I Certify that I am the Legal Business Owner of the subject business and that all of the above information is true
and correct to the best of my knowledge. I agree to accept and abide by any conditions placed on the subject
project as a result of approval of this application. I agree to indemnify, hold harmless, and defend the City of
Carlsbad and its officers and employees from all claims, damage or liability to persons or property arising from or
caused directly or indirectly by the installation or placement of the subject property on the public sidewalk and/or
the operation of the subject business on the public sidewalk pursuant to this permit unless the damage or liability
was caused by the sole active negligence of the City of Carlsbad or its officers or employees. I have submitted a
Certificate of Insurance to the City of Carlsbad in the amount of one million dollars issued by a company which
has a rating in the latest "Best's Rating Guide" of "A-" or better and a financial size of $50-$100 (currently class
VII) or better which lists the City of Carlsbad as "additional insured" and provides primary coverage to the City.
I also agree to notify the City of Carlsbad thirty days prior to any cancellation or expiration of the policy. The

The insurance shall remain in effect for as long as the property is placed on the public sidewalk or the business

hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on

PROJECT NAME: Carlsbad Farmers Market
PROJECT NUMBER: RP 13-03
This early public notice is to let you know that a development application to relocate the
existing Farmers Market from the public parking lot adjacent to Roosevelt Street to
State Street, between Grand Avenue and Carlsbad Village Drive, was submitted to the
City of Carlsbad on February 15, 2013. The project application is undergoing its initial
review by the City.
LOCATION: State Street, between Carlsbad Village Drive and Grand Avenue
PROJECT DESCRIPTION: The applicant is requesting approval of a Review Permit to
relocate the existing Farmers Market currently located in the public parking lot adjacent
to Roosevelt Street to State Street, between Grand Avenue and Carlsbad Village Drive.
The applicant, Urban Place Consulting Inc., proposes to close State Street every
Wednesday from 11:00 a.m. to 8:00 p.m. to accommodate the Farmers Market. A
mixture of produce, prepared foods, and artisanal products will be offered. In addition, it
is anticipated that live music, open cooking and other events coinciding with growing
seasons and community events will be incorporated into the Farmers Market.
Please keep in mind that this is an early public notice and that the project design could
change as a result of further staff and public review. A future public hearing notice will
be mailed to you when this project is scheduled for public hearing before the Planning
Commission.

Hey Shannon-
My comments are specific to the maintenance/repair of the streetscape within and adjacent to the area of impact of the
proposed Farmer's Market. Specifically, along State Street-from the southern corners of Carlsbad Village Drive, to the
northern corners of Grand Avenue-I request the owner/applicant be responsible for the following:
• Removing all litter and debris from the public hardscape as needed during each market session (inc.
removal/haul away of plastic liners and contents, and replacement of like plastic liners).
• Servicing all public trash/recycling receptacles as needed during each market session (inc. removal/haul away of
plastic liners and contents, and replacement of like plastic liners).
• Servicing all public trash/recycling receptacles at the conclusion of each market session (inc. removal/haul away
of plastic liners and contents, and replacement of like plastic liners).
• Implementing storm water pollution prevention best management practices (BMPs)-e.g., placement of fabric
rolls/silt sheeting/gravel bags, etc. around all storm drain inlet during each market session.
• Cleaning any spills or leakage of liquid or solid materials on the public hardscape during each market session.
• Repairing/replacing any public landscape or irrigation damaged/destroyed during each market session.

