/detention basins or underground drainage collection systems
(under planting areas that could impact the planting).
Show sight lines per the Manual
Label all walls, indicate heights and materials.
Label all hardscape - Ex: Tile, brick, stamped concrete
4. Provide new planting in the parkway area on Roosevelt Street between the sidewalk and the
curb. Include the two required street trees (1 per 40' of street frontage), shrubs and
groundcover.
5. Three street trees are required on Pine Avenue (1 per 40' of street frontage). The
Trachycarpus palms are not suitable as street trees.
6. Use a shrub and groundcover planting in the side 4' strip. The Landscape Manual prohibits
the use of turf in areas less than 6' wide.
7. Label the trash enclosure and provide self supporting vines on the trash enclosure.
8. Explain what is planned in the rectangular space adjacent to the building at the end of the
north row of parking.
9. Explain what is planned in the rectangular space to the south of the driveway closest to the
corner.
10. Correct misspellings and incorrect name on plants:
• Camilla saganeum - should be Camellia sasanqua
• Cape Malva - should be Cape Mallow
• Betula verrucosa - should be Betula alba
11. Provide building elevations, walls heights and materials, as well as a preliminary grading
plan with the next submittal.
12. Provide 2 copies of the landscape concept plan on the next submittal.
13. Please revise the elevations/plans to more accurately portray the trees/palms planned.
Many large palms are shown on the elevations which are not shown on the Planting
Concept. Either add the large palms or modify the elevations. In addition, please revise the
North elevation to show the property line wall. That's really a more realistic viewpoint, since
it would be impossible to see the elevation as shown.

1. A 6-foot solid masonry wall should be provided along the south property line. Please
provide wall section detail for the north property wall and show the worst case scenario.
2. Please show the second story building overhang on Sheet A and measure the setback line
on Sheet A from that point. Please indicate the new front yard setback under "Project
Data". Staff measures a 9-foot front yard setback.
3. Under "Project Data" where it says Recreational Space 120 S.F. please make it read
Required Recreational Space 120 S.F.
4. Please provide a sample image of the enhanced paving to be provided at the entrance to
the commercial space.
5. In order to meet the PD requirements for the conversion of the future apartments to
condominiums, enhanced paving will need to be provided at the driveway entrance to the
site. Please provide sample.
6. Please note the existing and proposed land use on the plans.
7. Staff understands that the applicant wishes to construct the apartments to the standards of
a condominium project so that the apartments can be converted to condominiums in the
future. Note that the standards for converting apartments to condominiums are subject to
change in the future.
8. Staff suggests the applicant provide additional building articulation along the north elevation
that will be visible from Roosevelt Street.
9. Please provide a Preliminary Landscape Plan with next submittal.

