SUBJECT: Revision to Army and Navy Academy Fencing Plan (RP 09-34)
The Housing and Neighborhood Services Director has completed a review of your application
for revisions to the Army and Navy Academy fencing plan, (APN: 203-041-02) which is a
modification to RP 09-34 - Army and Navy Academy Site Fence. The proposed modifications
include:
• Removing the stone veneer from the pilasters and replacing it with stucco and
adding base detail on the Carlsbad Boulevard frontage.
• Removing the stone veneer from the top of the southern monument sign and
supporting pilasters, and then replacing it with stucco and cap details. The
monument will be enhanced with the addition of a decorative ogee shaped curve
to the top of the wall.
• Removing the stone veneer from the top of the northern monument sign and
supporting pilasters, and then replacing it with stucco and cap detail. The new
signage will include the Army and Navy Academy logo.
In order for a Redevelopment Permit Consistency Determination to be approved, all of the
following findings must be made:
1) The modified project design is comparable In character, scale, architectural detail and/or
other design features to the original project design, or represents an upgrade in overall
design features and/or materials as originally approved. The modification must not be
readily discernible to the decision makers as being substantially different from the project
as originally approved. The original architectural detail or the design features may be
enhances as long as the character, scale, or theme of the design remains consistent
with the original approval.
2) No project condition, feature, facility or amenity is changed or deleted that had been
considered essential to the project's design, quality, safety or function by the Housing
and Neighborhood Services Director, Planning Commission and/or City Council.
3) The modified project complies with all applicable development standards, or does not
exceed the variances in standards as originally approved by the final decision maker
4) The modified project does not increase the density or intensity of the development A
decrease in the density or intensity of development can be considered an acceptable
change for consistency determination purposes, at the discretion of the Housing and
Neighborhood Services Director
5) The proposed modification does not involve the addition of a new land use not shown on
the original permit
6) The proposed change will not result in any significant environmental impact, and/or
require any additional mitigation.

1) The proposed change would not result in any health, safety or welfare impacts.
8) There were not any major issues or controversies associated with the original project
which would be exacerbated with the proposed project modification.
After careful consideration of the circumstances surrounding this request, the Housing and
Neighborhood Services Director has determined that the application qualifies for a consistency
determination with the approved permit and therefore, approves the changes to the project
based on the requirements set forth within the Village Master Plan and Design Manual.

FENCE REVISION AND CONSISTENCY DETERMINATION
The Army Navy Academy (ANA) needs to adjust the approved fence plan (RP 09-34/CDP
09-18) as a result of budget challenges and an opportunity to revise the fence details in
compliance with the Consistency Determination (CD) policy for the Village area. The
intent of the CD policy Is to maintain the quality and integrity of the original approval
while allowing for project modification. In this case, the modification will allow the ANA
to proceed with this perimeter enhancement project, consistent with the property's
master plan, given current budgetary challenges that can be addressed with the
proposed changes.
The changes proposed are reflected in two sets of submitted exhibits: Eight exhibits
depicting the changes are provided, dated November 18, 2010 (A1-A4); and six
comparative renderings showing before and after images for three locations are also
provided, dated November 18, 2010.
Summary of Changes:
Three main areas are involved with this request: the northern monument signage, the
Carlsbad Blvd frontage, and the southern monument signage.
Beginning with the Carlsbad Blvd frontage, the stone veneer from the pilasters is
proposed to be stucco pilasters with added base detail. The Senior Well area just north
of the entrance gate to ANA will retain the currently approved low stone wall and two
stone pilasters in front of the Senior Well area.
The northern monument signage will have the stone endcaps replaced with stucco
pilaster and cap details. The new signage will have the ANA logo.
The southern monument will be enhanced via addition of a decorative ogee shaped
curve to the top of the wall. Six-foot height limit to the sign will be maintained by
mounding the grade at the base of the sign so that the street-exposed sign height does
not exceed six feet. The stone veneer pilasters will be replaced with stucco pilaster with
cap detail.

