Reason FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 3 The following findings have been made in order to approve the Administrative Review Permit Amendment for property located at 2780 Carlsbad Boulevard: 1. The Housing and Neighborhood Services Director has determined that the project is consistent with the policies, goals and action programs set forth within the Carlsbad General Plan. 2. The Housing and Neighborhood Services Director has determined that the project is consistent with all applicable development standards and land use policies set forth within the Village Master Plan and Design Manual. 3. The Housing and Neighborhood Services Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303(e) of the State CEQA Guidelines as accessory (appurtenant) structures'including garages, carports, patios, swimming pools, and fences do not have a significant effect on the environment. Page 2 of 3 The following conditions have been approved for the subject project: 4. This approved permit serves as the required land use and Coastal Development Permit for the subject project, approving an outdoor dining patio at an existing restaurant. 5. The project shall be completed according to, and consistent with, the plans approved by the Housing and Neighborhood Services Director on the date noted above. The approved plans have been stamped by the Housing and Neighborhood Services Director and indicate the approval date of 06/05/2012. 6. The number of seats within the outdoor patio may not exceed the number of seats (30) inside the restaurant any time. An increase in seating to the outdoor patio will require an amendment to this permit and additional parking. 7. The Sidewalk Tables and Chairs (RP 12-16) for seating within the public right-of-way shall be suspended for the duration of time that the outdoor seating area on private property is in use. 8. Developer shall obtain appropriate and applicable building permits to allow for use of the outdoor dining patio and demonstrate compliance with ADA accessibility requirements. 9. Developer shall remove the existing driveway to Carlsbad Blvd. by reconstructing curb, gutter and sidewalk to match the existing surface. These improvements shall be shown as a Construction Revision to an existing record public improvement drawing (DWG 130-6), subject to city engineer approval. Developer shall apply for and obtain a right-of-way permit prior to performing work in the city right-of-way. 10. Developer shall pay traffic impact fees based on Section 18.42 ofthe City of Carlsbad Municipal Code, respectively. The Average Daily Trips (ADT) and floor area shown on the site plan are for planning purposes only. These fees shall be paid prior to use of the outdoor seating area. 11. The operational hours of the approved restaurant shall not extend beyond 10:00 PM. The hours may not be extended without an amendment to this permit. 12. The parking lot shall be striped per the approved project plans. 13. Per the State Department of Alcohol Beverage Control, the sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 9:00 AM and 11:00 PM each day of the week. These hours, however, are modified by condition #9, noted above, which limits the operational hours of said business. 14. There shall be no live entertainment or dancing permitted on the premises. 15. There shall be no pool or billiard tables, amusement machines or video game devices in the premises at any time. 16. No sounds, including but not limited to loud speakers, sound systems, or other types of music or noise from the operation of the business shall be audible beyond the boundaries of the premises. 17. The applicant shall comply with all other conditions ofthe ABC license for this establishment. 18. The applicant shall implement an appropriate parking management plan, which may include valet parking and requirements for employees to park in public parking lots, for said business to reduce parking impacts on neighboring properties. 19.