Group.
We have prepared this letter to address preliminary comments from the City of Carlsbad Engineering
Department regarding the above referenced site plan.
1. As requested additional spot elevations, quantities and slope grades have been added to the plan.
Construction BMP and erosion control devices have been removed from the plan.
2. A recent title report will be submitted.
3. As noted on the original preliminary grading plan, the 22 ft. width dimensioned the existing paved road,
and the 40 ft. dimensioned to centeriine of right-of-way. The revised pian shows the 80 feet of right-of-
way on both Roosevelt and Pine, in addition to the 20 feet of right-of-way at the alley.
4. The comment notes State Street on the north side ofthe project. This project is bounded to the north
by the adjacent residential development, APN 204-084-10, and there is no State Street within the
direct vicinity of the project.
a. With regard to the alley behind the project (approximate east side of the project) the alley is
depicted on the original plan and dimensioned on this revised plan.
b. New improvements include removal of existing driveway along Pine Avenue, new concrete
sidewalk, curb and gutter, as depicted herein and on the original plan. In addition a new
concrete entrance to the proposed parking area off the alley is proposed in lieu ofthe original
paver block entrance.
5. Additional information has been provided with regard to the adjacent apartment complex, including flow
patterns, extent of concrete parking and concrete walkways.
6. See the revised grass swale configuration. Note additional grass swales have been provided along
the north, south property line and portions of the east property line adjacent to the alley. We have
outlined pre and post development impervious surfaces, grass swale surface area on the project plan.
Gutter downspouts have also been depicted to demonstrate rooftop runoff will flow into tlie proposed
grass swales for filtration. Runoff will flow from rooftops, parking areas to grass swales for filtration
and to existing improvements at Pine Avenue and Roosevelt Street.
a. The following site design BMP's have been utilized to reduce impervious surfaces include:
i. Increased density with two story, mixed use design.
ii. The proposed covered parking minimizes the exposure of parking lot associated
pollutants to precipitation, and greatly reduces these pollutants washing into City
storm drains.
iii. Proposed landscaping to include trees for canopy interception, as well as
groundcover / grass for biofiltration.
b. It should be noted there is no change to pre and post development impervious surfaces.
7. See the new note regarding the 3 lot consolidation on the right side of the page.
8. See the addition of the ADT - (SanDag 2004 Figures), EDU (Dudek & Assoc. City of Carlsbad Master
Sewer Plan Update 2003), GPD (WSFU count v. demand. Appendix A Chart A-3, UPC 1-2003 ), Fire
Sprinkler (to be confirmed by fire sprinkler consultant at design phase), Cut and Fill Quantities, as
requested.
9. See the revised plan for parking dimensions.
10. See the nearest existing fire hydrant on the southeast corner of Roosevelt Street and Pine Avenue.
A separate water line and DDC valve have also been depicted along Roosevelt Street for the
anticipated additional water services.

Dear Don:
This letter is a follow-up to my previous letter to you, dated September 22, 2005, in which the
items necessary to complete your application for a Major Redevelopment Permit were
identified. In addition to the items listed in my previous letter. Engineering Department's
comments on your proposed project are as follows:
Engineering:
The Engineering Department has completed a review of the above subject. We have reviewed
the application for completeness and have determined that the application and plans submitted
for the project are incomplete and unsuitable for continued review due to the following
incomplete items:
1. Please submit a preliminary grading/drainage plan (This information may be included as
part of your site plan). Provide grading quantities, spot elevations and slope grades. I
have red lined the site plan with comments to help clarify what we need to review this
application. The siti fence can be removed at this stage.
2. Submit a Preliminary Title Report current within the last six months.
3. Show cross section of public streets and alleys. This applies to 3 sides of the project.
Include full width in the cross section and dimensions. I attached a copy of assessors
page that shows Roosevelt Street to be 80 feet wide. A 22' half street seems wrong.
Pine Ave. is also 80' wide (you show 19' half street).
4. Show names, widths and improvements for State Street, Street identified along the
north side of the project, and the (Public?) alley behind the project. Include existing and
proposed improvement (new driveways, planters, curb & gutter) information.
5. On the preliminary grading plan, provide additional spot elevations or topography at
least 25-feet outside the property line. This information should cleariy demonstrate
existing drainage patterns. The existing Apartment Complex north of this site should
show the buildings, retaining walls, walkways, parking bays and any features that could
have an impact on the proposed development.
6. This project qualifies as a "priority" project pursuant to new regulations issued by the
Regional Water Quality Control Board. Please clarify how this project minimizes
impervious area and maximizes infiltration to the maximum extend practical for storm
run-off. One suggestion may be for the water discharged from the parking lot to flow

over a grass or landscaped swale along the side of the structure to allow for some
infiltration before being discharged to City right-of-way. Please increase the length and
locations of the vegetated swale as shown on the site plan. There is a confusing symbol
(concrete) in the location of the proposed vegetated swale, please clarify.
7. The legal description for this project should include a bold note that the existing 3 lots
will be consolidated by Lot Line Adjustment.
8. Revise the site plan to list the correct ADT (traffic), EDU (sewer), and GPD/MGD (water)
GPM (Fire) and grading quantities - cut, fill, import or export, required or generated by
this project.
9. Proposed parking dimensions should be provided on all spaces.
10. Identify the location of the nearest fire hydrant. Also, if fire sprinklers are required, add a
separate water line and double detector check valve for the sprinkler system. Locate the
DDC Valve on private property but in a location accessible to the Fire Department.
A redlined check print is enclosed for the applicants use in making the requested revisions.
This check print must be returned with the plan revisions to facilitate continued staff
review.