In combination, the changes create a hierarchy at the main entrance and the corner
monuments by enlarging the adjacent pilasters, and adding additional detail; decorative
finials are added to the top of the fence line (shown on plans, not on rendering due to
scale); and, the stone low wall will remain to the south of main entrance as approved.
In summary, ANA feels the new balance of stone veneer pilasters and low wall combined
with stucco pilasters, signage detailing, finials, and stucco cap detail is best combination
of current Spanish Colonial style with new perimeter security and visual feature.
The proposed changes satisfy the CD criteria for the Village area as outlined below:
Consistency Determination criteria:
1. No project condition, feature, facility or amenity is changed or deleted that had
been considered essential to the project's design, quality, safety or function. 777e
proposed revision retains the project elements that provided a quality-design
(stone veneer pilaster and low wall where proposed) while re-introducing
detailed stucco pilasters and treatment reflecting the Spanish Colonial
architecture that has been onsite since original construction. The proposed fence
revision maintains the public safety element with regards to a perimeter fencing
feature, while modifying yet retaining the high quality appearance and
articulation associated with the original approval.
2. The request represents an upgrade in overall design features and/or materials
and improves upon the project's compatibility with the surrounding
neighborhood. The proposed request is an upgrade by providing a perimeter
fence design that augments the onsite Spanish Colonial style of campus
buildings. The currently approved fence design competes with the onsite Spanish
Colonial feel by introducing stone veneer and materials to the degree reflected in
the original approval. The introduction of stucco with the corresponding detailing
proposed, in combination with the stone elements that are retained in this
proposal, provide a balance of aesthetics and safety that can actually be funded
by ANA while respecting the original approval in the context of consistency. In
addition, the southern monument sign is proposed for revision by the
introduction of stepped articulation to the top curve of the sign and addition of
ANA logo; the approved sign lacks this level of detail.
3. The proposed revision does not change the density or boundary of the subject
property. No change to project density or boundary locations due to the revised
fence proposal.
4. The proposed revision does not involve the addition of a new land use not shown
on the original permit. The revised fence does not represent a new land use
compared to the original approval.
5. The proposed revision does not rearrange the major land uses within the
development. Onsite land uses are not re-arranged via this proposed fence
revision request
6. The proposed revision does not create changes of greater than ten percent
provided that compliance will be maintained with the applicable development
standards of the Carlsbad Municipal Code. No quantifiable changes are proposed
relative to the original approval that would invoke the 10% element of the
consistency determination cnteria.
1. The proposed change will not result in any significant environmental impact
and/or require additional mitigation. 777e revised fence will not Impact the
environmental review associated with original approval nor will it impact the
environmental conditions onsite in negative manner.
8. The proposed change would not result in any health, safety or welfare impacts.
The proposed change will increase the benefit of public health, safety and
welfare because right now, perimeter fencing is lacking. The increase to public
and ANA student safety, plus the increase in architectural quality and
presentation to the community provided by the original approval will be likewise
improved by this consistency determination request
9. There were not any major issues or controversies associated with the original
project which would be exacerbated with the proposed change. The proposed
changes will still result in community amenity via perimeter fencing of ANA,
consistent with original approval and governing master plan.
10. The proposed change would not be readily discernable to the decision makers as
being substantially different from the project as originally approved. The changes
could be noted by a decisionmaker but the changes are within the realm of
substantial conformance given the improved fence design and detailing. The
retention of approved features around the Senior Well help to create a hierarchy
of fence elements that now relate better to the onsite Spanish Colonial buildings
while remaining consistent with the ANA master plan.

On March 23, 2010, the Housing and Redevelopment Director conditionally approved
Administrative Redevelopment Permit No. RP 09-34 for property located at 2605
Carlsbad Boulevard. The decision of the Housing and Redevelopment Director Is
subject to a ten (10) day appeal period. The appeal period has elapsed and no appeals
were filed.
Attached Is a copy of the approved pemilt with conditions authorizing construction of
fencing around the perimeter of the main portion of the campus as show on the
approved plans. Please review all conditions carefully. Violation of the conditions could
result In revocation of this pemilt.