I apologize that the comments I sent only referenced code sections for compliance. Without details of the event and
what plans are envisioned, it is difficult to specify requirements.
A PERMIT IS REQUIRED FOR TENTS AND TEMPORARY MEMBRANE STRUCTURES AND CANOPIES IN EXCESS OF 400 SQ.
FT. TENTS AND/OR CANOPIES LESS THAN TWENTY (20) FEET APART WILL BE CONSIDERED AS ONE. Section 2403.2, CFC,
2010 ed. Regardless of permit threshold, all temporary tents and membrane structures shall comply with Chapter 24 of
the California Fire Code, 2010 ed. Title 19 and Health and Safety Code. Inspections are required.
With that being said, I suggest the applicant provide the following details in addition to my comments previously made. I
have interjected consideration points as it relates to specific code requirements. Please note that this is a starting point
and that details provided may drive further discussions. Please note that I misspoke about item #1 when we met.
1. 20' access is required for fire department access for emergency response. 37.5' is the street width
shown. Vehicles necessary to the operation of the tent or canopy shall be parked at least twenty (20) feet from
any tent. All other vehicles shall be parked one (100) hundred feet away at a minimum. [California Code of
Regulations, Title 19, Division 1, §312.] Section 13116, Health and Safety Code.
2. Show location of cooking booths. These shall be separated from retail booths by a minimum of twenty (20) feet.
3. Tents and canopies shall be made from flame resistant material of nonflammable materials. Please see
California Code of Regulations, Title 19, Division 1, 315. (a) and 332.(a) for specifics. Section 2404.3 of the
California Fire Code, 2010 ed. for labeling requirements.
4. Open and or exposed flame ( cooking) is not allowed under a tent or canopy while open to the
public. Combustible materials and cooking which produces grease-laden vapors are not permitted inside the
tents or canopies.
5. How is power going to be provided?
6. Please indicate if heaters are going to be provided.
7. Is there an information packet distributed to the applicant? Fire Department may want to enclose information.

Before they can shut down a roadway they need an approved Traffic Control Plan. I would recommend encouraging
them to do this sooner than later. We can probably provide them with past similar control plans for other events that
have shut down the roadway. I have already shared this information with Ashley Westman at Urban Place. The person to
work with on the TCP is John Kim. If the farmers market purchases equipment there has even been discussion that we
could store it at our Oak Maintenance yard. There has also been a discussion about creating a CIP project with Urban
Place to install some temporary or permanent (but retractable) barricade devices.

We do not have any existing requirements for the Farmers Market. I don't know that they have been approved through

Attached is an application filed on behalf of the Carlsbad Village Association to hold a weekly farmer's market on State
St. between Carlsbad Village Dr. and Grand Ave. We have no issues or conditions but I guess we could add LDE's
standard condition #32 regarding stormwater (see below) but it really doesn't apply in this case. I understand from
Shannon that this application is it and that they won't be applying for any sort of special event permit. Any input or
advise as how to condition this thing would be appreciated. This what we have:
#32: Developer shall comply with the city's Stormwater Regulations, latest version, and shall implement best
management practices at all times. Best management practices include but are not limited to pollution control practices
or devices, erosion control to prevent silt runoff during construction, general housekeeping practices, pollution
prevention and educational practices, maintenance procedures, and other management practices or devices to prevent
or reduce the discharge of pollutants to stormwater, receiving water or stormwater conveyance system to the maximum
extent practicable. Developer shall notify prospective owners and tenants of the above requirements.
We could re-write it as:
Applicant shall comply with the city's Stormwater Regulations, latest version, and shall implement best management
practices at all times. Best management practices include but are not limited to pollution control practices or devices,
general housekeeping practices, pollution prevention and educational practices, maintenance procedures, and other

I unfortunately will not be able to attend the Public Hearing on this proposal.
Having now lived in Carlsbad Village two years along with my wife and I having the opportunity to go through the
Citizens Academy I am very impressed the actions that have been taken to move the City of Carlsbad and the area of the
Village forward. Certain actions that have been tried, like the Waffle shop, I thought was an innovative and interesting
idea for land use.
The one block area along State Street where the Farmer's market is proposed to be located on Wednesday's I am a bit
more skeptical about. This is a heavy traffic pattern area. Congestion is already going to worsen with the new improved
extension of Garcia's into the parking spaces. Also in talking with the business owners along this block they are
concerned that their business will decline. Farmer market clientele are not their clientele.
If one is to draw people into an area, why not move further north along State Street, where the street is wider and help
develop that area of play houses, movie theaters, art galleries and antique shops. It is an overlooked area and would be
discovered with this new traffic.