Thank you for applying for a Land Use Permit in the City of Carisbad. The Housing and
Redevelopment Department, together with other appropriate City departments, has
reviewed your Redevelopment Permit, application No. RP 05-09, as to its completeness
for processing.
The application is incomplete, as submitted. The attached list includes information that
must be submitted to complete your application. This list of items must be submitted
directly to the Housing & Redevelopment Office. All list items must be submitted
simultaneously and a copy of this list must be included with your submittal. No
processing of your application can occur until the application is determined to be
complete. When all required materials are submitted to the Redevelopment Office, the
City has an additional thirty (30) days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application
will be initiated. In addition, please note that you have six months from the date the
application was initially filed, August 24, 2005, to either resubmit the application or
submit the required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to
constitute withdrawal of the application. If an application is withdrawn or deemed
withdrawn, a new application must be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION

Staff has completed a review of the subject project for application completeness. The
application and plans submitted for this project are incomplete at this time. The following
additional items are required to find the application complete. Please submit to the
Housing & Redevelopment Department four (4) copies of the revised plans showing the
following information: (Please note, the issues are listed under the department which
identified them as an area of concern.)
Housmg & Redevelopment:
1. The proposed project will require a noise study due to its proximity to the railroad. A
Noise Report Submittal Form has been enclosed for your convenience.
2. Please complete the Early Public Notification Package. The requirements for the
early public notice package are enclosed.
3. Please apply for a Minor Subdivision (MS) through Engineering if this is to be a
condominium project. Please indicate associated MS# in the upper right hand corner
of the plans.
4. The proposed project is eligible to participate in the Parking In-Lieu Fee Program for
a maximum of 25% of the required on-site commercial parking subject to the
approval of the Housing & Redevelopment Commission. (Residential parking is
required to be provided on-site and cleariy marked.) This means the project as
proposed is eligible to participate in the pari<ing in-lieu fee program for 1 space
(7x.25=1). With participation in the parking in-lieu fee program ($11,240 for one
space) the project appears to be missing four (4) commercial parking spaces.
Please revise the plans accordingly.
5. Staff strongly encourages the incorporation of some sort of outdoor seating area as
part of the proposed project for the tenants/customers of the commercial/office
space. Staff suggests the southwest corner be used to incorporate some type of
outdoor seating area and to take advantage of the natural light at this location.
6. As mentioned in the preliminary review, apartments are not evaluated for
conformance with the Planned Development (PD) standards. It is our understanding
that the owner wishes to convert the units to condominiums in the future. Therefore,
the project must be built to the PD standards (Carisbad Municipal Code 21.45.080)
or else the project will not be able to be converted to condominiums at a later date. I
have enclosed the PD Ordinance for your review. In particular, the PD ordinance will
require tenant storage space and private recreational space. Please revise the plans
accordingly and provide dimensions to verify.
7. The south side yard setback measures less than five feet. Please revise plans
accordingly.

