I want to clarify the facts and firmly dispute the assertions presented by Bill Hoffman during his presentation at the Carlsbad City Council meeting on Tuesday August 28^^ Warm Regards, Katie Taylor Broker / Owner Taylor Place Real Estate, Inc SHAME ON ANA - Setting The Record Straight Bill Hoffman on behalf of the Army Navy Academy addressed the City Council on 8/28/12 saying that 2 business owners, Taylor Place Real Estate and the Scandia Motel were objecting to the new ANA Athletic building project because ANA declined to provide any compensation due to loss business. His statement distorted the truth. After the City Council approved the ANA project with no discussion or questions regarding the concerns and objections I brought to the City Council's attention, I had a conversation outside the meeting with Bill Hoffman and challenged him to set the record straight. Bill Hoffman insinuated the only reason I and the owner of the Scandia Motel had objections to the ANA project was based on a monetary demand. Mr. Hoffman never explained what the amount was or who was to benefit. This left the impression or could be construed as a bribe for an outrageous amount which could not be further from the truth. In meetings with ANA, it was my idea, not the owner of the Scandia Motel to propose and request for Mrs. Artukovic to receive some compensation for loss of business during the 6-9 month construction period, since the work will be within a few feet of her motel building and she would clearly lose business. First I requested $6000 and then reduced to $4500. At no time, did I ever request one dime in compensation from ANA for my business. I lease my real estate office from Mrs. Artukovic and was only trying to help another small business owner, a widow, get through the loss of income during construction. Uba Artukovic is an American success story, an immigrant from a communist country who was able, 37 years ago with her husband, to start a small business in Carlsbad. During one meeting with ANA, I brought her story to their attention, and the response was "that was interesting but what did that have to do with ANA." This callus remark represents the ANA attitude towards its neighbors who will be impacted by the construction. Bottom line the project is good for ANA and they are not concerned with the impact on others. Regarding the $4500, a statement was made by ANA and also said by Bill Hoffman at the City Council meeting, they could find no precedent for compensating a business owner for lost business during a construction project. When does there need to be a precedent to do what is right? To set the record straight, I was the person who kept insisting to ANA it was reasonable and fair to offer some compensation to Mrs. Artukovic. Mrs. Artukovic was willing to forgo monetary compensation because of the intimidation placed on her by ANA. ANA tried to intimidate Mrs. Artukovic advising that the Scandia Motel's handicap parking was on ANA property and they had Arial photos to prove it...this was not accurate. Then ANA claimed two of her buildings were probably on ANA property and may have to be torn down and that also turned out not to be true. With ANA, intimidation was the rule of the day. Based on this experience, I guess the "Village" concept that the City of Carlsbad promotes is right out the window. From the very first meeting with ANA, I pointed out there were other problems and concerns regarding their project over and above the impact on my real estate office and the Scandia Motel. At the City Council Meeting, I pointed out that the location of the new ANA ticket booth was on a section of Carlsbad Blvd with no street parking. The design creates a reason for people to slow down and let passengers off while the driver parks in another location. This design will block and slow down traffic. To lessen the impact to traffic, the ticket booth should be located on the south end of the football field where 50 parking spaces are designated. For safety reasons, an above street level walkway should be built from the ANA west campus to the new athletic building on the east side. Regularly, my staff and I hear screeching tires and see accidents on this section of Carlsbad Blvd where it narrows in front of the proposed ticket booth. This is already a hazardous section of Carlsbad Blvd...cars speed through this section, pedestrians cross at all areas, and cars try to pass each other in the bike lane which is in constant use by cyclists especially on weekends. The proposed parking for the ANA project is clearly inadequate. ANA claims the number of cars to events will not change. A ticket booth and larger stadium seating appear to contradict this claim. I tried to negotiate an agreement that all parties considered fair. At every point, ANA kept to the same theme, there was nothing they could do as they needed every "square foot" for their project to meet the setbacks requirements. After a few meetings, ANA agreed to some concessions on fencing, drainage, construction parking and construction clean-up. However, the final plan approved by the City Council left minimal space for the Scandia Motel to maintain a building on the south side of her property. The ANA block wall will be within 3 feet of the building and approximately 9 feet high including the top railing. To his credit, Mr. Hoffman said after the City Council meeting