NOTICE OF FINAL ACTION
CHANGE IN USE FROM RETAIL TO RESTAURANT
3091 ROOSEVELT STREET, CARLSBAD, CA.
Date of Notice: December 29, 2010
NOTICE IS HEREBY GIVEN that the Housing and Neighborhood Services Director of the City of Carlsbad
has made a final decision to APPROVE an Administrative Review Permit (RP 10-34) for property located at
3091 Roosevelt Street (APN 203-306-10). The property is located on the west side of Roosevelt Street
between Oak Avenue and Carlsbad Village Drive. The proposed project consists of the conversion of an
existing commercial/retail space to a restaurant. The applicant is also requesting final approval from the
Planning Commission of a shared parking/lease agreement between the property owner of 3067 Roosevelt
Street (New York Pizzeria) for the required 11 parking spaces. The Housing and Neighborhood Director
has determined that the proposed project meets all applicable requirements and is consistent with the
Village Master Plan and Design Manual. Therefore, the Director has approved the subject permit.
The applicant for the Administrative Review Permit is Joe Barille. The permit will allow the space to convert
from a commercial/retail land use to a restaurant with certain conditions applied.
If you wish to appeal the decision of the Housing and Neighborhood Services Director on this matter to the
Planning Commission, you must file a written appeal with the Housing and Neighborhood Services
Department within ten (10) calendar days of the date of this decision/notice. The written appeal must be
submitted no later than 5:00 p.m. on IVlonday, January 10, 2011. Appeal forms are available at the
Housing and Neighborhood Services Department located at 2965 Roosevelt Street, Suite B. If you have

NOTICE IS HEREBY ALSO GIVEN that the project is exempt from the requirements of the California
Environmental Quality Act (CEQA) per Section 15303 of the State CEQA Guidelines in that the project
involves the conversion of an existing small structure from one use to another where only minor
modifications are made to the interior of the structure. Appropriate documentation will be filed by the City of
Carlsbad's Housing and Neighborhood Services Department.