8. Please indicate on the site plan that the commercial space is
"Commercial/Retail/Office". This will allow the owner to rent out the space to office,
commercial, or retail tenants.
9. Please revise/include the following items under project data on the cover sheet/site
plan:
• Please identify the Zoning as "V-R Village Redevelopment, District 5" and
General Plan to read "Village".
• Please indicate overall building height (refer to comment #11 about building
height for more).
• Please include the proposed setbacks under project data.
• Please provide the open space calculation (minimum 20% of the site). In
addition please provide the percentage of the site to be landscaped.
• Please indicate the cubic footage of tenant storage space for each unit.
10. Please revise/include the following items on the site plan:
• Please identify the contact information of the developer and owner on the
right hand side of the sheets and indicate the site address.
• Please include the project number "RP05-09" in the upper right hand corner
of the plans.
• Please identify existing buildings, permanent structures, and vegetation within
100 feet of the site.
• Indicate setback dimensions for the required front, rear, and side yard
setbacks for all structures on the site plan. Please note that no fence, wall, or

ENGINEERING CONDITIONS OF APPROVAL:
NOTE: Unless specifically stated in the condition, all of the following conditions,
upon the approval of this proposed tentative map, must be met prior to
approval of a building or grading permit whichever occurs first.

1 Prior to hauling dirt or construction materials to or from any proposed construction site within this
project, Developer shall apply for and obtain approval from, the City Engineer for the proposed

requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface pollutants when
planning any changes to the landscaping and surface improvements.
12. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer
shall submit for City approval a "Storm Water Manangement Plan (SWMP)". The SWMP
shall be in compliance with current requirements and provisions established by the San
Diego Region of the California Regional Water Quality Control Board and City of Carlsbad
Requirements. The SWMP shall address measures to reduce, to the maximum extent
practicable, storm water pollutant runoff at both construction and post-construction stages
ofthe project. The SWMP shall:
a) Identify existing and post-development on-site pollutants.
b) Recommend source control and structural Best Management Practices to fliter said
pollutants.
c) Establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to employee education on the proper
procedures for handling clean up and disposal of pollutants.
d) Ensure long-term maintenance of all post construct BMPs in perpetuity.

BRIEF DESCRIPTION: A 4-unit apartment project over 1500 sq. ft. of Commercial/Retail/Office
(fronting on Roosevelt Street) and also over 3,972 sq. ft. of parking and
320 sq. ft. of storage space. Access to parking and storage is from
Alley located on Pine Ave.

ENGINEERING CONDITIONS OF APPROVAL:
NOTE: Unless specifically stated in the condition, all of the following conditions,
upon the approval of this proposed tentative map, must be met prior to
approval of a building or grading permit whichever occurs first.
General
1 Prior to hauling dirt or construction materials to or from any proposed construction site within this
project, Developer shall apply for and obtain approval from, the City Engineer for the proposed
haul route.
2 A right of way permit will be required for sidewalk reconstruction / repair and utility
services and under grounding or removal of utility poles.
3 Prior to issuance of any building permit, Developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formally established
by the City.
4 Prior to the issuance of a building permit, Developer shall submit to the City Engineer proof that
the existing lots within this project have been consolidated or merged in accordance with the
Carlsbad Municipal Code.
Fees/A ereements
5 Developer shall cause property owner to execute and submit to the City Engineer for recordation
the City's standard form Drainage Hold Harmless Agreement regarding drainage across the
adjacent property.
6 Prior to approval of any grading or building permits for this project, Developer shall cause Owner
to give written consent to the City Engineer to the annexation of the area shown within the
boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1, on a form provided by the City Engineer.
Gradins
1 No grading for private improvements shall occur outside the limits of this approval unless
Developer obtains, records and submits a recorded copy to the City Engineer a grading or slope
easement or agreement from the owners of the affected properties
8 Based upon a review of the proposed grading and the grading quantities shown on the Site Plan
and preliminary grading plan, a grading permit for this project is not required.
9 Developer shall submit to the City Engineer, a reproducible 24" x 36", photo mylar of the site plan
and preliminary grading plan reflecting the conditions as approved by the final decision making
body (including any applicable Coastal Commission approvals). The reproducible shall be
submitted to the City Engineer, reviewed and, if acceptable, signed by the City's project engineer
and project planner prior to submittal of the building plans, final map, improvement or grading
plans, whichever occurs first.
10 Additional drainage easements may be required. Developer shall dedicate and provide or install

