As part of the exemption process, the lead agency (City of Carlsbad) is required to file a Nofice of Exemption with the San Diego County Clerk. As of January 1, 2007, the County Clerk is now charging a documentary handling fee of $50. According to our records, we have not collected the $50 for the County Clerk documentary filing fee. Until the fee is collected and the Notice of Exemption can be filed, any local permits issued for the project are invalid. As of the date on this letter, not all conditions have been met, and the parking lot layout does not comply with the approved plan. Please review the following list and address the items accordingly. • Condition number 10 has not been met which requires boxed trees to be placed in the pubic right of way to prevent parking in that area and to screen the parking lot. • 88 parking spaces are provided on site, while 85 spaces are shown on the plan. • There are 2 parking spaces in the middle aisle that are not shown on the plan. The addition of these 2 spaces prevents the 42 foot tuming radius which is required per Cal Trans Figure 407E. • Spaces 46-51 are marked as compact spaces. There should only be 5 standard parking spaces located here, not 6 compact spaces. • There are 47 pay-to-park spaces on site. The approved plan allows for 16 pay-to-park spaces. • Permits for the entrance sign and directory sign have not been obtained. If immediate action is not taken on the above issues, the Housing and Redevelopment Department will proceed with revocation of the permit. See the attached Assessor Parcel Map for reference -1 am thinking it may be easiest and not jeopardize the future of the value of the property to make one lot out of APNs 203-232-03,04, and 13 and get the easement for your parcel, 203-232-05. Is there a difference between the two choices and what are is the diference. We have to keep in mind that the highest and best use for the properties in the future. One thing that I have been toying with is the ability of maybe converting the house from a Residence to a Commercial Use (ie a small cafe), but that would take a substantial investment. The other altemative is to rent the house as a single family unit even though it is nonconforming So does the lot line adjustment as opposed to a deed restriction have any future implication in regards to the use of the home? Four sets of a 24" x 36" site plan to scale with the following infonnation included: • Property lines of subject property • Parking space dimensions • Storage Room (formerly called "Guard House") in its correct location • Floor plan of entire center reflecting existing square footage for each individual business and identifying the required parking spaces and total provided based upon the square footage of the existing businesses. Building 1. Parking spaces all comply with the Califomia State access requirements. 2. The "Guard House" is to be used only for storage of parking management/safety supplies, such as plastic delineators and orange cones. Califomia State access requirements do not apply. Fire 1. Tmck tuming movements as per Caltrans Design Template 407-E are shown on the site plan. 2. Driveway entries are a minimum of 12 feet. November 16. 2006 Issues of Concem Housing and Redevelopment 1. Parking spaces 1 - 10 on the original plan were not solely on the subject property and have been removed fi-om the revised plan. 2. We are concemed with the suggestion that a landscaped median be provided to screen the parking as viewed from Garfield Street. There is no existing irrigation system to maintain landscaping. Further, because ofthe pedestrian activity in the area and the lack of sidewalks, we are concemed with the visibility of pedestrians that may be compromised with landscaping that could impair the ability of drivers to observe pedestrians and pedestrian's observation of drivers. Also, landscaping significant enough to screen the parking lot would provide protection for nefarious individuals and be a potential hazard to public and property safety. 3. The existing trash enclosure is well maintained and in good condition; however, we are amendable to installing a gate to further screen the trash bins, subject to the approval of the trash hauler. 4. The existing lighting has been identified on the plans and no additional lighting is proposed. November 28. 2006 Engineering Incomplete Items 1. Three copies of the Preliminary Title Report dated Febmary 15,2007 2. Topography lines have been included to show existing drainage pattems 3. Right-of-way lines have been clearly identified 4. The access to the parking lot will be left open at all times. Parking will be managed by a private parking management company (Pacific Coast Valet, who currently has a valid City Business License) using an "Iron Maiden" type of metering system for only those spaces not identified as tenant parking. 5. We are unclear as to the necessity for the exhibit showing all existing improvements and parking on Garfield Street fi-om Grand to Carlsbad Village Drive. Since we have removed the spaces that encroached onto Garfield and have provided the required number of parking spaces on site for tenant parking, we believe this request is no longer pertinent to the application. 6. The tables in Appendix A ofthe SUSMP have been filled out as requested. A complete Public Notification Packet prepared pursuant to the City's requirements is also included with this resubmittal. Please provide a 24" x 36" site plan to scale with the following infonnation being included: • Property lines of subject property • Parking space dimensions • Show the guard house in its correct location unless it is to be moved which should be indicated. • Provide a fioor plan of the entire center reflecting the existing square footage for each individual business. Further identify the required parking spaces and the total provided based upon the square footage of the exisfing businesses. Engineering: Engineering Department's comments are forthcoming and will be sent under a separate cover. Building: 1. Parking spaces shall comply with the California State access requirements. 2. The guard house shall comply with the California State access requirements as well. On the site plan, show truck turning movements as per Cal Trans Design Template 407-E. 2. Driveway entries need to be a minimum of 12 feet. I'm ready to condition the project for approval as soon as we reach agreement with the applicant as to how we handle the public street parking from the residence to the parking lot driveway. We will not require the construction of concrete curb, gutter and sidewalk. Nevertheless, in order to make that side of the street pedestrian friendly and to accommodate public street parallel parking, maybe an asphalt berm and sidewalk should be constructed from the driveway at the end of the existing sidewalk in the south side to the parking lot driveway. The operator. Pacific Coast Valet, offered to place boxed trees in this area. There's an expired sign permit to construct a sign in front of the existing storage room between the parking lot driveways. The applicant needs to verify that, if the sign is going to be installed (via a new permit), the sign needs to be completely within the property boundary without encroaching into the street right-of-way.
