NOTICE IS HEREBY GIVEN that the Housing and Neighborhood Services Director of the City of
Carlsbad has made a final decision to APPROVE an Administrative Review Permit (RP 11-14) for
property located at 660 Carlsbad Village Drive (APN 203-204-26). The property is located on the
north side of Carlsbad Village Drive just west of Madison Street. The proposed project consists of
the conversion of an existing commercial/retail space to a restaurant. The Housing and
Neighborhood Services Director has determined that the proposed project meets all applicable
requirements and is consistent with the Village Master Plan and Design Manual. Therefore, the
Director has approved the subject permit.
The applicant for the permit is Mayur Pavagadhi. The permit will allow the space to convert from a
commercial/retail land use to a restaurant with certain conditions applied.
If you wish to appeal the decision of the Housing and Neighborhood Services Director on this
matter to the Planning Commission, you must file a written appeal with the Housing and
Neighborhood Services Department within ten (1 0) calendar days of the date of this
decision/notice. The written appeal must be submitted no later than 5:00 p.m. on Monday,
August 22, 2011. Appeal forms are available at the Housing and Neighborhood Services
Department located at 2965 Roosevelt Street, Suite B. If you have questions regarding this

Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
considered incomplete with issues remaining as discussed below:
1. Please review and revise the storm water questionnaire (form E-34). I have attached
comments and suggestions. I addition the project should include Low Impact
Development (LID) measures to lesse the impact of storm water runoff from this
development. Flow thru planters and pervious planters that can accept sheet flow from
parking spaces could be incorporated into the design in compliance with current
requirements and regulations. For more information please visit :

2. Revise the Legal Description on cover sheet Al.O to reflect entire project. Also correct
the assessor's parcel number to correspond to the total project parcels. Submit a
current Title Report for the complete boundary of the project. If necessary provide
information or lease agreement to show full use of the adjacent parcel.
3. The site plan should show (screened/background) the existing improvements or
conditions with proposed improvements or development printed over, in a slightly
darker line weight.
4. The site plan should show existing topography, contours or spot elevations to reflect
current and proposed drainage patterns. The site plan should also extend 25' beyond
the project boundary to show fences, drainage patterns and buildings.
5. You can remove the sheet index information from the site pia , if these drawi gs are
not part of the discretionary package.
6. On sheet Al.O: Please show streetscape improvements, access ramps, cross sections for
the alley and Carlsbad Village Drive, existing fences, planters, and streetscape on

We understand a grease trap has been installed please identify this location. Add RP 11-
14 and CDP 11-_to the upper right corner as identification of the project. Check with
Austin Silva for project identification numbers.
7. Please add the correct scale to the site plan. An Engineers scale of 1"=10' is acceptable
and may allow room for adjacent property information to be provided.
8. The one way traffic configuration and angled parking will not fit within the space
provided. Please review your proposed design and review Chapter 21.44 of the Carlsbad
Municipal Code for acceptable dimensions and parking standards. If reconfiguration is
pursued, show proposed reconstruction of driveway on Madison Street.
9. Show truck access and circulation including delivery loading area and circulation for
trash pick-up. The city uses Caltrans Design Manual for a 40' truck/bus, figure 404.5F
When corrected, please resubmit: storm water questionnaire, title report, and 2 copies
of the revised site plan. If you have any questions, please give me a call.

The following findings have been made in order to approve the Administrative Review Permit for
property located at 660 Carlsbad Village Drive:
1. The Housing and Neighborhood Services Director has determined that the project is consistent
with the policies, goals and action programs set forth within the Carlsbad General Plan.
2. The Housing and Neighborhood Services Director has determined that the project is consistent
with all applicable development standards and land use policies set forth within the Village
Master Plan and Design Manual.
3. The Housing and Neighborhood Services Director has determined that the project is exempt from
the requirements of the California Environmental Quality Act (CEQA) per Section 15303 Class 3
of the State CEQA Guidelines as the project involves the conversion of an existing small
structure from one use to another where only minor modifications are made to the interior of the
structure.