ISSUES OF CONCERN
1. Please revise the site plan to change the orientation of the curb cafe for Garcia's so it is consistent

2. Please revise the Farmers Market Rules and Regulations to address the current proposal and
location for the Farmers Market. Specifically, please ensure that details are included with respect

It is being proposed that the 2900 block of State St., from Carlsbad Village Dr. to
Grand Ave, be shut down every Wednesday afternoon and the current farmer's
market that is now in the public parking lot on Roosevelt St. be moved to State
St. The street will be shut down between 1 pm and 8pm in the summer, with the
marketing running 2pm to 7pm, and in the winter the street will be shut down
from 1 pm to 7pm, with the market running 2pm to 6pm.
The current and future market is owned by the Carlsbad Village Association, and
will be run by a contracted and experienced market manager, Ron La Chance.
The manager will be present at all times during the market and will have an
assistant helping with the set-up and tear down.
The proposed market will not be replacing the Saturday market, currently located
in public parking lot on Roosevelt. The Saturday market is being looked at as
completely separate and may or may not continue, but is not tied to the
Wednesday market or its move.
As representatives of CVA, Urban Place Consulting has reached out to the public
in several meetings to discuss and get input on the market details, such as time,
location, and purpose of the market. The relocation of the market has been
discussed at the monthly Village Voices Meeting, several times at the monthly
business owners meeting, at the property owners meeting, as well as numerous
e-blasts that are frequently sent out to residence, business owners and property
owners.
The majority of the property owners and residence that we have talked to are for
the move and think it is a great idea. They love the idea of revitalizing the
declining market and think State St is a good location. Holding a market on State
St during dinner hours was thoroughly thought through and general thinking is
that it will be good for the restaurants as it will bring more people down to the
village to patronize their establishments. Thought will also be put in to the mix of
vendors so as to not be a detriment to the restaurants or any business on the
street. We would also like to encourage partnerships between the restaurants
and the market, by hosting farmers' market dinners where the chefs prepare
special meals made only with food bought at the market or with cooking
demonstrations by the local chefs at the market.
State St. has the capacity to hold 61 vendors. This will be a Certified Farmers'
Market, with all permitting being done through the Department of Food and
Agriculture. The mix and types of vendors will be controlled by the market
manager, Urban Place Consulting staff, and the CVA board of directors. The
vendor mix will be watched carefully and the surrounding businesses will be
taken into consideration when thinking about vendor types. The market will be
mainly produce, with some artisan prepared foods (breads, cheese, jams, etc.),
meat and seafood, and some artisan crafts. This market will not be a flea market.
Temporary restrooms will be located just off State St on Grand Ave in parking
space (see site plan). The company currently providing restroom service to the
market will continue to do so. It will be dropped off and picked up every
Wednesday.
Additional lighting will not be provided to the vendors. It has been assessed that
with the lights in the trees and new lighting being considered by council, it will be
sufficient for the market. There will also be no heaters or generators. All
equipment needed by the vendors will be provided by them and therefore stored
by them.
All litter and debris will be removed by the market manager and staff provided by
CVA, as well as servicing trash cans, cleaning spills, repairing public
landscape/irrigation, and implementing storm water pollution prevention.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Planning:
1. Please clarify who will be operating the Farmers Market. Will it be the Carlsbad Village Association
or Urban Place Consulting? Will there be a Farmers Market manager who will be the main point
of contact for vendors, etc.? Will that person be present at the Market from 11 a.m. to 8:00 p.m.?
2. Please clarify what hours the Farmers Market will be open to the public and what hours within the
11:00 a.m. to 8:00p.m. time frame will be allocated to set-up and clean-up. In addition, will there
be different hours during the winter (i.e., when daylight savings time has ended)?
3. Please clarify whether the proposed Farmers Market will be replacing the Saturday Farmers
Market in the public parking lot off Roosevelt Street.
4. Please summarize the results of any outreach that has been undertaken with the property owners
and business tenants which will be affected by the new location for the Farmers Market. How do
the property owners feel about the proposed day and window of time? Are there any concerns
from the owners of the restaurants about the Market running through lunch and dinner hours?
Has any consideration been given to reducing the time in which the market runs (i.e., 3 p.m. to
8:00 p.m.) to limit the impacts to the retail tenants? If a public outreach meeting has not been
held, it is recommended that one be arranged with the affected property owners prior to the first
public hearing.
5. Please provide a separate site plan which identifies the properties adjacent to State Street which
will be affected. Please include the Assessor's Parcel Number (APN), address, property owner's
name, the name of the business as well as the hours of the business (can be provided in separate
legend).
6. Please provide a separate site plan which identifies the exact layout of the vendors, drawn to
scale.
7. Please revise the site plan provided as follows:
a. Account for the anticipated "curb cafe" to expand the outdoor dining area for Garcia's
restaurant into the public right-of-way;
b. Account for any associated equipment/vendor vehicles, etc., so fire safety can be adequately
analyzed;
c. If musicians are anticipated, please identify the location on the site plan (or on a separate plan
which details the layout of the vendors);
d. Identify where the outdoor cooking demonstrations will be located and where any other food
preparation will be located;
e. Identify the location of waste and recycling receptacles (existing and proposed);
f. Identify the location of any existing benches;
g. Identify the location of tree wells/landscape islands;
h. Identify the location of existing outdoor dining areas;
i. Identify the location of existing light standards;
j. Identify the location of existing bike racks; and

