This Exclusion 1(b) does not modify or limit the coverage provided under Covered Risk 5, 6,13(c), 13(d), 14 or 16. 2. Rights of eminent domain. Crime Prevention through Environmental Design The proper design and effective use ofthe built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life. The design includes the physical environment, the planned behavior of people, the productive use of space and an effective crime/loss prevention program. Natural Surveillance • Place and design physical features to maximize visibility. This will include building orientation, windows, entrances, walkways, landscape trees and shrubs, fences and any other physical obstruction. • Design the placement of persons, common areas or activities to maximize surveillance possibilities. • Design lighting that provides for appropriate nighttime illumination of walkways, entrances and driveways. Natural Access Control • Use walkways, pavement, lighting and landscaping to clearly guide guests to and from selected entrances. • Use real or symbolic barriers like fences or landscaping to prevent and or discourage access to or from dark and or unmonitored areas. • Used managed access on common doors and elevators. Light fixtures shall be deemed accessible if mounted within 15 feet vertically or 6 feet horizontally from any accessible surface or any adjoining roof, balcony, landing, stair tread platform or similar structure. Landscaping Plan a landscaping design that enhanced surveillance and security. Tree canopies should be no lower than six (6) feet and should not allow access to roofs or balconies. Ensure landscaping plan does not deter from lighting and addressing. Plant only low profile shrubs that can be maintained below two (2) feet. Use security plants where necessary to prevent entering and tampering. Install walls and fences that are see-through and enhance surveillance. Install gates that allow surveillance. Keep entranceways clear of clutter. Addressing • Locate numerals where they are clearly visible from the front street. • Contrast the numeral's color to the background on which it is affixed. • Numerals shall be no less than four (4) inches in height and illuminated during the hours of darkness. Doors Do not use of glass within 42 inches of a locking device. Install wooden doors of solid core construction with a minimum thickness of one and three-fourths (1-3/4) inches. This includes the garage pedestrian door to the outside and the door from the garage into the residence. Equip all doors with a single cylinder dead-bolt lock using a 5-pin tumbler. Connect the deadbolt to the inner portion of the lock by connecting screws. Ensure the lock has a one-inch throw that can withstand a cutting tool attack. Choose a deadbolt that embeds at least three-fourths of an inch into the strike plate. Common entrances should have managed access. Strike Plates • Reinforce all deadbolt strike plates. Choose strike plates constructed of a minimum 16 U.S. gauge steel, bronze, or brass and secure it to the jamb by a minimum of two screws, which should penetrate at least two (2) inches into the solid backing beyond the surface to which the strike is attached. Viewer • Arrange entrance doors so that the occupant has a view of the area immediately outside the door without opening the door. Except doors requiring a fire protection rating that prohibits them, such a view may be provided by a door viewer having a field of view of not less than 190 degrees. Mounting height should not exceed fifty-four (54) inches from the floor. Window and sliding glass doors • All exterior sliding glass doors and windows should be equipped with locking devices which will keep the sliding panel ofthe door or window from being opened from the outside horizontally or vertically lifted. Keying • Upon occupancy by the owner, each single unit in a tract constructed under the same general plan, should have locks using combinations that are interchange free from locks used in all other separate dwellings. A noise report is required for residential projects requiring a discretionary permit containing five or more dwelling units or any multiple family dwelling units located within or 500-feet beyond the 60 dB(A) CNEL noise contour line of the Noise Contour Map approved as part ofthe Carlsbad General Plan. The exterior noise level to which residential units must be mitigated shall be 60 decibel (dB(A) CNEL. Interior noise levels for residential units shall be mitigated to 45 dB(A) CNEL when openings to the exterior ofthe residence are closed. If openings are required to be closed to meet the interior noise standard, then mechanical ventilation shall be required. Engineering: 2. A completed form E-34 Stormwater Standards Questionnaire, to determine what type of reports and storm water mitigation must be completed to satisfy state and city storm water quality requirements, is required to be submitted with all applications. The project appears to create 5,000 square feet or more of impervious area (including the condominium units, the driveway and the associated street improvements) and supports a driveway. Question 6 of Step 2 ofthe E-34 would therefore be answered "yes" and would determine the project as proposed to be a priority stormwater project (PDP). PDPs are required to prepare and submit a preliminary Storm Water Management Plan (SWMP), integrating storm water treatment control best management practices and, if applicable, flow-control (hydromodification) requirements in the project design. Refer to the City of Carlsbad Engineering Standards Volume 4, Storm Water Standards Manual. Currently the site is within an area determined by the city to be exempt from priority project hydromodification requirements. To maintain this current exemption, construction in reliance of a permit must have started before the effective date ofthe 2013 Regional Water Quality Control Board order, now estimated to be December 2015. This exemption may not remain after the effective date of the 2013 order. 4. A preliminary hydrology/hydraulic analysis to calculate existing and proposed lOO-year storm flows. Please provide information on the cover sheet regarding the project team including the developer, architect, civil engineer, and landscape architect. 3. Please include a vicinity map on the cover sheet. 4. Please include the project title and project number (RP 14-10) on the top right corner of each sheet. 5. Please indicate the dimensions of the lot on the site plan. 6. Please indicate the roof pitch on the roof plans and elevation sheets. 7. Please indicate the building heights on the elevation sheets. 8. Please indicate the building materials on the elevation sheets. 9. Please indicate the scale to which the site plan is drawn. 