drainage structures, as may be required by the City Engineer, prior to or concurrent with any
grading or building permit.
11. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit, latest version. Developer shall provide improvements
constructed pursuant to best management practices as referenced in the "Califomia Storm Water
Best Management Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas or City right-of-way. Plans for such improvements shall be
submitted to and subject to the approval of the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with established
disposal programs to remove and properly dispose of toxic and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil, antifreeze,
solvents, paints, paint thinners, wood preservatives, and other such fluids shall not be
discharged into any street, public or private, or into storm drain or storm water conveyance
systems. Use and disposal of pesticides, fungicides, herbicides, insecticides, fertilizers
and other such chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface pollutants when
planning any changes to the landscaping and surface improvements.
12. Prior to the issuance of grading permit or building permit, whichever occurs first, Developer
shall submit for City approval a "Storm Water Manangement Plan (SWMP)". The SWMP
shall be in compliance with current requirements and provisions established by the San
Diego Region of the California Regional Water Quality Control Board and City of Carlsbad
Requirements. The SWMP shall address measures to reduce, to the maximum extent
practicable, storm water pollutant runoff at both construction and post-construction stages
ofthe project. The SWMP shall:
a) Identify existing and post-development on-site pollutants.
b) Recommend source control and structural Best Management Practices to filter said
pollutants.
c) Establish specific procedures for handling spills and routine clean up. Special
considerations and effort shall be applied to employee education on the proper
procedures for handling clean up and disposal of pollutants.
d) Ensure long-term maintenance of all post construct BMPs in perpetuity.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to the
following:
13. Developer shall exercise special care during the construction phase of this project to prevent
offsite siltation. Planting and erosion control shall be provided in accordance with Carlsbad
Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction of the City Engineer.

Please advise the applicant to make the following corrections to the plans so that they will meet
the requirements of the City of Carlsbad's Landscape Manual.
1. Provide the name, contact information and license number for the Landscape Architect
who prepared the drawings.
2. Provide a water conservation plan per the Manual requirements.
3. Provide the following:
Total area of landscape
Total area of turf Note the maximum allowable amount of turf is 10% cool
season and 15% warm season. Specify the type of turf to be used.
Provide sizes for all plants.
Show and label the edge of the ROW, property lines and easements.
Show any bio-swales/detention basins or imderground drainage collection systems
(under planting areas that could impact the planting).
Show sight lines per the Manual
Label all walls, indicate heights and materials.
Label all hardscape - Ex: Tile, brick, stamped concrete
4. Provide new planting in the parkway area on Roosevelt Street between the sidewalk and
the curb. Include the two required street trees (1 per 40' of street frontage), shmbs and
groundcover.
5. Three street trees are required on Pine Avenue (1 per 40' of street frontage). The
Trachycarpus palms are not suitable as street trees.
6. Provide parking lot trees at a rate of 1 tree per 4 spaces. Locate the trees adjacent to the
parking, not on the opposite side of any walls over 3' tall.
7. Use a shmb and groimdcover planting in the side 4' strip. The Landscape Manual
prohibits the use of turf in areas less than 6' wide.
8. Label the trash enclosure and provide self supporting vines on the trash enclosure.
9. Explain what is plaimed in the rectangular space adjacent to the building at the end of the
north row of parking.
10. Explain what is planned in the rectangular space to the south of the driveway closest to
the comer.
11. Correct misspellings and incorrect name on plants:
• Camilla saganeum - should be Camellia sasanqua
• Cape Malva - should be Cape Mallow
• Betula vermcosa - should be Betula alba
12. Provide building elevations, walls heights and materials, as well as a preliminary grading
plan with the next submittal.
13. Provide 2 copies of the landscape concept plan on the next submittal.