they would try and increase that space to at least 4 feet. Over the years, I have tried to be a good neighbor to ANA including accommodating their guests to use my office restrooms since their facilities were not convenient to the football field. My only complaint to ANA has been over the bagpipe players practicing outside in the summer. Ask any other resident or business owner and I am sure they have complained too. ANA primarily keeps the bagpipe players on the Carlsbad Blvd side due to complaints from beach residents. I propose the following to ANA. I will donate $4500 to Wounded Warriors on behalf of ANA, if ANA compensates Mrs. Artukovic $4500 for loss business. $4500 is a drop in the bucket for their $10,000,000 project. Since we were not present at the meeting and could not speak to the points contained in their letter, this letter has been written to address each of the points made. Attached is the letter from Mr. Ginder with our responses inserted (labeled "AN Response"). As you are likely aware, both of my clients own mi operate businesses directly adjaooit (north) of the Army Navy Academy's athletic fidd; Ms. Artukovic also owns tihe land on which these businesses are situated. Please accept this letter as my clients' fonnal objection to the above-ieferenced project Please take whatever steps are necessary to place clients' objections, as set forth more fiilly below, as agrada-items for discussion vihea the Carlsbad City Counsel addresses this project at its August 28.2012 meeting. Agenda-Items: 1. Lack off Prooednral Notice/llkie Process To begin with, I understand that the Carlsbad Planmng Commission held a public hearing regarding this project on July 3,2012. Ms. Taylor neva received any notice of this hearing, nor did she receive any actual notice of tlie project until several days after the hearing took place and, apparently, the Phmning Commission voted to approve the project. It is our contoition that Ms. Taylor is an individual to whom notice of the project and the July 3"* hearing was due and diat the lack of notice to her is a procedural defect in project's approval process. AN Response: Both the owner of the property and each tenant were notified of the Planning Commission hearing within the timeline requirements of the Zoning Ordinance. Attached is a list of owners and tenants who were notified of the hearing. The owner of the hotel is circled and the tenant at the address of Taylor Place Real Estate is circled. Every tenant on site was notified. We obviously could not get the actual names of the tenants since they are not listed on the Assessor's Rolls, but a letter of notice was sent to each address. 2. Lot-tine disiiwiteffliliiicriMiichnieiiit Next, the project as ^proved by the Planning Cranmission appears to enaoacfa upon Ms. Artukovic's property based upon a survey that she obtained several years ago. This is of particular Page 1 of 3 Response to Letter of Objection concem to Ms. Artukovic, as the project, as approved by the Planning Commission, may result in the loss of her handicapped parking. It is also a concem to Ms. Taylor as the wall and fence that the Academy intends to build will obliterate an artistic mural on the side of her building. As such, unless these issues can be resolved between my clients and the Academy, I have advised Ms. Artukovic to proceed with a quiet-title action and to seek an injunction to preserve the status-quo until the Superior Court determines the proper boundary lit>e separating Ms. Artukovic's property from the Academy's property. AN Response: A very recent survey (July 2012) was completed to determine the exact property line between the Academy's property and the Hotel property. The hotel buildings and the real estate office were built very close to the property line, but there is no encroachment. The handicap space is entirely on the hotel property. The proposed retaining wall in front of the mural is no greater than 3 feet and averages approximately 1.5 feet. It would not block the mural. Regardless, we will redesign the parking lot to eliminate the need for the wall. There is no fence proposed along the property line fronting the mural. The only obstruction could be tree planting. We are willing to relocate the trees elsewhere on site, but this is subject to the city's approval. 3. Loss of Bnanegs Revenne Construction of the project will have significant impact upon my clients' businesses. It is unlikely that Ms. ArtukovOi's customers will want to stay as guests of ha hotel while major construction is occurring directly next door. Rirthermore, Ms. Tabor's real estate business necessarily involves meeting with clientele at bet office, which lacks air-conditioning. It is virtually certain Aat construction will result is air bom dirt and dust Hat wiU coat the interior of Ms. Ta^or's offices. This will severely hinder Ms. Taylor's ability to operate her business and is likely to negatively impact her income. AN Response: The assertion that our construction will have a significant impact on either the Real Estate business or the hotel business has not been substantiated with facts and is at this point completely hypothetical. That said, we believe that the completed project will enhance the business of the hotel since there will be more activities at the Athletic Center that will generate the need for nearby accommodations for parents and relatives. We