k. Identify the orientation of the vendors. To encourage exposure to adjacent businesses, it is
recommended that the tents or canopies be oriented towards the businesses.
8. Please indicate how many parking spaces will be temporarily displaced during the Farmers
Market. In addition, please identify the public parking lots which are available for parking and
convenient to the proposed location for the Market.
9. Please provide details on the number and types of vendors anticipated. Please indicate whether
this will be a Certified Farmers Market through the State of California Department of Food and
Agriculture. If the market will not be certified, please provide additional details as to why it will
not be certified. In addition, please clarify what will distinguish this from a flea market and how
the types of vendors will be controlled.
10. Please submit a signage plan which details the type, dimensions, and location of the proposed
signage.
11. Please indicate whether temporary restrooms will be provided. If restrooms will be provided,
please indicate where they will be located.
12. Please indicate whether any additional lighting is anticipated. Will the vendors be providing their
own individual lights?
13. Please prepare a Farmers Market Rules and Producers Agreement. The agreement shall include,
but not be limited to, details on where the vendors will park, clean-up and set-up procedures,
disposal of waste, security, and signage.
14. Please indicate whether food will be prepared on-site or if all items sold will be required to be
prepared and packaged offsite.
Transportation Engineering:
1. Please submit a Traffic Control Plan which lays out the details for the closure of State Street.
Please contact John Kim, Associate Engineer, Transportation Department, at (760) 602-2757, for
guidance in the preparation of the plan.
2. Please indicate where the equipment associated with the Farmers Market will be stored or if all of
the equipment will be hauled away by the vendors each week.
Fire:
1. A mtmmum 20' access clearance shall be provided along State Street for fire department
emergency response. The access should be dimensioned on the site plan. Vehicles necessary to
the operation of the tent or canopy shall be parked at least twenty (20) feet from any tent. All
other vehicles shall be parked one (100) hundred feet away at a minimum. [California Code of
Regulations, Title 19, Division 1, §312.] Section 13116, Health and Safety Code.
2. Please identify on the site plan where the open cooking will be located. Please be advised that the
cooking booths shall be separated from the retail booths by a minimum of 20 feet. Open cooking
shall comply with California Fire Code (CFC), 2010, ed., Title 19.

3. Please indicate whether any generators will be utilized to provide power and, if so, where they will
be located.
4. Please indicate whether heaters are going to be provided.
5. Please provide a list of vendors and the contact information for each vendor.
6. Please provide a site plan of the vendors.

ADVISORIES/ ANTICIPATED PROJECT CONDITIONS
Fire:
1. A Fire Use Permit will be required prior to operation of the Farmers Market, to the satisfaction of .
the Fire Department.
2. A permit is required for tents and temporary membrane structures and canopies in excess of 400
sq. Ft. Tents and/or canopies less than twenty (20) feet apart will be considered as one. Section
2403.2, CFC, 2010 ed. Regardless of the permit threshold, all temporary tents and membrane
structures shall comply with Chapter 24 of the California Fire Code, 2010 ed. Title 19 and Health
and Safety Code. Inspections will be required.
3. Tents and canopies shall be made from flame resistant material of nonflammable materials.
Please see California Code of Regulations, Title 19, Division 1, 315.(a) and 332.(a) for specifics.
Section 2404.3 of the California Fire Code, 2010 ed. for labeling requirements.
4. Open and or exposed flame (cooking) is not allowed under a tent or canopy while open to the
public. Combustible materials and cooking which produces grease-laden vapors are not permitted
inside the tents or canopies.
Building:
1. Disabled access/path of travel (minimum 36" clearance from any obstructions) shall be
maintained at all times, including to any sanitary facilities.
Land Development Engineering:
1. Applicant shall comply with the city's Stormwater Regulations, latest version, and shall implement
best management practices at all times. Best management practices include but are not limited to
pollution control practices or devices, general housekeeping practices, pollution prevention and
educational practices, maintenance procedures, and other management practices or devices to
prevent or reduce the discharge of pollutants to stormwater or stormwater conveyance system to
the maximum extent practicable.

