Description/Explanation: P-1(8) Sidewalk cafe for Garcia's Mexican Restaurant will span two diagonal parking spaces #409 & 41 0 to provide additional seating for up to 38 guests. Cafe dining area is to be constructed with concrete pedestal pavers set above the existing asphalt and flush with the curb and sidewalk. The design will feature a rustic communal dining table, bright orange planter pots and a banquet bench with bold, serape-inspired patterning. I also agree to notify the City of Carlsbad thirty days prior to any cancellation or expiration of the policy. Dear Kirk, The City Planner has completed a review of your application for a Curb Cafe Permit RP 13-07 at 2968 State Street. A notice was sent to property owners and tenants within a 100' radius of the subject property requesting comments regarding the above request. One comment was received within the ten day notice period (ending on August 19, 2013). After careful consideration of the circumstances surrounding this request, the City Planner APPROVES this request based on the following findings and conditions. Findings: 1. That the project is consistent with the Village Master Plan and Design Manual in that the curb cafe will create a stronger user and pedestrian experience by increasing the quantity and quality of outdoor dining in the Village and enlivening the streetscape. 2. That the project is consistent with City Council Policy 78 Design Standards in that (a) the curb cafe occupies two diagonal parking spaces with a one-foot wide buffer; (b) the curb cafe is located "most-directly'' in front of Garcia's Mexican Restaurant. 3. That this project is the first curb cafe on State Street between Carlsbad Village Drive and Grand Avenue, which may have a maximum of five curb cafes. 4. That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303 (New Construction of Small Structures) of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. The City Planner has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact caused by the project. Conditions: 1. Approval is granted for RP 13-07 as shown on Exhibits "A"-"C" dated August 27, 2013 on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. 2. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the city shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the RP 13-07 documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development different from this approval shall require an amendment to this approval. 4. The Developer/Operator shall and does hereby agree to indemnify, protect, defend and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney's fees incurred by the city arising, directly or indirectly, from (a) city's approval and issuance of this Curb Cafe Permit, (b) city's approval or issuance of any permit or action, whether discretionary or non-discretionary, in connection with the use contemplated herein, and (c) Developer/Operator's installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. 5. RP 13-07 shall be reviewed by the City Planner on a yearly basis for compliance with the provisions outlined in City Council Policy No. 78 and the conditions herein. If the City Planner determines that the conditions of approval have not been met or the Curb Cafe Permit is being or recently has been exercised contrary to any of the provisions of City Council Policy No. 78, the permit may be brought back for administrative review, placement of additional or modified conditions, revocation, or other remedies available to the city. 6. This Curb Cafe Permit is granted for a period of three (3} years from August 27, 2013 through August 25, 2016. Additionally, the applicant shall sweep and remove debris from adjacent street areas made inaccessible to street sweepers due to the curb cafe. 10. The curb cafe shall not have any awnings or roof elements. 11. No signs, including signs prohibited by Carlsbad Municipal Code Section 21.41.030, or objects that would distract or impair motorists, shall be attached or displayed on any part of the curb cafe. 12. The applicant shall provide the City of Carlsbad with a current certificate of insurance which lists the city as additionally insured.
