Sidewalk cafe for Garcia's Mexican Restaurant will span two diagonal parking spaces
#409 & 41 0 to provide additional seating for up to 38 guests. Cafe dining area is to be
constructed with concrete pedestal pavers set above the existing asphalt and flush with
the curb and sidewalk. The design will feature a rustic communal dining table, bright
orange planter pots and a banquet bench with bold, serape-inspired patterning.

Indemnification and Insurance Requirement for Village Area Administrative Permit
Certification Statement:
I Certify that I am the Legal Business Owner of the subject business and that all of the above information is true
and correct to the best of my knowledge. I agree to accept and abide by any conditions placed on the subject
project as a result of approval of this application. I agree to indemnify, hold harmless, and defend the City of
Carlsbad and its officers and employees from all claims, damage or liability to persons or property arising from or
caused directly or indirectly by the installation or placement of the subject property on the public sidewalk and/or
the operation of the subject business on the public sidewalk pursuant to this permit unless the damage or liability
was caused by the sole active negligence of the City of Carlsbad or its officers or employees. I have submitted a
Certificate of Insurance to the City of Carlsbad in the amount of one million dollars issued by a company which
has a rating in the latest "Best's Rating Guide" of "A-" or better and a financial size of $50-$100 (currently class
VII) or better which lists the City of Carlsbad as "additional insured" and provides primary coverage to the City.
I also agree to notify the City of Carlsbad thirty days prior to any cancellation or expiration of the policy. The
notice shall be delivered to:

The insurance shall remain in effect for as long as the property is placed on the public sidewalk or the business
is operated on the public sidewalk. This agreement is a condition of the issuance of this administrative permit for
the subject of this permit on the public sidewalk. I understand that an approved administrative permit shall

posts.
Type A Protection Post is used to protect facilities behind the post from vehicular impact.
Type B Demountable Protection Post is typically used for access control, such as on a fire road or a trail that would have
occasional official vehicle traffic. It is not meant to be a crash barrier.

Land Development Engineering (LDE) staff has completed a review of the above-referenced
project for application completeness. The application and plans submitted for this proposed
project are complete. Below is a list of engineering issues to be resolved prior to resubmittal:
1. Please submit a completed Storm Water Standards Questionnaire E-34. The link to this
questionnaire on the city's web site is:
http://www.carlsbadca.gov/business/building/Documents/E-34.pdf. All city projects are
required to have a completed copy of this questionnaire on file.
2. An encroachment agreement is required. Complete and submit Engineering Plancheck
Application E-23 and Encroachment Agreement Submittal Checklist E-9 to the Land
Development Engineering Counter at 1635 Faraday Ave, Carlsbad CA together with the
encroachment agreement processing fee of $325. Links to these forms on the city's
website are: http://www.carlsbadca.gov/business/building/Documents/E-23.pdf and
http://www.carlsbadca.gov/business/building/Documents/E-06.pdf.
3. Provide a mechanism for removing the step stone roof paver to clean the gutter and the
area under the deck.
4. Provide a mechanism for screening the perimeter of the deck, other than the gutter
flow line, to prevent trash and litter from accumulating under the deck.
5. Provide an alternative method of securing the step stone roof pavers should there be
insufficient clearance due the street pavement crown to install the screw jacks and
pavers flush with the sidewalk I top of curb elevation.
6. Specify the lag bolt diameter, depth and spacing used to secure the steel angle to the
curb face. Lag bolts are preferred over epoxy to minimize damage and facilitate repair
when the steel angle is removed.

7. Revise the sidewalk railing adjacent to the proposed curbside table [upper left on Curb
Cafe Plan Sheet Ll.01] so there is no intrusion into the sidewalk area in front of the
adjacent parking space.
8. Provide a vertical design element in/on the planter at the traffic end of this parking
space [lower left on Curb Cafe Plan Sheet L1.01] to aid the driver's ability to locate the
planter when backing out.
9. Provide a vehicle safety element similar to San Diego Regional Standard Drawing M-16
Demountable post at the traffic end of the opposite parking space [lower right on Curb
Cafe Plan Sheet L1.01], or propose an alternative solution.
10. Revise the Seating Summary Table to include the dining area. Since the outside dining
area/seats are less than the indoor dining area/seats, no additional traffic impact fees or
sewer impact fees will be assessed.
11. See the attached red line print of Sheet L1.01 for additional redline comments.
12. Resubmit three copies of the revised Sheet L1.01