Parks and Recreation:
The applicant/operator of the farmers market will be responsible for the following:
1. Removing all litter and debris from the public hardscape as needed during each market session.
2. Servicing all public trash/recycling receptacles as needed during and at the conclusion of each
market session, including the removal/haul away of plastic liners and contents, and replacement
of like plastic liners).
3. Implementing storm water pollution prevention best management practices (BMPs) -e.g.,
placement of fabric rolls/silt sheeting/gravel bags, etc. around all storm drain inlet during each
.market session.

Hi Shannon! I'm writing in regards to the proposal to have the Farmers Market on State St! I manage Ooh La La located
at 2972 State and we would be absolutely thrilled to move the farmers market over here. I personally don't currently go
to the Carlsbad farmers market, even though I live and work in the village. I drive to Oceanside to go to their farmers
market. It puts our current one to shame. As a mother who works and lives in Carlsbad, I take my son there because:
a) it's much more fun (especially for kids)
b) it has a much wider variety of things I want to shop for
c) it has live entertainment
I think it would bring more foot traffic to the village, it would bring more money to our local economy and it would be
much more convenient all around. To all of us who work at Ooh La La, it's an absolute no brainer! Please move it over
here!

I was just informed about a meeting held for tomorrow. My understanding that it will just be a casual Q&A forum to
discuss the proposal. We will hold off on providing any petition to deny any proposal to move the market until the
possibility that it may go to the city council. It should be clear that the Urban Place Consultants should retract the flyer
they have been passing/ sending out announcing that the farmers market will be moving to state street on Wednesdays
(as though it has already been approved) at least until it is actually approved. This creates confusion amongst business
owners in the area.
We definitely feel this will only impact our scarce parking as it stands right now and after discussing with many on State
st. they feel that they are paying a premium to be on the main street in downtown and really don't think it is fair for outside
business's/booth's to be able to sell their goods along side business's that are paying such a premium. In addition our
customers are willing to sign any petition too and (;!fter speaking with several of them they feel that they would have to
park further away and therefore would probably start doing business elsewhere. The Village Corner lie. Would have to
pay for a parking guard on those days to insure our corner has parking for our customers and not the farmers' market
vendors, nor customers.
We are all scratching our heads and wondering why and who would want to jeopardize the successful businesses
along State to help a 4 day a month farmers market. If the redevelopment dept. is trying to make more money or show
that they are working to improve the area we should let the customers speak and have our local news there to record and
document this. We look forward to a better decision.

I appreciate the feedback you've provided for the proposed location for the Farmers Market. The application is still in
the very early stages of the process and we are still currently reviewing it and providing comments. I have forwarded
your email on to Urban Place Consulting as I feel it's important for them to hear the feedback from the affected tenants
and property owners. I would like to ask you to clarify your last statement below regarding Urban Place profiting from
this proposal. It's my understanding that they will not be profiting from the Farmers Market and are just acting as the
applicant, but I'd like to hear your perspective. Also, what are the hours of your business? I'm just curious if you would
be more amenable to having the market on this block if the hours were cut back to mid-late afternoon into the early
evening. There is much that is still up for discussion with this request and we have not formulated a recommendation.
When this project moves forward to the public hearing {not anticipated for at least another few months), you will
receive another notice in the mail. I would encourage you to attend the hearing to provide your feedback to the
Planning Commission and, ultimately, City Council. In the interim, please feel free to call or email me with any