General
1. This approved permit serves as the required Village Review permit for the subject project. The
applicant has received approval to convert an existing commercial/retail building to a restaurant
at 660 Carlsbad Village Drive.
2. The project shall be completed according to, and consistent with, the colors, materials, and plans
approved by the Housing and Neighborhood Service's Director on the date noted above. The
approved plans have been stamped by the Housing and Neighborhood Services Director and
indicate the approval date of August 23, 2011.
3. The usable restaurant space is limited to 2,638 square feet as indicated on the floor plan. The
non-usable space shall not be occupied at anytime. An amendment shall be required to this
permit to increase the amount of usable restaurant space within said building.
4. In consideration of the City's approval of an alternate parking lot design proposed by the
applicant for the restaurant known as "Catch" to be located on a parcel of land described as
Assesor Parcel Numbers 203-304-26 and 203-304-31, with acceptance of this approved permit,
the tenant and property owner shall promise to hold the City of Carlsbad, its officers, agents and
employees, or any other public agency, harmless from any liability for damage arising from any
use of the noted parking lot which has a narrower drive aisle width and therefore less back up
distance for vehicles using said parking lot. As a condition of approval, the tenant and property
owner shall execute a hold harmless agreement and submit the agreement for recordation prior
to final certificate of occupancy and operation of said business establishment.
5. The applicant shall obtain required building permits for construction of all new improvements to
said existing structure.
6. A separate sign permit is required for any new signage located on site.
7. All rooftop mechanical equipment shall be properly screened per City of Carlsbad standards.
8. The exterior of the building shall be properly maintained at all times, and there shall be no
outdoor storage permitted at any time.
9. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include but are
not limited to pollution treatment practices or devices, erosion control to prevent silt runoff
during construction, general housekeeping practices, pollution prevention and educational
practices, maintenance procedures, and other management practices or devices to prevent or
reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance
system to the maximum extent practicable. Developer shall notify prospective owners and
tenants of the above requirements.
10. Developer shall complete and submit to the City Engineer a Project Threat Assessment Form
(PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF, Developer shall also
submit the appropriate Tier level Storm Water Compliance form and Tier level Storm Water
Pollution Prevention Plan (SWPPP) as determined by the completed PTAF all to the satisfaction
of the City Engineer.
11. Developer shall incorporate measures with this project to comply with Standard Stormwater
Requirements per the city's Standard Urban Stormwater Management Plan (SUSMP). These
measures include, but are not limited to: 1) reducing the use of new impervious surfaces (e.g.:
paving), 2) designing drain<t"" from impervious surfaces to discr-\ge over pervious areas (e.g.:
furf, landscape areas), 3) a~designing trash enclosures to avol!'contact with storm runoff, all
to the satisfaction of the city engineer.
12. Developer shall install potable water and sewer services, laterals, meters and cleanouts with
specific size and locations approved by the city engineer. The locations of said services shall be
reflected on building plans or construction revision as mentioned above.
13. Developer shall pay traffic impact and sewer impact fees based on Section 18.42 and Section
13.10 of the City of Carlsbad Municipal Code, respectively. The Average Daily Trips (ADT) and
floor area contained in the staff report and shown on the site plan are for planning purposes only

This fetter is a follow-up to my previous fetter to you, dated June 15, 2011, in which the
items necessary to complete your application for an Administrative Review Permit were
identified. The Engineering Department has removed several comments from their initial
review. The comments listed below are the updated comments. Please address these
comments for your next submittal.
Engineering:
1. Please review and revise the storm water standards questionnaire (form E-34).
Revise the legal description and assessor's parcel number to reflect the entire
project (both parcels).
2. The site plan should show (screened/background) the existing improvements or
conditions with proposed improvements or development printed over, in a slightly
darker line weight.
3. The one way traffic configuration and angled parking will not fit within the space
provided. Please review Chapter 21.44 of the Carlsbad Municipal Code for required
dimensions and parking standards and redesign accordingly. Clarify whether
proposed parking spaces are standard or compact. If reconfiguration is pursued,
show proposed reconstruction of driveway on Madison Street. Show existing planters
and landscaping proposed to be removed.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
RP 11-14
Staff has completed a review of the subject project for application completeness. The
applications and plans submitted for this project are also incomplete in some areas.
Please take note of the comments. The application cannot be processed further without
the requested information. Please resubmit 3 sets of plans addressing the following
incomplete items by providing the requested information and addressing the noted
issues at your earliest convenience:
Housing and Neighborhood Services:
1. The parking requirement for a restaurant in the VR (Village Review) zone is one
space per 100 square feet of net floor space. Net floor space is that area which
remains after square footage of spaces that do not generate parking demand are
removed from the calculation of total square footage of floor space of a building.
Spaces which do not generate a parking demand include, but are not limited to,
restrooms, storage areas, walkways, and similar space.
2. Parking is required to be provided for the kitchen area of the restaurant. Combining
the 1 ,596 square foot kitchen area with the 2,644 square foot dining area requires a
total of 42 parking spaces (4,240 square feet).
3. Standard parking spaces must have a minimum area of 170 square feet and a
minimum width of 8'6".
4. Compact parking spaces may be used for up to 40% of the required parking spaces
and must be 8' wide by 15' long.
5. Drive aisles for parking spaces at a 60 degree angle must be 18' wide.
6. With 42 parking spaces required and 29 spaces provided on site, there is a parking
shortage of 13 spaces. Staff has identified possible solutions (listed below) that may
satisfy the parking requirement with the City Council's approval:.
A. The site is eligible to participate in the Parking In-Lieu Fee Program for up 100%
of the required parking spaces. The parking in-lieu fee is $11 ,240/space. With
13 spaces needed, the total fee would be $146,120. This option allows Housing
and Neighobrhood Services Director approval of the administrative permit for the
change in land use, but requires Council approval of the parking in-lieu fee
agreement prior to release of the building permit.
B. A standards modification may be requested to ask for a reduction in the required
parking spaces and to the standard parking space size. A standard modification
would require a public hearing before the Planning Commission who would make
a recommendation to the City Council for final decision.
C. Valet parking may be used to satisfy the parking requirement if it can be shown
that a valet operation can accommodate the required number of parking spaces
on site. Because this is also considered a standard modification, it will require a