ISSUES OF CONCERN

Staff has completed a review of the subject project for Issues of concem. The following
Items need to be resolved or adequately addressed prior to staff making a final
detemiination on the proposed project: (Please note, the Issues are listed under the
department which Identified them as an area of concem.)
Housing & Redevelopment:
1. Decorative wall features may extend no more than six (6) Inches above the
maximum height of the wall (six feet). Please reduce the height of the pilaster to 6'
6".
2. All new signage will require approval of a sign pemilt as part of a separate
application.
Engineering:
1. The previous review dated September 30, 2009 requested that existing and
proposed right of way be shown on each site plan and each detail for the proposed
fence. It is apparent that the proposed right of way for Cypress Ave., Pacific Street
and Mountain View Drive still remains an Issue and will not be resolved as part of
this application. With this said, the proposed fence locations are proposed entirely
at the risk of the applicant and any future relocation will be the responsibility of the
applicant.
2. Details and street cross-section on sheet A-3 are misnamed. I believe the Center
Entry Gate (lower detail) Is on Cypress Ave. On the site plan, sheet A-1 label the
entry gates to con^espond to details on sheet A-2 and A-3.
3. The proposed comer monument wall shown on sheet A-4 Includes a significant 12"
CMU wall, planter, and parking spaces all located within possible future right of
way. This will be a significant expense to relocate. As mentioned In comment No. 1
above the costs and responsibility for any relocation is entirely upon the applicant.
4. Construction note "F" on Pacific Street refers to "New... Fence and Pilasters
located 40' on centers on Cypress and Ocean Street". Please clarify and correct
note on sheet A-1.
5. The 6'8" Pilasters with exterior lighting will require building permits, please check
with Building Department for further information.

The Engineering Department has completed another review of the above project for application
completeness. From an Engineering standpoint, the application and plans submitted for this
project are considered complete with minor issues or clarification of previous comments
provided.
1. The previous review dated September 30, 2009 requested that existing and proposed right of
way be shown on each site plan and each detail for the proposed fence. It is apparent that the
proposed right of way for Cypress Ave., Pacific Street and Mountain View Drive still remains an
issue and will not be resolved as part of this application. With this said, the proposed fence
locations are proposed entirely at the risk of the applicant and any future relocation will be the
responsibility of the applicant.

Thank you for applying for a Administrative Review Permit in the City of Carisbad. The
Housing and Redevelopment Department, together with other appropriate City
departments, has reviewed your permit application No. RP 09-34, as to its completeness
for processing.
The application is Incomplete, as submitted. The attached list includes information that
must be submitted to complete your application. This list of items must be submitted
directly to the Housing & Redevelopment Office. All list items must be submitted
simultaneously and a copy of this list must be included with your submittal. No
processing of your application can occur until the application is determined to be
complete. When all required materials are submitted to the Redevelopment Office, the
City has an additional thirty (30) days to make a detennination of completeness. If the
application Is determined to be complete, processing for a decision on the application
will be initiated. In addition, please note that you have six months from the date the
application was initially filed, August 20, 2009, to either resubmit the application or
submit the required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to
constitute withdrawal of the application. If an application is withdrawn or deemed
withdrawn, a new application must be submitted.

Fire:
The Fire Department has the following comments:
1. The fence may only be permitted if the Anny Navy Academy provides an
improvement to the fire access for the campus. Unless modified access Is provided,
the Fire Department cannot approve the project as it restricts access that Is already
below minimum standards.

Engineering:
The Engineering Department has the following comments:
1. The site plan must show existing and proposed property lines. It appears that the
proposed fences, walls and corner monuments are located within City right of way.
Please revise sheets A-1 thru A-3 to reflect public right of way and private property.
2. Details and street cross-sections on sheets A-2 and A-3 should include existing and
proposed street right of way. Existing and future proposed improvements should be
shown to avoid future relocation or reconstruction of the fence.
3. Five of the seven streets adjacent to the Army Navy Academy are classified as
Alternative Design Streets. These streets are Mountain View Drive, Pacific Street,
Ocean Street, Garfield Street and Cypress Avenue. Location of walls within a
standard right of way would preclude the Alternative Street Design Process as
conditioned with the Master Site Plan approved in November 2006. Please locate
proposed walls and fences outside of the standard right of way as required. Note:
Ocean Street is designated as a 50' right of way, Carisbad Blvd. is designated as
102' right of way and Mountain View, Pacific, Cypress and Garfield currently require
a 60' right of way.
4. From a quick review of site plans it appears that portions of existing buildings on
Pacific Street and Cypress Ave. are located within public right of way. Provide
accurate and detailed information on the site plan, and discuss the proposed status
of any encroachments into the ultimate rights of way.
5. If permitted, the proposed wall, gate and fence on Carisbad Blvd. will require an
encroachment agreement if located within the right of way. I have attached a copy of
a blank agreement for your understanding of terms. This agreement will be a

condition of any approval for the fence, wall and gate on Carisbad Blvd., and would
be prepared by the City.
This review does not constitute a complete review of the proposed project based on
missing information. Comments on technical and design issues will be identified