believe this enhancement will more than offset any minor impacts to the hotel business. Furthermore, any monetary request to offset hypothetical financial impacts on any business establishes a dangerous precedent for all developers in the city in general. We do not believe they are either necessary or appropriate. AN/General Contractor will be providing all necessary preventative measures to reduce the amount of dirt and dust onto adjacent properties. We also have agreed to continually monitor our impacts to the hotel property and we will clean up any dirt and dust, etc that our construction generates. Page 2 of 3 Response to Letter of Objection 4. lagBWWKFaBT AMraarf fliiY^ri Finally, my clients do not feel that the fdlowing issues have been adequmety adidressed and vetted as part of the Planning Commission's approval of tbe project: A. Tht project's effect upon the site drainage from the Acaidemy's pn^ierty mto Ms. Artukovic's property; AN Response: Under the current conditions, some water does drain from the AN property onto the hotel property and some water drains from the hotel property onto the AN property. At the conclusion of our construction, there will be no water drainage from either property onto the other. All AN drainage will be channeled to an on site basin and then flow into the city's storm water system. AN will ensure that hotel drainage along the property line will be provided for. B. Increased pedestrian traffic acros& Carlsbad Boulevard from the Academy to tbe new adiktic field and the niety of the existing csots walk to batMlle the iaatased pedestrian traffic needs; AN Reply: The city staff and AN have addressed this issue and the project has been conditioned to provide an electronic pedestrian crosswalk system at the existing crosswalk. This system will be designed by AN and reviewed by the city to ensure a safe pedestrian crossing at this location. Also, the city is reconfiguring the stripping in front of the Academy so that there will be a single lane in each direction as the lanes approach the crosswalk. This will further reduce risks to crossing pedestrians. C. baeased padupg comsestioD. AN Response: Parking for the entire AN facility was addressed when the AN Master Site Plan was approved a few years ago. This plan ensures that every development phase of the Academy had sufficient parking to meet the demands of that phase. The Athletic field phase is no different. The parking standard of the Zoning Ordinance and the Master Site Plan will be met by the additional parking being added. Also, it should be noted that the construction of the new athletic facility will neither increase the number of faculty nor the number of students enrolled at the school. Parking demand is not being increased by this facility. However, we are still adding parking spaces. D. Increased biiilding heights. There is existing soil that will have to be removed, re-compacted and brought back to the site, but the existing elevations are not being raised. Grinder 970 Canterbury Place Escondido, CA 92025 RE: RP 12-13/CDP 12-04 - ARMY AND NAVY ACADEMY Dear Mr. Eric Ginder: You submitted a letter to be distributed during the Public Comment period at the City Council meeting on July 24, 2012. In the letter, issues were raised regarding lack of procedural notice/due process, lot- line dispute/encroachment, loss of business revenue, site drainage, increased pedestrian traffic, increased parking congestion, and increased building heights. The following are responses to the issues raised within your letter to the City Council. 1. Lack of procedural notice/due process: The noticing requirements for a Major Redevelopment Permit and Coastal Development Permit require the city to notif/ property owners within a 600 foot radius of the site and occupants within a 100 foot radius of the site. The required noticing was completed, and both the property owner and tenant were included in the noticing. In addition, an on-site project notice sign was posted on the property soon after the application for the project was submitted. 2. Property line: Hofman Planning and Engineering had the property line surveyed and staked, which was shown to the property owner (Uba Artukovic) and tenant (Katie Taylor) to demonstrate that the project does not encroach into any of the adjacent properties or impact parking spaces. Furthermore, there is concern regarding the mural being blocked from view on the south wall of Ms. Taylor's office. The Army and Navy Academy, along with the representative Hofman Planning and Engineering, have met privately with Ms. Artukovic and Ms. Taylor to resolve their issues with the project. As a result of the meetings, the Army and Navy Academy has agreed to remove a retaining wall, and instead, slope a portion of the parking lot. Also, the Army and Navy Academy will cluster trees in the landscaped portion of the parking lot adjacent to Ms. Taylor's office so that the mural on the south side of her building will still be visible. 3. Loss of business: It is understandable that there are concerns regarding the loss of business during construction of the proposed athletic facility. However, the site is located in an urban area with different land uses and it is acknowledged that there may be short term nuisance impacts from nearby construction. Municipal Code Section 8.48.010 limits the hours of construction Monday through Friday from 7 A.M. until dusk, Saturday from 8:00 A.M. to dusk, and no construction is permitted on Sundays and holidays. 