10. The required front yard setback is five to fifteen feet, the required interior side yard and rear yard setbacks are five to ten feet and the street side setback is 10% ofthe lot width. The proposed front yard setback is seven feet, and the proposed interior side yard and rear yard setbacks are five feet. In all cases where a range has been established as the appropriate setback standard, the top ofthe range shall be considered the desired standard. A reduction in the standard to the minimum, or anywhere within the range, may be allowed ifthe project warrants such reduction due to good project design. Please redesign the project to meet all required setbacks at the top ofthe range, or provide written justification to reduce the setbacks based upon the project design, and/or project features which benefit the village area. 11. The width of the existing lot is 88'. The street side yard setback shall be 10% of the lot width (8' 8"). The proposed street side yard setback is five feet. In order for the street side yard setback to be reduced, a Development Standard Modification is required because there is no established range. RP 14-10- LAGUNA BREEZE CONDOMINIUMS July 24, 2014 Page 4 Development Standard Modifications may be permitted by the City Council for projects that assist the City Council in meeting the goals and objectives set forth within the Village Master Plan and Design Manual. Please redesign the project to meet the required street side setback or provide written justification regarding how the project assists the City Council in meeting the goals and objectives of the Village Master Plan. 12. The minimum driveway width is 24 feet. With a proposed driveway width of 20 feet, an additional Development Standards Modification will need to be approved by the City Council, pending the Fire Departments recommended support of this standards reduction. 13. Staff strongly encourages removing the parapet walls that encloses the roof deck. 14. Staff strongly encourages creating more of a focal point for the entryway doors in the buildings for Plan 1 and Plan 2 Alt. 15. The entry walkway for Plan 2 is inconsistent between the site plan and landscape plan. Please correct. Engineering: 16. The notes on Sheet 1 ofthe Preliminary Grading Plan should be revised as noted on the plan. 17. Sheet 2 ofthe Preliminary Grading Plan should be revised as noted on the plan and as outlined below: • One ofthe existing water services on Madison shown to be removed should remain and be used for site landscape irrigation purposes. Add a note to the service being abandoned that it should be plugged at the main. • Show the driveway widths where marked in orange. • Add a note that the pedestrian access ramp will be modified to the satisfaction of the engineer. • Add the note taped to the sheet regarding revisions to DWG 455-3. 18. The project will be conditioned to revise the approved grading plan, DWG45-3A, to reflect proposed project and all stormwater requirements. City the 19. The project will be conditioned to revise the approved street improvement plan, DWG45-3, to reflect the proposed project and revised construction details for the pedestrian access ramp atthe southeast corner of Laguna and Madison. Landscape: Numbers below are referenced on the red line pians where appropriate for ease in locating the area of the comment concern. 1. Please coordinate civil plans to indicate that the existing Phoenix canariensis is to be relocated on isite versus "to be removed". 2. Please relocate the palm so as not to conflict with the water service. 3. The plan shall demonstrate that plants, when installed and at maturity, will be positioned to avoid obstructing motorists' views of pedestrian crossings, driveways, roadways and other vehicular travel ways. On collector streets and larger, landscape elements over 30 inches in height (including planting measured at maturity) as measured from adjacent street grade are not permitted at street corners within a triangular zone drawn from two points, 25 feet outward from the beginning of curves. Landscape features (shrubs, trees, fencing, etc.) shall be selected to ensure that no visual impairments or obstructions are located within the CalTrans sight distance lines. Please address. 4. Separate water service for landscaping (including, but not limited to connections, water meters, and back flow preventers) shall be provided for all commercial/industrial projects, golf courses, parks, and residential common areas in projects over four (4) dwelling units. Plan notes indicate that all areas will be irrigated from an HOA water meter; however the civil plans show only 5 water meters (1 for each unit). Please coordinate with the civil to show the additional HOA meter. 5. Please provide a conceptual detail/elevation ofthe proposed wood fencing. 6. Please show and label all bio-swales/detention basins or underground drainage collection systems (in or under planting areas that could impact the planting) and provide appropriate landscaping. Please provide an updated copy of the civil grading plans with the next submittal that show/address these structures as appropriate for cross checking. 7. Please indicate plant sizes (either by number or percentage of the total quantity). 50% of the shrubs (except on slopes 3:1 or steeper) shall be a minimum 5 gallon size. Please address and insure this requirement is met. 8. The Landscape Manual indicates that landscape plans are to feature ground covers, shrubs, and trees to screen elements of unsightliness and screen/soften new improvements. The Landscape Manual also indicates that landscaping shall be used to accentuate and enhance architecture. Please provide appropriate landscaping to include tall/vertical plantings along the east side ofthe Plan 1 unity (along Laguna Drive) and the south side of the Plan 2 alternate unit to both soften and enhance these elevations. Include any added landscape areas to the water use calculations. 9. Plans indicate that all areas are to be HOA maintained; however there are enclosed areas that appear they will be privately maintained by the adjacent home owner. Please address maintenance ofthese areas. 10. There are existing overhead utility lines along Madison Street. Civil plans indicate that the power poles are to be relocated but it is not clear to where. Please coordinate with the civil to determine the final location of all power lines and show and label these lines on the landscape plans and insure no conflicts with street trees. 11. Please sign the statement. 12. Please provide a colored or hatched plan clearly showing where recycled water, graywater and potable water are proposed to be used for irrigation. This plan will be forwarded to CMWD for review and any comments will be returned to the applicant. 13. Please revise the Eto to 40. 14.