On behalf of my self and the owner of The Australian Grill in Carlsbad we would like to express our joy
and excitement in the proposed move of the farmers market to State St. This would be hugely beneficial to all
the local shops and restaurants. Currently during the market on Wednesdays and Saturdays we lose a great deal
of business. These are our two slowest days of the week (as well as our neighbors). People are pulled over to the
parking lot where it is now held and foot traffic is slowed to a minimum on State St. Bringing the market closer
to us will bring customers to our front door. I know this to be a fact since I personally saw this happen when I
worked during the Ocean Beach farmers markets, the street were FILLED and droves of people would stop in to
browse the shops or have a glass of wine at the local bars and bistros after they did their shopping at the market.
I also had this same experience in Grass Valley and Stockton. While living in both towns I saw the wonderful
tum around when the market was moved to the downtown area. This will not only bring business and exposure
to us, but will liven Carlsbad Village as well. Having night markets with not only produce booths but
food vendors, art's and crafts, games for children and live music will create a family fun event twice a week that
would be an amazing way to spend a beautiful summer evening in our beloved Carlsbad!!
I realize some proprietors are concerned about losing parking, I absolutely sympathize with them and see their
concern but I feel so strongly that once they see the rise in their sales I think this concern will fade. Please let
me know ifStefanie (the owner) or I can help in any way possible in getting this offthe ground. I thank you

Proposed Carlsbad Farmers Market Location
Thank you for making we aware of the proposed change in the Farmers Market Location. Living in the Village, Village by
the Sea Condo Complex, it is great that the city takes such a great effort to keep people aware of proposed changes.
Normally I am in favor of changes the city has taken but this change I take exception to. State street is a major traffic
pattern, it does not make sense to close this area down for an entire day. I have also talked with the businesses along
this block that I do business with and they are not in favor of it, they believe it will make the parking that is bad worse
along with effecting their business.
If it has to be moved why not move it to State street one block down in front of the METRO station. This would not
impact the traffic flow and would develop that area.
Frankly I like where the farmers market is now and I see no reason to change.

I can't believe this is even being considered. I have been very vocal about the frustration of our customers with
the lack of parking and the inconvenience of getting to our store during the week. By moving the Farmers Market
and additional booths from the public parking lot to the main thoroughfare street in the Village, you
are essentially trading parking spaces. This move will add frustration to our existing customers and not solve
any of the parking or visability issues.
The model you are proposing is similar to that of Oceanside and our own Street Fair. The restaurants benefit at
the cost of the merchants. If you check the Oceanside retail-type merchants that are actually open during the
Thursday evening event, they do very little business while the restaurants do very well. Our own street fair brings
very little new business into our store. It has consistently declined for the last 10 of the 20 years that we have
been in the village.
I feel that closing State Street so that the farmers market merchants and outside area merchants can conduct
business while inconveniencing State Street retailers with a long established customer base is another slap in
the face to retail merchants that have been supporting the village for many years.
If the vision for the Village is to have a pedestrian or bike friendly village that encourages art galleries dining,
drinking, and self pampering but does not include retail then it should be published so that retail merchants could
decide to stay in the village or move to a more retail friendly town.
The Urban Plan Consulting Group has done little in the past months to increase traffic, at least in our store and
others I have spoken with. I guess new garbage cans, spinning benches around, moving planters or even adding
lights to State Street was not the draw anticipated. What is closing the main thoroughfare without solving the
parking or visibility problem going to do for us?
These decisions directly affect our business. If the city spent the money they paid UPC to increase parking and
visibility to the Village as they did years ago before the Company Stores opened we may not be having these
issues.

Hours and Set-up-The Certified Farmers Market will be scheduled every Wednesday from 3 pm-7 pm in the
Spring/Summer and 3pm-6pm in the Fall/Winter. The market will consist of Certified Growers, Specialty Foods,
Cooked Foods and Artisans only.
The market will normally be open rain or shine, however in the event of exceptionally heavy rain or wind the
manager will have the discretion to determine if the market should be closed for safety concerns. Vendors are
expected to keep a regular schedule. If a vendor will be absent from a scheduled market day, they must notify the
manager as soon as possible before the event. Failing to contact the manager regarding absence from a
scheduled market day may result in loss of vendor privileges. The manager's event day cell phone number is (858)