Fire:
public hearing before the Planning Commission who would make a
recommendation to the City Council for final decision. Staff has indicated that it
will support valet parking as a standards modification for said project.
1. Fire Department access is inadequate. Provide fire access road in accordance with

3. Per the meeting on 6/14111, if you are not able to meet the fire access requirements
noted above, please submit a letter with your revised plans indicating the reasons
that you will not be able to meet the requirements and request consideration of an
enhanced fire sprinkler system for the building which will reduce fire risks, and
request consideration for this alternate fire suppression system by the fire official.
4. Provide additional fire hydrants at intervals of 300 feet along public streets and/or
private driveways. Hydrants should be located at street intersections when possible,
but no closer than 1 00 feet from the terminus of a street or driveway.

Engineering:
1. Please review and revise the storm water questionnaire (form E-34). I have attached
comments and suggestions. In addition the project should include Low Impact
Development (LID) measures to lessen the impact of storm water runoff from this
development. Flow thru planters and pervious planters that can accept sheet flow
from parking spaces could be incorporated into the design in compliance with current

2. Revise the Legal Description on cover sheet A1.0 to reflect entire project. Also,
correct the assessor's parcel number to correspond to the total project parcels.
Submit a current Title Report for the complete boundary of the project. If necessary
provide information or lease agreement to show full use of the adjacent parcel.

3. The site plan should show (screened/background) the existing improvements or

4. The site plan should show existing topography, contours or spot elevations to reflect
current and proposed drainage patterns. The site plan should also extend 25'
beyond the project boundary to show fences, drainage patterns and buildings.
5. You can remove the sheet index information from the site plan, if these drawings are
not part of the discretionary package.
6. On sheet A 1.0: Please show streetscape improvements, access ramps, cross
sections for the alley and Carlsbad Village Drive, existing fences, planters, and
streetscape on Carlsbad Village Drive. Location of sewer, water, and utilities should
also be provided. We understand a grease trap has been installed please identify
this location. Add RP 11-14 and COP 11-12 to the upper right corner as
identification of the project.
7. Please add the correct scale to the site plan. An Engineers scale of 1"=10' is
acceptable and may allow room for adjacent property information to be provided.
8. The one way traffic configuration and angled parking will not fit within the space
provided. Please review your proposed design and review Chapter 21.44 of the
Carlsbad Municipal Code for acceptable dimensions and parking standards. If
reconfiguration is pursued, show proposed reconstruction of driveway on Madison
Street.
9. Show truck access and circulation including delivery loading area and circulation for
trash pick-up. The city uses Caltrans Design Manual for a 40' truck/bus, figure
404.5F.
When corrected, please resubmit: storm water questionnaire, title report, and 2 copies of
the revised site plan. Regarding any comments from the Engineering Department,
please contact Clyde Wickham, Associate Engineer, at (760) 602-27 42.
City staff is supportive of your request to convert the existing retail building to a sit-down
restaurant. To complete our processing and in order for staff to prepare the required
report for the Planning Commission and City Council to approve to address the
standards modifications required for the project, please revise your plans to include the
above information as quickly as possible. It is our commitment to you to process the
permit as quickly as we can following receipt of the final set of revised plans.
