It is the City Planner's determination that the request is consistent with the Village Review Area Master Plan and with all other applicable City ordinances and policies. The City Planner, therefore, approves this request based on the following: Findings: 1. That the placement of tables and chairs is not a project subject to the California Environmental Quality Act (CEQA). 2. That the sidewalk tables and chairs are for an eating/drinking establishment. 3. That the tables and chairs will not unduly disrupt pedestrian and vehicular movement. 4. That the applicant has signed an Indemnification Statement holding the City of Carlsbad harmless from any legal action resulting from placement of the tables and chairs on the public sidewalk. 5. That a Certificate of Insurance naming the City of Carlsbad as additionally insured in a minimum amount of $1 million, as established by the Risk Manager for the City, has been submitted to the City and will remain in effect for as long as the tables and chairs remain in the public right-of-way. 6. That the enclosure for the tables and chairs is desired for safety and aesthetic reasons Conditions: 1. A clear area of at least five feet in width shall be maintained for pedestrian use over the entire length of the sidewalk in front of the business. 3. The tables and chairs shall be placed in order to maximize a linear unobstructed area. 4. A clear area of at least five feet in width shall be maintained to building entries. 5. The tables and chairs shall not block access to fire emergency facilities (i.e., fire hydrants). 6. The tables, chairs and umbrellas are restricted to the frontage of the business, and shall not encroach on the frontage of any adjacent business. 7. All sidewalk obstruction including non-permanent trash receptacles shall be removed completely from the sidewalk area daily prior to the close of business. 8. The tables and chairs shall be of a uniform color and design and of substantial construction to withstand outdoor use. 9. Trash receptacles shall be provided and the sidewalk shall be kept free of litter. A new permanent trash receptacle, as approved by the Parks Department, shall be purchased by the property owner or business owner and located in an area approved by the Land Development Engineering Division and/or Parks Department. The existing trash receptacle shall be relocated to the area shown on the approved plans. 10. The enclosure for the tables and chairs shall not impede pedestrian traffic. 11. A right-of-way permit and encroachment agreement shall be required to be issued/approved by the Land Development Engineering Division. Please lower the proposed wrought iron fences to a maximum of 42" in height. 2. Please ensure that any proposed gates swing into the outdoor dining area and not out toward the sidewalk path oftravel. 3. Please relocate the railing opposite of the main entrance to be in line with the existing street tree planter. This will maintain approximately 8'10" of clearance in front of the main entrance. See red line plans for details. 4. To make up for space lost by relocating the railing, it is recommended to relocate the trash can and expand to the existing planter area. An additional trash can may need to be purchased as a condition of approval. Trash can relocation is subject to final approval by the City of Carlsbad Parks Department. 5. The four person dining tables shown along the Roosevelt Street elevation are not functional. Please revise the plans to show two person tables or show adequate space in conjunction with the proposed roll up doors to accommodate adequate space for dining, access and serving. Engineering: 1. Please show and dimension the top of the curb directly adjacent to the sidewalk on Roosevelt Street (approximately 6"). 2. Please show at least 5.5' from the face of the curb to the proposed railing along Roosevelt Street. To achieve this, the plans shall be revised to relocate the railing closer to the building. 3. Please show the street lights, ground utility boxes, and the ADA curb cut area at the corner of Grand and Roosevelt.
