B • Carlsbad, CA 92008-2389 • (619) 434-2810/2811 • FAX (619) 720-2037 ^ Attachment A to Appeal of February 19, 2008 Denial of Redevelopment Permit 08-04 The subject business seeking the right to continue to operate with a current Redevelopment Permit is a bar with entertainment called "The Alley," located at 421 Grand Avenue, Carlsbad. In 1993 the Design Review Board ofthe Housing & Redevelopment Department ofthis City recommended and approved a bar/cocktail lounge at this site with live entertainment and dancing, under a series of resolutions dealing with issues of parking, proximity to other alcohol servers, and hours of operation. The original permits provided that the Director would review the business".. .on a yearly basis to determine if all conditions ofthis permit have been met and that the use does not have a significant detrimental impact on surrounding properties or the public health and welfare." Although the original permit was for 5 years, with a right to extend for an unlimited number of times, the Applicant was not aware of that time limit. Importantly, however, it may be presumed that the Director found no fault or conflict with the business in this neighborhood location because, despite the described annual reviews, its use was never censured by the City. Between October 1995 and the present the current owner has operated the bar with various forms of live entertainment. To meet her obligation to provide public safety the operator has implemented stringent security supervision, and has attempted to operate her business in a manner appropriate to the Carlsbad Village restaurant and entertainment hub. Within the past few years the City has changed the dynamic of the downtown Carlsbad area by approving a variety of residential guest accommodations and residential (condominium) dwellings in close proximity to the busy and active downtown area. This has resulted in a predictable conflict, with new residents moving into a previously commercial/entertainment area expecting the quietude of typical residential neighborhoods. A handful of these residents have been quite vocal in attempting to curtail the long-existing activities of several downtown Carlsbad entertainment venues. The Applicant is a victim ofthat conflict created by this recent, forced mixed use. In challenging the Applicant's desire for the approval ofthe requested use Carlsbad Police Captain Mike Shipley has expressed concerns (1) that the business operated in an unpermitted manner by having karaoke, a disk jockey, and a live band; and (2) that the business generated sound ratings of 75dB, in excess ofthe limit authorized by the City's recent regulations. Those concerns are addressed as follows: (1) Piano Bar versus Live Entertainment - Much has been made of the fact that the 1993 authorizations described the entertainment type to a "piano bar." The current Page 1 of 3 operator was unaware ofthat specific limitation, and the Director apparently found no fault with this type of operation in its 12% years of continuous activity. Importantly, however, it does not necessarily follow that the Applicant's use violated the piano bar limitation. "Wikipedia" is a dictionary source gaining wide popular acceptance as the contemporary understanding of meanings of words and phrases. Attached as Exhibit "A-1" to this document is Wikipedia's definition of a "Piano bar," which includes all sorts of live entertainment, including, but not limited to, karaoke, hip-hop music, multiple pianos, solo or group singing, and combinations with other musicians. In fact, the only thing which seems to be the common denominator of a "Piano bar" is the presence of a piano in the venue. As such, the real issue forthis Applicant would seem to be providing entertainment with a noise and activity volume which is reasonably acceptable to the City, regardless of what instrument that entertainment is produced by. (2) Noise Levels - Prior to submitting her application to apparently legitimatize the long-standing use at the site the Applicant was not informed that she would have to address sound limitation. She has not been previously cited for such a violation, and Captain Shipley's critique, and mention of 75dB, did not come into existence until after her Application was filed. It would seem only fair that the Applicant be given a reasonable opportunity to address these concerns. In doing so the Redevelopment Agency should keep in mind what 75dB really means. Common charts show that a business office has a dB rating of 70, driving in a car with the windows closed at 30mph generates up to 73dB, a dishwasher produces 70dB, and a toilet is 75 to 85dB. A discotheque is 120 dB. Given the location of The Alley business at the intersection of active train tracks and within a few feet of the intersection of Grand Avenue and State Street, adjacent to a large parking lot and a half block away from a restaurant with frequent outside entertainment, it is difficult to imagine that even the ambient noise outside the business would not be as much as 75dB, before The Alley adds anything to it. The Appellant requests that she be given a reasonable opportunity to demonstrate that she is able to comply with the City's sound limiting ordinance, and that the noise qenerated bv her business does not cause undue problems in the neighborhood. Indeed, Captain Shipley has stated his concerns come down to only two issues.^ Captain Shipley indicates that he does not object to the business operating as long as it is truly able to show that it can meet its noise standards. His second issue, although he is not aware of any current concerns in this area, is that they continue to address any behavior problems occurring within the bar. Based upon a telephone conversation with Captain Shipley and Appellant's attorney, Kevin McCann, on Wednesday, February 26, 2008. Page 2 of 3 Similarly, Carlsbad Deputy Fire Marshal Greg Ryan indicates that he does not have objection to the operation of the business, except to be sure that they make all other appropriate permit applications, and that as far as he knows the business poses no fire or safety threat.