4. Drainage: Currently, the Army/Navy athletic field site drains towards the hotel property. The project resolves this issue by keeping all drainage on site and directed towards an underground treatment/storage facility. Most of the storm water will percolate on site. The hotel drainage is now conveyed through a dirt swale along the common hotel/Army and Navy property line crossing over into the Army and Navy side several times. This will be corrected by building retaining walls and cleaning the drainage water before it leaves the hotel site. Also, the dirt swale will be rebuilt to stay inside the hotel property. The part that won't have a retaining wall will be landscaped and have a bio-swale to take a portion of the hotel drainage. 5. Increased pedestrian traffic: Although there is not an increase in students associated with the new athletic facility, it is anticipated that more students and staff will be crossing Carlsbad Boulevard to use the facilities. As a result of this anticipated increase in use of the crosswalk, a condition has been placed on the project requiring the Academy to improve the existing cross walk and associated improvements to include a pedestrian signal or beacon. 6. Increased parking congestion: The previously approved Army and Navy Academy Master Site Plan addresses parking, which is based upon the number of students and staff at the school. The Master Site Plan designates separate planning areas, of which the subject property is designated as Planning Area E. Planning Area E calls for 63 parking spaces between two parking lots on the north and south ends of the property. The proposed project will be providing a total of 63 parking spaces between both lots. Furthermore, the site is currently being used as a multi-purpose field, which is what it will continue to be used as. The athletic building will have facilities such as a gymnasium, weight room, and film room that will be used by students and staff, not requiring additional parking spaces as there will be no increase in students and staff. Basketball games and wrestling matches are activities that currently do not occur on site right now and will take place in the new facility. However, these activities typically do not attract large crowds. 7. Increased fill heights: The maximum building height for the Land Use District 9 of the Village Review Zone is 45 feet. Building height is limited to the vertical distance measured from "existing grade" or "finished grade", whichever is lower, at all points along the "building coverage." The main athletic building measures 45 feet 5 inches and has a decorative parapet that extends five inches above the height allowance. Protrusions above the height allowance used as architectural features are permitted by Municipal Code (Chapter 21.46.020), if additional floor space is not created. Therefore, the proposed building heights are in compliance with the standard set forth. Silva and M. Elliott, and subsequent correspondence with A. Silva and M. Elliott, revised landscape concept and plans were agreed to and all plan sets have been updated accordingly. " Evergreen trees have been added along the north side of the athletic facility; however civil plans show a storm drain in this location. In the meeting and subsequent e-mails the applicant was requested to coordinate the storm drain with trees. Please coordinate with civil to relocate the storm drain or insure that the storm drain will not be compromised. Provide documentation that this has been coordinated. Architect, Landscape and Civil are working really close together and coordinating every step of the way. That storm drain pipe needs to go thru the back of the building to catch runofffrom the roof drains and also carries runofffi'om the North parking lot. It will be installed close to the building and as far as possible from the trees (Trees will be planted close to the retaining wall). Standard #2 - Ground Cover One hundred (100%) percent of the area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3 - Low Shrubs Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4 - Trees and/or Large Shrubs Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Slopes - 6:1 or steeper and: a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum Standard #1. b. 3' to 8' in vertical height require Standards #1, #2 and #3. c. In excess of 8' in vertical height require Standards #1, #2, #3, and #4. Provide cross sections of existing and proposed improvements to Beech Avenue and Carisbad Blvd. Existing and proposed improvements can be shown on the same cross section for each street. On each cross section show existing and proposed right of way. Carisbad Blvd. is a major arterial within 102' of right of way. Beech Avenue is a local street classification typically within 60' right of way, but in this case the right of way appears to be 80'. Cross sections added to sheet C-2. Beech Avenue will be shown at 80' right of way until further mapping studies are performed as part of the final engineering / mapping submittals. 