SUBJECT: CURB CAFE PERMIT NO. RP 13-07-Request for approval of a Curb Cafe Permit (RP 13-
07) to allow for Garcia's Mexican Restaurant to occupy two public parking spaces in front of the
business with a temporary deck structure with landscaping along the perimeter for outdoor dining
purposes for a three year period at 2968 State Street, in the District 1 of the Village Review Zone and
local Facilities Management Zone 1.
Dear Kirk,
The City Planner has completed a review of your application for a Curb Cafe Permit RP 13-07 at 2968
State Street. A notice was sent to property owners and tenants within a 100' radius of the subject
property requesting comments regarding the above request. One comment was received within the
ten day notice period (ending on August 19, 2013). After careful consideration of the circumstances
surrounding this request, the City Planner APPROVES this request based on the following findings and
conditions.
Findings:
1. That the project is consistent with the Village Master Plan and Design Manual in that the curb
cafe will create a stronger user and pedestrian experience by increasing the quantity and
quality of outdoor dining in the Village and enlivening the streetscape.
2. That the project is consistent with City Council Policy 78 Design Standards in that (a) the curb
cafe occupies two diagonal parking spaces with a one-foot wide buffer; (b) the curb cafe is
located "most-directly'' in front of Garcia's Mexican Restaurant.
3. That this project is the first curb cafe on State Street between Carlsbad Village Drive and Grand
Avenue, which may have a maximum of five curb cafes.
4. That the City Planner has determined that the project belongs to a class of projects that the
State Secretary for Resources has found do not have a significant impact on the environment,
and it is therefore categorically exempt from the requirement for the preparation of
environmental documents pursuant to Section 15303 (New Construction of Small Structures) of
the state CEQA Guidelines. In making this determination, the City Planner has found that the
exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project.

5. The City Planner has reviewed each of the exactions imposed on the Developer contained in
this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate
impacts caused by or reasonably related to the project, and the extent and the degree of the
exaction is in rough proportionality to the impact caused by the project.
Conditions:
1. Approval is granted for RP 13-07 as shown on Exhibits "A"-"C" dated August 27, 2013 on file
in the Planning Division and incorporated herein by reference. Development shall occur
substantially as shown unless otherwise noted in these conditions.
2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented
and maintained over time, if any of such conditions fail to be so implemented and maintained
according to their terms, the city shall have the right to revoke or modify all approvals herein
granted; deny or further condition issuance of all future building permits; deny, revoke, or
further condition all certificates of occupancy issued under the authority of approvals herein
granted; record a notice of violation on the property title; institute and prosecute litigation to
compel their compliance with said conditions or seek damages for their violation. No vested
rights are gained by Developer or a successor in interest by the city's approval of this Curb Cafe
Permit.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the RP 13-07 documents, as necessary to make them internally consistent and
in conformity with the final action on the project. Development shall occur substantially as
shown on the approved Exhibits. Any proposed development different from this approval shall
require an amendment to this approval.
4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims and
costs, including court costs and attorney's fees incurred by the city arising, directly or indirectly,
from (a) city's approval and issuance of this Curb Cafe Permit, (b) city's approval or issuance of
any permit or action, whether discretionary or non-discretionary, in connection with the use
contemplated herein, and (c) Developer/Operator's installation and operation of the facility
permitted hereby, including without limitation, any and all liabilities arising from the emission
by the facility of electromagnetic fields or other energy waves or emissions.
5. RP 13-07 shall be reviewed by the City Planner on a yearly basis for compliance with the
provisions outlined in City Council Policy No. 78 and the conditions herein. If the City Planner
determines that the conditions of approval have not been met or the Curb Cafe Permit is being
or recently has been exercised contrary to any of the provisions of City Council Policy No. 78,
the permit may be brought back for administrative review, placement of additional or modified
conditions, revocation, or other remedies available to the city.
6. This Curb Cafe Permit is granted for a period of three (3} years from August 27, 2013 through
August 25, 2016. Once the permit has expired, the curb cafe shall be completely removed and
the street, curb and other adjacent surfaces shall be restored to the condition prior to the curb
cafe installation.