State Street cannot be closed for vendor set-up until1:30 pm. NO VENDOR vehicles can be parked on State Street
prior to street closure at 1:30pm. Once the street is closed, all vendor vehicles will enter State Street from the
North (off of Grand Avenue). ALL vendor traffic will proceed in one direction for set-up (North to South). ALL
vendors will park in the designated parking lot for vendors. The Fish House Vera Cruz parking lot is the designated
parking area for ALL vendor vehicles. (SEE ATIACHED MAP). No vendor vehicles will remain on State Street after
set-up. No vehicles will be permitted to remain on State Street after 2:50 pm. Vendors will be issued a numbered
parking pass. All vendor vehicles will display the parking pass on the vehicle dashboard in clear sight. Parking
passes will be returned with booth payment at the end of the event.
City of Carlsbad Business License-Every vendor is required to get a business license from the City of Carlsbad. You

Vendor Booths-All vendors will have appropriate permits in their booths at all times. All tables will have a
tablecloth or other market manager approved covering. Vendors are encouraged to use displays, decorations,
tablecloths etc. to enhance the appearance their booths. We are the "new" State Street Farmers Market. We
want a new image. People buy with their eyes. Make your booth appealing.
Only those items listed on vendor's original application may be sold. Products not listed on vendors application
may not be sold without prior manager approval. Food vendors cooking food or dispensing samples shall have a
hand wash station in their booth as required by the San Diego Department of Environmental Health. Vendor
spaces will be pre assigned (See Attached Map) however they are not necessarily permanent assignments. The
manager reserves the right to change the location of vendor space assignments at his discretion.
Artisans-Only hand crafted items will be allowed. Artisans must be able to prove that they create everything they
sell. There are only 8 artisan spaces. Artisans will set-up at the Northwest Corner of Carlsbad Village Dr. and State
Street in the grassy area at Box' d. Artisans will have to unload from the parking lot/alley just West of State Street.
{See Map). Artisans will pay a flat rate of $35.

After Market Breakdown-All vendor vehicles will be parked on the South end of the market. Vendor traffic will
flow one way at closing too. (South to North). No Food vendors will be able to enter State Street with their vehicle
until their booth is closed up and ready to pack. This includes your canopy being folded up. Certified Growers
WILL be able to enter State Street prior to their booth being broken down.
General Rules-
• Vendors are expected to arrive no later than 2:30 pm
• Certified Growers and Food vendor's booth fee shall be 9% of sales ($20 minimum). Artisan's booth fee
shall be a flat rate of $35.
• The manager reserves the right to audit sales of any vendor booth at any time to ensure truthful sales
reporting.
• The manager reserves the right to halt sales of any product at his discretion.
• If products are sold by weight, the scale must be in clear view of the customer and must be sealed with a
current yearly stamp by the County Sealer of Weights and Measures.
• No individual music devices shall be permitted in vendor booths.
• No smoking or alcohol consumption is permitted.
• No early breakdown/exit from market.
• No outside soliciting or any political material shall be allowed.
• All booths will have pricing/menu displayed for customers.
• Vendors are responsible for trash removal from their booth space. No community waste disposal will be
available.
• Be friendly to our customers AND your fellow vendors. We like a good vibe.
EXPELSION FROM SELLING AT THE MARKET
Vendors who do not comply with these market rules and all other applicable regulations and laws, will
forfeit their right to the privilege of selling at the Market. A vendor will receive a written warning if not in
compliance with the market rules. A second warning for the same offense will result in possible
suspension or cancellation.
Market participants have the right to appeal the imposition (by the management/operator) of any fine,
suspension, or expulsion from this market. The market will provide participants with:
A. Notice in writing of the alleged violation with the factual basis for it and the proposed penalty.
B. A 30 day time period to request an appeal.
C. If an appeal is requested in writing the vendor will have an opportunity to dispute the alleged violation
in person in front of the Carlsbad Village Association Board and/or the Urban Place Consulting Group.
D. A short, written statement of the market's decision will be given to the vendor within 14 days

State Street Farmers Market Vendor Agreement
Vendors are responsible for securing their canopies from wind. Vendor assumes full responsibility for any
damage or injury caused by vendors equipment which includes but is not limited to canopy and vendor
vehicle.
