CRA is Shell's environmental consultant for the environmental case located at 1089 Carlsbad Village Drive, Carlsbad, California. Shell and their consultant, CRA, prepared a Corrective Action Plan (CAP) and a CAP Addendum that presents a mitigation plan with remedial alternatives for soil and groundwater contamination at the above-referenced site. The County of San Diego Department of Environmental Health (DEH) must review and approve the CAP prior to implementation of the plan. This notice is to advise you that the plan is available for public review, and that DEI-I is accepting public comments on the plan through April14, 2013. The environmental contamination at the site resulted from a leaking underground fuel tank system. The leak was first discovered in April1999. The CAP recommends "No Further Action'' and regulatory case closure for the site. The proposed modifications include: • Removal of the east side yard fence and installation of a rolling gate adjacent to the alley. In order for an Administrative Review Permit Consistency Determination to be approved, all of the following findings must be made: 1) The modified project design is comp~rable in character, scale, architectural detail and/or other design features to the original project design, or represents an upgrade in overall design features and/or materials as originally approved. The modification must not be readily discernible to the decision makers as being substantially different from the project as originally approved. The original architectural detail or the design features may be enhances as long as the character, scale, or theme of the design remains consistent with the original approval. 2) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function by the Housing and Neighborhood Services Director, Planning Commission and/or City Council. 3) The modified project complies with all applicable development standards, or does not exceed the variances in standards as originally approved by the final decision maker. 4) The modified project does not increase the density or intensity of the development. A decrease in the density or intensity of development can be considered an acceptable change for consistency determination purposes, at the discretion of the Housing and Neighborhood Services Director. 5) The proposed modification does not involve the addition of a new land use not shown on the original permit. 6) The proposed change will not result in any significant environmental impact, and/or require any additional mitigation. 7) The proposed change would not result in any health, safety or welfare impacts. 8) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed project modification. The access will be from the existing rear alley. The Carlsbad Fire Department has approved the proposal with the installation of a "Knox" box at the entry to the building. The "Knox" box will have the keys to the building, roofladder and the lock on the rolling gate. There will be no outside storage on the east side yard. Trash trucks would approach as shown on sheet 2 of 8. We do not really see haw the exact orientation of the enclosure is relevant, since the dumpsters are manually rolled in and out of the enclosure. We will realign the enclosure, but are confused as to why it is necessary. These changes are reflected on sheet 1 of 8. 2. Will add tree and shrubs. These changes are reflected on sheet 5 of 8. 3. Will supply color samples 4. Will update title block. 5. Will add info to title block. These changes are reflected on sheet 1 of 8. 1. A four food wide gate and Knox box will be provided. A four foot access path will be maintained in the landscaping for fire dept access. These changes are reflected on sheet 1 of 8, and 5 of 8. 2. Per agreement with Carlsbad fire protection services, a condition has been added that the propane tank shall be ten feet minimum from the freeway onramp roadway, and this distance it to be maintained if the roadway is widened. The tank will be moved, or removed if made necessary by freeway widening. A note to this effect is shown on sheet 1 of 8 Engineering 1. Per telephone conversation with Clyde Wickham, this preliminary soils report is no longer required. A soils report pertinent to the structural drawings will be submitted with the structural drawings with the building permit drawings. 2. Slope analysis was done on property and arrows showing slope are included on sheet 3 of 8. These slope measurements indicate that almost all drainage is by sheet slow to the west/northwest, terminating in the storm drain at the intersection of Village Dr., and the SB 15 ramp. Flow from the planter on the north of the property is southwestward, away from the Caltrans ROW. Flow turns west to north at the fueling station toward Village Dr. 3. Three copies of the preliminary title report will be submitted with this submission. 4. The forms will be submitted 5. There is insufficient elevation change to denote drainage pattern on a contour map. We will provide spot elevations and slope measurements at those elevations to show drainage patterns. a. My research on Low Impact Design indicates that the addition of planter area and the addition of a tree and some bushes to the proposed planter meet this requirement. b. A series of slope measurements made by me on 2/16/2010 indicate that over 95% of the property, including roof drainage, sheet flows North toward Village Drive, and the storm drain at Village Drive and I-5 Southbound Onramp. c. On the site plan or drainage plan show contours and drainage patterns. Incorporate Low Impact Development (LID) for areas of repaving, site reconstruction or soils disturbance. Consider roof drains that will surface flow to the landscape area on the Drainage plan. Ideally the site could surface drain to the proposed landscape planter and flow north via a vegetated swale to the existing inlet or storm drain on Carlsbad Village Drive. The drainage plan could be incorporated into sheet 3 and renamed Drainage & BMP plan. The following issues need to be resolved prior to resubmittal: 1. Tentative Map Application must comply with current City SUSMP requirements. Consider Low Impact Design (LID) and site specific filtration or capture of storm water pollutants expected to be produced by this project. Roof drains should also surface flow into vegetated areas prior to connection to storm drain. 2. Similar projects in this area have installed strip drains around the fueling canopy to isolate, filter and contain any contamination or pollutants caused by the fuel operation (ref. Unocal RP 96-03). 3. On the site plan, place vehicle spaces at the fueling stations (8 total locations), and dimension the clear travel area or backup distance between buildings and parking spaces to fueling stations. The clear area adjacent to the south east fueling station is only 13'. This is only wide enough for one way travel. 4. Clarify the existing square footage and the proposed square footage. Identify current ADT and the current EDU's allocated for this site. All of this information should be noted on left side of the site plan, under Project Data. 5. Show utility services, water meter location and cleanouts. Also show connections to storm drains, landscape inlets and drain lines, gas, electric and phone service. Please refer to red lined site plan for additional information and clarification of comments. Return redlines with revisions.
