SUBJECT: NON-CONFORMING SIGN AT SUNNY'S RESTAURANT
The Design Review Board approved application RP/CUP 82-11 on
February 9, 1983 for a remodel of the existing Baker's
Restaurant at 2952 Harding Street, The Housing and
Redevelopment Coimnission approved this application on March 15,
1983. One of the conditions of approval was the existing
freestanding pole sign be removed and that a uniform sign plan
be submitted to the Land Use Planning Manager for approval. As
of this date the sign has not been removed.
The City has notified Mr. Neal Baker, or his representative, at
least three times. Chris Salomone and myself notified Mr. Bill
Withers, operator of the restaurant, orally in early March. VJhen
nothing was done about the sign we notified the owner on April
14 by letter (attached). No response was received so final
notice was given by certified mail on May 4 (attached) and we
have received no response. VJe hope that the Attorney's
office will proceed with the normal actions involved in bringing
this sign into compliance as soon as possible.

Dear Sir:
Your establishment is located within the boundaries of the
Village Redevelopment Area of the City of Carlsbad. The
development standards of this area require a redevelopment
permit even in situations where no building permit would be
require (for example, changes to existing signs or a color
change to a building). Your site has an approved
redevelopment permit (RP 82-11) that details the exterior
color scheme. A change such as you have effected requires
the approval of the Design Review Board in the form of an
amendment to the existing permit (RP 82-11). Applications
for this amendment may be obtained from this office or at the
Development Processing counter at the Community Development
office, 2075 Las Palmas Drive.

Carlsbad approved your request to remodel and add a dining area
to your existing drive-thru restaurant on Harding Street.

RE: FINAL NOTICE - FREESTANDING SIGN AT SUNNY'S
Mr. Baker:
On April 14, 1983 you were sent a notice (copy attached)
requesting that you bring the sign at Sunny's Restaurant (Harding
Street location) into conformance with your approved
Redevelopment Permit (No. 82-11).
The City has contacted your company several times regarding this
sign. Originally, Mr. Withers (restaurant operator) indicated
the sign would be made conforming by March 30, 1983. In the
City's second notice you were given until May 1, 1983. A field
check on May 3, 1983 indicated that the sign is still non-
conforming.
Please consider this final notice to bring your sign into con-
formance with the approved Redevelopment Permit. If the sign is
not in conformance with said permit by May 13, 1983, the matter
will be turned over to the City Attorney's Office for appropriate
action.

Mr. Baker:
The City has reviewed your letter of April 5, 1983, and were
happy to hear that the processinq time for your project was much
quicker than you expected. We feel our processing times are very
streamlined.
In your letter you also requested a delay until October 1, 1983,
before beginning the recently approved model for Baker's
restaurant. This would allow you to operate the existing
facility through the summer months. We feel that this is-'a '
reasonable request. We must insist, however, that the Baker's
sign be taken care of immediately.
.In a meeting with Chris Salomone and myself, Mr. Withers operator
of the Carlsbad Baker's Burgers, indicated that the sign would be
made conforming by March 30. The City aqreed, but the sign has
not been relocated. A copy of the resolution approving the
remodel, which includes conditions regarding the relocation of
your sign, was sent to Mr. Withers. He has been made aware of
what needs to be done concerning the sign.
Please consider this letter notice to bring your sign into
conformance with the conditions of approval by May 1, 1983. If
you have any questions regarding these conditions please feel

The preliminary staff report for the above referenced project has
been completed. A copy of the report, including the recom-
mendation and conditions, is enclosed. This preliminary report
will be discussed by staff at the Development Coordinating
Committee (D.C.C.) meeting which will be held on February 1,
1983, beginning at 9:45 a.m. If you have any questions
concerning the report, you may attend the D.C.C. meeting.

Re: Public Facilities Fee Agreement and Application Fee,
Baker's Tacos
The enclosed Public Facilities Fee Agreement, application blank
and check are being returned for the following reasons:
1) All owners must sign the Public Facilities Fee Agreement and
their signatures must be notarized.
2) A fee of $400 is charged for a Conditional Use Permit, plus
the $100 fee for the Environmental Impact Assessment. I am
enclosing the $100 check rather than holding it here at the
office.
Return the agreement, $500 check and application blank to me by
February 3, at 2:00 p.m. in order to be placed on the March 23rd
agenda.

As per instructions from Kathy Nicholes of your Planning
Dept. we are sending you our proposed plans to re-model
and add to the Baker Burger Drive-thru on Harding St,
This plan was submitted, to you after conference with a
Mr. Henthon about a year ago however it got lost in the
shuffle and we failed to follow up so we'll start all
over again.
This store has been operated as a lease unit however that
lease expires Jan 1, 1983 and. the store will then be operated,
as a company store, with direct supervision from here.
The former operator was not interested in re-modeling
however Mr. Baker is and is anxious to get started as
soon as possible.
Please advis me as quickly as possible as to what we should
be doing next to work towards securing a permit to clean
up this store and make it operative.