2. Right of way on Carisbad Blvd. is shown as only 100 feet, 2 feet less than current requirements. If we consider this roadway to be correctly aligned with the centeriine, a one foot dedication on each side of the roadway would be required. On the site plan, show a proposed right of way dedication of one foot, and the project will be conditioned to dedicate right of way before the issuance of a building permit. To keep this project on a fast track, you could dedicate this right of way at any time, the process is relatively simple. The location of Carisbad Blvd. is per the Master Plan and is considered preliminary. Further mapping studies will be performed at the final engineering / mapping stage. We are dimensioning the total width of the street on these plans. The width ranges from 100.65' to 102.5'. 3. Constraint Items shown on sheet C-3 and C-4 identify issues with the placement of proposed buildings over existing easements. Additional study is needed to release, vacate or quitclaim unnecessary easements. Further mapping studies will be performed as part of the final engineering / mapping process. 4. Undergrounding of overhead electric facilities is a requirement of the Master Site Plan (RP 05-04). Chapter 5, page 22 and 23 have specific requirements that address improvements and undergrounding conditions on this parcel of the Academy. All utilities will be undergrounded on the frontage of the project in coordination with the utility purveyors. Efforts will be made to coordinate with neighboring properties to underground the complete block. Plans have been updated with existing and proposed utilities. 5. The application and plans submitted for this proposed project are, from an Engineering perspective, considered complete with issues to be resolved before we can support an approval: ENGINEERING COMMENTS: 1. Provide cross sections of existing and proposed improvements to Beech Avenue and Carlsbad Blvd. Existing and proposed improvements can be shown on the same cross section for each street. On each cross section show existing and proposed right of way. Carlsbad Blvd. is a major arterial within 102' of right of way. Beech Avenue is a local street classification typically within 60' right of way, but in this case the right of way appears to be 80'. 2. Right of way on Carlsbad Blvd. is shown as only ICQ feet, 2 feet less than current requirements. If we consider this roadway to be correctly aligned with the centeriine, a one foot dedication on each side of the roadway would be required. On the site plan show a proposed right of way dedication of one foot, and the project will be conditioned to dedicate right of way before the issuance of a building permit. To keep this project on a fast track, you could dedicate this right of way at any time, the process is relatively simple. 3. Constraint Items shown on sheet C-3 and C-4 identify issues with the placement of proposed buildings over existing easements. Additional study is needed to release, vacate or quitclaim unnecessary easements. 4. Undergrounding of overhead electric facilities is a requirement of the Master Site Plan (RP 05- 04). Chapter 5, page 22 and 23 have specific requirements that address improvements and undergrounding conditions on this parcel of the Academy. 5. The project will be conditioned to consolidate the existing lots, per condition No. 31 of DRB Resolution No. 334 As mentioned above several easements can also be quitclaimed or vacated to clear up old land uses that may not be needed today or in the future. Beech Avenue will be required to be improved. Please show curb, gutter and sidewalk along the frontage of Beech Ave. as required. The proposed three driveways are an issue on Beech Avenue. Two driveways would produce minimal conflict with existing driveways. Consider redesigning the two parking lots into a single lot graded to 'a general 3-4% cross slope. 7. On the site plan legend sheet C-1, use standard symbol for proposed retaining walls. Show these walls on sheets C-2, C-5, C-6 and C-7. Please add height of walls at a reasonable interval or change of elevation. 8. The Preliminary Storm Water Management plan (SWMP) identified undercuts and subsurface storage details that I believe were omitted in the earthwork calculations, please check this and if needed revise earthwork quantities to reflect proposed development. 9. The SWMP and proposed hydromodification plan looks acceptable for discretionary approval. Show how the project meets low impact design (LID) requirements of the Standard Urban Stormwater Management Plan (SUSMP). If possible disconnect roof drains to allow more surface drainage across vegetated swales or grassy areas. 10. The offsite (D-40) energy dissipater looks like it is located directly upstream from a railroad access road. This outfall carries all of the drainage from this project. Consider the damage that could occur with a heavy storm occurrence, and relocate or mitigate the potential damage to offsite property. Perhaps the railroad access could be raised above the outfall area. A private easement from NCTD will be required to locate this drainage facility offsite. 11. The parking lot dimensions proposed do not meet the city's minimum standards. Check Section 21.44.050 of the municipal code for specific dimensions and requirements. As an example: Perpendicular parking requires a minimum 24' backup dimension. 12. Numbers below are referenced on the red line plans where appropriate for ease in locating the area of the comment concem. 