7. A use fee of $100 per month per parking space (two), payable in one-year increments ($1,200
per space/per year) shall be paid upon permit issuance and shall be paid annually thereafter for
the duration of the permit.
8. The curb cafe shall be limited to food and/or beverage serving uses only.
9. The curb cafe, including all materials, fixtures, furniture and plants, shall be maintained in good
condition. All maintenance and repair of the curb cafe shall be the sole responsibility of the
applicant. Additionally, the applicant shall sweep and remove debris from adjacent street areas
made inaccessible to street sweepers due to the curb cafe.
10. The curb cafe shall not have any awnings or roof elements.
11. No signs, including signs prohibited by Carlsbad Municipal Code Section 21.41.030, or objects
that would distract or impair motorists, shall be attached or displayed on any part of the curb
cafe.
12. The applicant shall provide the City of Carlsbad with a current certificate of insurance which lists
the city as additionally insured. The certificate must remain in effect for as long as the curb cafe
is placed within the public right-of-way.
13. Prior to any work being performed in the public right-of-way, a Right-of-Way Permit and
Encroachment Agreement must be obtained from the Engineering Department.

Dear Ms. Gonzales:
It has been two years since your application for a Curb Cafe Permit at 2968 State Street (Garcia's
Mexican Restaurant) has been approved. Per condition number seven in the approval letter dated
August 27, 2013, a use fee of $100 per month per parking space (two), payable in one-year
increments ($1,200 per space/per year) shall be paid upon permit issuance and shall be paid
annually thereafter for the duration of the permit. Please pay the fee of $2,400 for the next year
at the Faraday Center located at 1635 Faraday Avenue.
Staff has noticed that red poles with lighting strung across the curb cafe have been installed on
the curb cafe, which was not a part of the approved plans. Please remove the poles and lighting.
If you would like to include lighting within the curb cafe, an amendment to RP 13-07 is required
with details and specifications submitted to the city for review and approval.

CEQA Determination:
This is to advise you that after reviewing the application for the project referenced above, the City has
determined that the following environmental review process (pursuant to CEQA) will be required for the
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for New
Construction of Small Structures-Section 15303. No environmental review is required for the project.
A Notice of Exemption will be filed after approval of the project with the San Diego County Clerk's Office
which involves a filing fee. Please submit a check to the project planner in the amount of $50.00 made out
to the San Diego County Clerk. The check should be submitted approximately one week prior to the City
Planner decision date.
Target Decision Date:
In the interest of expeditiously processing your application consistent with the State Permit Streamlining Act
(California Government Code Section 65950), an administrative decision to approve or deny the project
should be determined by September 9, 2013.
Therefore, in the interest of achieving that decision date, all remaining project issues must be addressed by
August 26, 2013. If all project issues are not resolved by the date listed above, you may formally request a
one-time 90 day application extension. Otherwise, you will need to withdraw the application.

ISSUES OF CONCERN
Planning:
1. With government K-4 L-2 rated planters incorporated for perimeter security protection, bollards
installed in the street are no longer required. Please remove the two demountable posts at the
northwest and southwest corners of the curb cafe.
Engineering:
2. The angles of the striping and spacing for the diagonal parking spaces along State Street are
incorrect. Please revise the plan to show the correct angle of the striping and dimensions of the
parking spaces.
3. Please install a visibility post at the northwest corner of curb cafe. The visibility post shall have
reflective tape and attached to a planter with a height of three feet from the street grade.
4. Please provide edge striping along the west end of the parking stalls.
5. Please return the red lined set of plans with your next submittal.

Lag bolts are preferred over epoxy to minimize damage and facilitate repair when the steel

Sheet Ll.01] so there is no intrusion into the sidewalk area in front of the adjacent parking
space.
8. Provide a vertical design element in/on the planter at the traffic end of this parking space [lower
left on Curb Cafe Plan Sheet L1.01] to aid the driver's ability to locate the planter when backing
out.

9. Propose a safety element similar to San Diego Regional Standard Drawing M-16 Demountable

area/seats are less than the indoor dining area/seats, no additional traffic impact fees or sewer
impact fees will be assessed.
