It has come to our attention that the large, freestanding sign identifying the above location is in violation of the Carlsbad Municipal Code. I would like to resolve this matter in an informal manner. Please discontinue the violation and call me at 438-5591 within 14 days of receipt of this letter to avert further action on the City's behalf. Your cooperation will be appreciated. There seems to be a question as to the definition of freeway oriented business and the exposure allowed to those types of businesses. I would submit that a super- market which anchors a shopping center such as our store on Elm Street does, is in fact a draw for the freeway business going past Carlsbad. Our success or failure in a center of this nature is in direct proportion to the success of the other tenants. If we do well, they do well. If we pull people off the freeway, they get the spillover and the net result is more revenue for the City of Carlsbad. I would have like to had the sign at 35 feet which would have given me both north and south-bound exposure but I relented and went to 30 feet during the meeting which I felt was a good compromise. To drop the sign all the way to 22 feet as suggested by Planning, would further damage our visibility. Anything you and the Design Review Board can do to help would be appreciated.