1. Please provide the percent of the landscaped area (as defined in Appendix G) of each planting zone as described in Section A.5-3 and Appendix A of the Landscape Manual. There appear to be 2 zones as shown on the water conservation plan. Please also define which zone the existing planting areas are. 2. Please extend the bio-swale to coordinate with civil plans. 3. Landscaping consisting of ground cover, shrubs, and trees shall be used to screen elements of unsightliness and screen/soften new improvements. Landscaping shall be used to accentuate and enhance architecture. Please provide planting to include tall evergreen trees on the north and east sides of the athletic facility and on the east side of the maintenance building. 4. Landscape elements over 30" in height (including planting measured at maturity) are not allowed at street comers within a triangular zone drawn from two points, 25' outward fi-om the beginning of curves and end of curves. (See Appendix C.4). The same height limitation applies at driveways 25' fi-om the edge of the apron outward along the curb then 45-degrees in toward the property. In addition to the requirement above, on collector streets and greater, Cal Trans Sight Distance Standards shall apply to the height restriction stated. Please show and label all vehicular sight lines on the plans and insure these requirements are met. Tree canopies in these areas are to be raised to a minimum 8' height above finish grade. 5. All utilities are to be screened. Landscape constmction drawings will be required to show and label all utilities and provide appropriate screening. Please also insure light poles are not in conflicts with trees. 6. Trees shall be provided at the minimum rate of one per every four parking stalls. Trees pertaining to this requirement shall be located within the parking area, exclusive of parking lot setbacks. The trees shall be located in close proximity to the spaces they are to shade. The perimeter landscaped strip may include any landscaped yard, setback, or landscaped area otherwise required within the property and shall be continuous except for required access points. Please address. 8. Planting or any combination of planting, mounding, and decorative walls shall be used to provide screening fi-om adjacent property or streets of the parking area to a height of 3'. 9. At least three percent of parking areas shall be planted and maintained with trees or approved shmbs. The plantings shall be contained in planting areas with a minimum dimension of 4' and bounded by a concrete or masonry curb of a minimum of 6" in height. The plantings shall be located throughout the off-street parking areas in order to obtain the maximum amount of dispersion. Please provide a calculation proving the percentage of landscape area provided in the parking areas. 10. The water conservation plan has been forwarded to Carlsbad Municipal Water District for review. Any comments will be retumed to the applicant. 11. As required by the State of Califomia, the City of Carlsbad has adopted a water efficient ordinance. All requirements of this ordinance are to be met. Concept plans shall include calculations which document the maximum allowed annual water use for the landscaped area or maximum applied water allowance (MAWA) and estimated total water use (ETWU). A landscape project shall not exceed the MAWA. The MAWA for a landscape project shall be determined by the following calculation as defined in the City ordinance: MAWA = (ETo)(0.62)[(0.7 x LA) + (0.3 x SLA)]. The ETWU shall be determined by the following calculation as defined in the City ordinance: ETWU = iETo)(0.62) ^ PFxHA ^ IE + SLA Please include numbers used for each part of these formulas (include the number used for the ETo) on the plans for cross checking. In addition to the calculations, include a statement on the plans signed under penalty of perjury by the person who prepared the plan that provides: "I am familiar with the requirements for landscape and irrigation plans contained in the City of Carlsbad's Water Efficient Landscape Regulations. I understand that constmction drawings are to be prepared in compliance with those regulations and the Landscape Manual. I certify that the plans will be prepared implementing those regulations to provide efficient use of water." Please insure that all requirements of the water use ordinance are met. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder of the year. b. Standard #2 - Ground Cover One hundred (100%) percent of the area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3 - Low Shmbs Low spreading woody shmbs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent of the slope face (at mature size). d. Standard #4 - Trees and/or Large Shmbs Trees and/or large shmbs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Slopes -6:1 or steeper and: a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum Standard #1. b. 3' to 8' in vertical height require Standards #1, #2 and #3. c. In excess of 8' in vertical height require Standards #1, #2, #3, and #4. Areas graded flatter than 6:1 require Standard #1 (cover crop) with temporary irrigation when they have one or more of the following conditions: a. Sheet graded pads not scheduled for improvements within 6 months of completion of rough grading. b. A potential erosion problem as determined by the City. c. Identified by the City as highly visible areas to the public or have special conditions that warrant immediate treatment. 13.