^ For all the above reasons it would seem only fairthat the Housing & Redevelopment Commission give the Applicant a reasonable opportunity to demonstrate the ability to comply with reasonable sound limitations. In this regard, it is expected to cost between $10,000 and $20,000 forthe engineering and sound-proofing associated with meeting new noise level control limits. As such, the Appellant asks that this Commission approve her use, but condition that use upon showing to the City's reasonable satisfaction compliance within a reasonable period of time, and with such compliance to be demonstrated by an appropriate and qualified sound engineer engaged by the Applicant. It is not fair to ask the Applicant to make such a costly investment without some assurance that it will not be wasted. For this Reviewing Board to do anything less than this would be to eliminate this long-standing business, which relies upon entertainment as a basis of its operation, and ex post facto to favor newcomers to The Village who seek to change its character to meet their personal preferences. Appellant respectfully submits that both can coexist, but that this Commission should make reasonable accommodation to her business to adapt with the times. Page 3 of 3 Piano bar • From Wikipedia, the free encyclopedia A piano bar (also known as a piano lounge) consists of a piano or electronic keyboard played by a professional musician, located in a cocktail lounge, bar, hotel lobby, or office building lobby. Usually the pianist receives tips in a jar or basket on or near the piano, especially from patrons requesting a song. Some piano bars feature a baby grand or grand piano surrounded by stools for patrons (or, somewhat humorously, an upright piano covered by a counter that makes it appear to be a grand piano). Others have a bar surrounding the piano or keyboard. There are several different types of piano bars: • "instrumental only": the professional piano/keyboard player plays strictly instrumental music, which is usually classical, semi-classical, or "easy listening"; this type of piano bar is often found in hotel lobby lounges or "fine dining" restaurants. • "only the musician sings": the professional piano/keyboard player sings to his/her accompaniment, usually on microphone, but no other singers are generally allowed. • "the musician and waitpersons sing": the professional musician sings and also invites waitpersons to sing solos. • "sing-along": patrons surrounding the piano/keyboard sing as a group, usually without any microphones, often preferring "standards" and "show tunes", or very old songs like "Down By The Old Mill Stream", "Bicycle Built For Two", etc., but in some cases pop or rock. • "dueling pianos": usually on stage with two grand pianos, each played by a professional player who sings and entertains; humor and audience participation are prevalent; usually these types of piano bars have substantial sound systems, and most of the songs performed are rock and roll, "classic rock". FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 3 The following findinqs have been made in order to approve the Administrative Redevelopment Permit to allow a change in land use from a "Bar" only to a "Bar with Entertainment": 1. The Housing and Redevelopment Director has determined that the project is consistent with all applicable development standards set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan for the subject property. 2. The Housing and Redevelopment Director has determined that the existing bar is an allowed use and was previously approved by the Design Review Board and Housing and Redevelopment Commission as a permitted (non-accessory) use and may continue as said use. Therefore, the Director has determined that the existing use Is consistent with the land use policies set forth within the Village Master Plan and Design Manual and Village Redevelopment Plan. 3. The Housing and Redevelopment Director finds that the new use of Bar with Entertainment is a permitted use due to the prior approvals, and that the site of the use is suitable for a nightclub use and will have minimal impact upon the Village traffic, parking, residents and other adjacent uses due to the fact that the primary use of the establishment will occur in the evening when many of the adjacent busine»|s are closed and the noise attenua^i conditions for said project will result in minimal impact Mrresidents and other adjacent use. 4. The Housing and Redevelopment Director has considered the total number of other bars with entertainment and/or nightclubs in the Village and determined that there is not currently an over concentration of night clubs which would be detrimental to the Viiiage. At the time of approval of this permit, there was only one other bar with entertainment and/or nightclub located within the Village Area. There are several restaurants which allow for live entertainment as well in the area. However, these establishments do not meet the definition of a bar with entertainment and/or a night club. 5. The Housing and Redevelopment Director has determined that the potential for creating noise problems for nearby residential areas will be mitigated through the conditions set forth below for noise attenuation. 6. The Housing and Redevelopment Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan for the Village Area. 7. The Housing & Redevelopment Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines and will not have an adverse significant impact on the environment. The following conditions have been approved for the subject project: 1. The establishment shall be required to obtain and maintain an Entertainment License, issued by the Chief of Police, at all times, if the establishment is unable to obtain and/or maintain an Entertainment License at any time, this land use permit shall become null and void. 2. The establishment shali conform to the provisions of Chapter 8.09 (Entertainment License) of the Carlsbad Municipal Code at all times of operation. 3. The establishment shall be required to install and/or construct all necessary noise attenuation improvements to said facility in order to comply with the noise restrictions set forth in Chapter 8.09 (Entertainment License) of the Carlsbad Municipal Code at all times required by said ordinance. 4. The sale of alcoholic beverages for consumption off the licensed premises is prohibited. 5. This permit shall be subject to revocation by the Housing and Redevelopment Director if the applicant fails to conform to any of the above conditions of approval. 6. There shall be no live entertainment or dancing permitted in the outdoor patio of the licensed premises at any time. 7. Tables and chairs shall not be removed to create additional areas for dancing.
