Engineering Department staff has completed a review of the application submittal
documents for application completeness. The application and plans submitted for this
project are incomplete. Prior to next submittal, it is suggested the following items are
adequately addressed.

1. The project site plan should show existing public improvements to State Street
and alley to the west. Right of way should also be shown.
2. Provide an accurate seating diagram for existing and proposed eating areas,
including Sidewalk seating and patio seating.
3. Please show existing and proposed (if changes are anticipated) locations of
trash enclosures.
Engineering Concerns
General
Engineering has no concerns or issues with the proposed expansion of existing
buildings.

Initial review: (Note: This commentary identifies fire protection issues associated with
the project, and/or prescribes specific corrections or information needed to achieve Fire
Department approval.)
Fire department has reviewed this application and would comment that the
proposed use of the storage area for additional seating shall increase the occupant
load and shall require that the following corrections be made:
1. the Main entrance shall have the swing reversed. The Building Code requires all
Assembly Occupancies that are 50 or more occupants (56 occupants less wait staff)
be provided with a Main exit door that swing in the direction of exit travel.
2. the movable partition shall be provided with at least a 32 inch wide door way
when this room is used for dining/meeting purposes or shall remain completely
open.6

I recently noticed that the restaurant has expanded over into the suite that is next
door to you. I remember discussing a possible expansion with you several
months ago where I explained that you would need to meet the parking
requirements and an Administrative Redevelopment Permit would be required.
Please contact our office so we may begin the permit process. If we do not hear
back from you within 10 days of the date of this correspondence, this issue will
be turned over to code enforcement.

Dear Mrs. Reyer:
Thank you for applying for a Redevelopment Permit in the City of Carlsbad. The
Housing and Redevelopment Department together with other appropriate City
departments, has reviewed your Administrative Redevelopment Permit as to its
completeness for processing.
The application is incomplete, as submitted. The attached list includes
information that must be submitted to complete your application. This list of
items must be submitted directly to the Housing & Redevelopment Office.
All list Items must be submitted simultaneously and a copy of this list must
be included with your submittal. No processing of your application can occur
until the application is determined to be complete. When all required materials
are submitted to the Redevelopment Office, the City has an additional thirty (30)
days to make a determination of completeness. If the application is determined
to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was
initially filed, August 18, 2008, to either resubmit the application or submit the
required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to
constitute withdrawal of the application. If an application is withdrawn or deemed
withdrawn, a new application must be submitted.

Please resubmit 4 sets of plans addressing the following incomplete items:
Housing and Redevelopment:
1. Please submit the Administrative Redevelopment Permit Public
Notification Package along with the necessary postage fee (postal rate
X numberof labels).
2. Revise plans so they are to scale with the scale noted on the plans.
3. Please add the following information requested on the returned red-
lined plans to the site/floor plan.
a. Show the floor plan for the existing restaurant, including kitchen,
bathrooms, and entrances and exits.
b. Please note if the pass-thru from the existing restaurant to the
proposed expansion is existing or proposed.
c. Show that the restaurant space will be separated from the
storage space by a permanent wall and door in the proposed
expansion.
d. Show the dimensions of the outdoor patio at the rear of the
existing restaurant.
e. Show existing parking behind the current and proposed
restaurant space, demonstrating that the parking stalls meet
regulation size.
f Show all property lines.
g. Label parking for the adjacent businesses.
4. Please include the red-lined plan with resubmittal to facilitate review.

Housing and Redevelopment:
1. Based on the proposed restaurant expansion of 292.5 square feet, three
regulation size (8.5 ft x 20 ft) parking spaces are required. The site plan
submitted can only accommodate one regulation size parking space at the
rear of the proposed expansion. Redevelopment Staff cannot support the
approval of this project at this time because of the insufficient parking
available for the proposed use.
Building:
1. Tenant improvements shown on the site plan will require compliance with
Accessibility Standards, including disabled accessible restrooms.
2. Please submit detailed construction plans for a tenant improvement permit.
3. One disabled parking space and an accessible path of travel to the entry is
required. For the disabled parking space, provide an unloading zone of 5 feet
adjacent to one regulation (8.5 ft x 20 ft) parking space for handicapped
access. The parking space does not need to be marked as a handicapped
space.
Regarding any comments from the Building Department, please contact Will Foss,
Building and Code Enforcement Manager, at 760-602-2716.
Engineering:

Per our telephone conversation, due to economic concerns we have decided to withdraw our
application for the 100 sq ft addition to the restaurant. The space wUl remain retail.
We are requesting a refund for the application fee.
