10. FINDINGS AND CONDITIONS OF APPROVAL (IF APPLICABLE) Page 1 of 2
The following findings, have been made in order to approve the Administrative Review Permit
Amendment for property located at 2812 Roosevelt Street:
1. The Housing and Neighborhood Services Director has determined that the project is consistent
with the policies, goals and action programs set forth within the Carlsbad General Plan.
2. The Housing and Neighborhood Services Director has determined that the project is consistent
with all applicable development standards and land use policies set forth within the Village
Master Plan and Design Manual.
3. The Housing and Neighborhood Services Director has determined that the project is exempt from
the requirements ofthe California Environmental Quality Act (CEQA) per Section 15303(e) ofthe
State CEQA Guidelines as accessory (appurtenant) structures including garages, carports, patios,
swimming pools, and fences do not have a significant effect on the environment

The following conditions have been approved for the subject project:
4. This approved permit serves as the required land use permit for the subject project, approving an
outdoor dining patio at an existing delicatessen.
5. The project shall be completed according to, and consistent with, the plans approved by the
Housing and Neighborhood Services Director on the date noted above. The approved plans have
been stamped by the Housing and Neighborhood Services Director and indicate the approval date
of 06/05/2012.
6. The seating area within the outdoor patio may not exceed 598 square feet any time. An increase in
seating area to the outdoor patio will require an amendment to this permit, additional parking, and
additional traffic impact fees.
7. Developer shall obtain appropriate and applicable building permits to allow for use of the outdoor
dining patio and shade structure.
8. Developer shall pay traffic impact fees based on Section 18.42 of the City of Carlsbad Municipal
Code, respectively. The Average Daily Trips (ADT) and floor area shown on the site plan are for
planning purposes only. These fees shall be paid when pulling applicable building permits for the
shade structure.
9. The parking lot shall be striped per the approved project plans.
10. This permit shall be subject to revocation if the applicant fails to conform to any of the above
conditions of approval.
