The Police Department concerns identified in my March 7, 2008 memorandum have not changed. Noise - The documents provided indicate steps have been taken to address the excessive noise issue coming from The Alley. The Police Department does not have the expertise to determine ifthe noise remediation measures are sufficient to warrant issuing a redevelopment permit. The critical issue remains and must be made perfectly clear to The Alley owner / manager regardless of the effort, money and materials invested in attempting to correct the noise volume level if it remains in excess of the statute limit the establishment will be in violation of Chapter 8.09. Enforcement of noise violations could result in the suspension / loss of The Alley's Entertainment License even if the redevelopment permits allows for entertainment. Patron Management - Police personnel assigned to this detail have confirmed staffing changes have been implemented and resulted in a significant reduction in police concerns for how patron issues are being handled. I have had a number of conversations with Ms. Borst and Mr. McCann (attorney) regarding management of patrons. They have advised me The Alley will be contracting with a professional guard company when a new redevelopment permit is issued. I believe The Alley owners / managers understand patron management is a critical issue not only for maintaining viable business but also represents a significant civil liability if they fail to maintain a competent staff. Based on The Alley's actions thus far, and stated commitment to hire a professional guard company, the Police Department's objection for failure to provide appropriate "Patron Management" is removed.
