Based on the information you shared, you had been using the subject suite (approximately 725 square feet) for your office business for approximately two years but needed to expand and subsequently relocated within the Village. However, you continue to have a lease on the subject space and would like to assign that lease to a certified public accountant for his office use. According to the approved land use permit (RP 83-16) for the subject property/building, the uses within the building are to be retail and office. At a minimum, the retail uses are specifically required to be located on the first floor and within the street-facing suites (occupying approximately 3000 square feet total). Office space is permitted on the first floor ofthe building, but must be located to the rear ofthe building (no street frontage) and occupy approximately 1000 square feet. The entire second floor may be used for office purposes with no retail required. It is currently estimated that the existing retail establishments occupy approximately 2300 to 2500 square feet of space within the subject building and do occupy the entire street-facing suites on the first floor. There are currently no offices with street frontage. Offices currently occupy the remaining approximately 1500 to 1700 square feet, which is located to the rear ofthe first floor retail and not visible to the street. Because the current retail business are occupying the first floor, street-facing suites of the subject building, staff believes that office uses may continue to occupy the rear 1500 to 1700 square feet of building leasable space, including suite C-1 which you previously leased. As a result, we will approve use of the subject suite by the noted certified public accountant office. However, It should be clearly understood that office uses will not be permitted to expand beyond those spaces currently occupied In suites C-1 and D-1 as of this date. The retail uses may expand Into those office spaces, but the reverse will not be permitted. By copy of this letter to the property owner, we are notifying the property owner that no additional conversion of retail space to office space will be permitted on the first floor of the subject building. At a minimum, the amount of retail space currently occupied within the building as of this date must be maintained. In addition, only retail businesses will be permitted to occupy the street-facing suites (A-l and B-1) at the front of the building at all times. This retail space requirement is Important because the property is located within the Coastal Zone which requires first floor uses to be tourist-serving 2965 Roosevelt St., Ste. The Coastal Commission approved the subject land use permit because It included the retail space on the ground floor and within the street- facing suites, and only a small amount of office space to the rear of the building on the first floor. It is, therefore, Important to maintain this retail and not have It further encroached upon by the first floor office space. We have no concern with the entire second floor continuing to be used for office purposes. Again, thank you for your Inquiry. Neither the City of Carlsbad nor the Carlsbad Redevelopment Agency have specific regulations pertaining to the design of cellular antenna facilities. The Carlsbad Village Redevelopment Master Plan is silent on the issue except for general requirements concerning the need for an Administrative Redevelopment Permit in the following circumstances: 1. Additions to the building footprint which have a building permit valuation which is equal to or less than $60,000; and/or 2. Interior or exterior improvements to existing buildings which result in an intensity of use; and/or 3. Changes in pemiitted land uses which result in site changes, increased ADT, increased parking requirements, or result in compatibility issues/problems. The cellular antenna projects within the redevelopment area that have been presented to staff to date have all been processed as Administrative Redevelopment Permits, because each of them met one or more of the aforementioned criteria. The Carlsbad Municipal Code is the regulatory document for situations Where the Village Redevelopment Master Plan is silent. Carlsbad Municipal Code Section 21.42.010 (2)(J) governs citywide processing of cellular facilities which qualify as quasi-public utilities. This section of the Municipal Code states that a conditiornal use permit is required for cellular facilities in all zones. In the redevelopment area, thie redevelopment permit takes the place of the conditional use permit. Section 21.42.020 of the Carlsbad Municipal includes the fmdings necessary to grant a conditional use permit. In addition. Section 21.42.030 states that in granting a conditional use permit, any and all conditions necessary to protect the public health, safety and welfare, may be added. In accordance with the authority granted under Section 21.42.030, in order to approve a conditional use permit or redevelopment permit in the case of projects within the redevelopment area, staff has added that all cellular and similar wireless antenna facilities must be of stealth design and architecturally integrated into the existing structure. 2965 Roosevelt St., Ste. A) An all weather access road shall be maintained throughout construction. 5) All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. 6) Adequate emergency vehicle turn-arounds shall be provided by a cul-de-sac or a hammerhead when driveway is more than 150 feet deep from property line at street, 7) All driveways shall be extended to within 150 feet of all portions of the exterior walls of the first story of any building. AO Proposed security gate systems shall be provided with "Knox" key operated override / y^ switch, as specified by the Fire Department. 9) All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "No Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. 10) Fire retardant roofs shall be required < . all structures.' 11) Brush clearance shall be maintained within a minimum distance of 30 feet to each residence. 12) ) All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. 13) All roof-top appurtenances shall be architecturally integrated into the design of the building and shielding to prevent noise and visual impacts, subject to approval before issuance of permit. \k)y Building exceeding 10,000 sq. ft. aggregate floor area shall be sprinklered or ha^e four-hour fire walls with no openings therein which shall split the building into 10,000 sq. ft.
