REQUEST FOR TWO HOUR PARKING ZONE ON ARBUCKLE PLACE
As requested. Staff has reviewed the parking conditions on
Arbuckle Place and found sufficient parking to be available
in both the 23 space parking lot and the 14 on street spaces
adjacent to Mr. Jim Hirschberg's property. Since the
building is surrounded by single family homes, parking
demands are not conflicting between the two different land
uses. Other property owners on Arbuckle Place are parking on
their own property or directly adjacent, and are not
interfering with the parking areas available for Mr.
Hirschberg's property. Arbuckle Place is only partially
improved. When fully completed there should be an increase
in parking availability and any parking deficiencies will
improve.
Staff recommends leaving parking as it is and including this
street in the downtown parking study. At that time it can be
determined if a two-hour parking zone would be recommended by
your department.
I tried to contact Mr. Jim Hirschberg on numerous occasions
and was referred by phone to a Pennsylvania listing. Staff
believes that this item should be dropped from the Traffic
Safety Commission agenda at this time pending further study.
Please let us know if you want this matter scheduled for the
Traffic Safety Commission consideration.

As part of the City requirements when I was ready for construction, I had
to pull a building permit and pay various fees to the various agencies.
I thought that at that time, I was through paying all my fees. I came to
find out that I would be required to pay for more building permits as
it became necessary to construct the improvements within the building.
This came as quite a shock to me however, it was part of the learning
process for office construction. As it became time for these new permits
to be pulled, I was notified that I would not be able to obtain them unless
I signed some kind of fee agreement.
I signed 6 fee agreements for 6 tenant improvements. These agreements were
different from the one I signed for the construction of the building.
Now I wish to sell this property (only because my fees ran me into trouble
financially) and I find that I cannnot have these fee agreements released.
I was told by Helen at the building dept. that what I signed will remain on
my title until sometime in 1988 and that it is equivalent to a blank check
for the city to write in some amount for some fees at some future time.
If this is the case, then it is apparent to me that due to the time it took
and fees to pay and changes to make which has caused me to have to sell my
building, and now due to these fee agreements which create an open lien
prevent me from being able to sell my building I will soon go broke.
I need your assistance. I have always tried to play by the rules, but
your rules keep changing and now it has become quite serious.

I would like to formally request that the traffic circulation
and parking on Arbuckle Place, between Jefferson and Madison
in the Redevelopment Area be reviewed by the appropriate
authority and that it be taken into consideration that the
parking be limited to two hours during business hours.
I have personally met with the property owners and
representing the tenants of the Austin/Pacific office
complex.
I am aware that two hour parking can be accomplished in the
Redevelopment Area and has recently been studied and action
transpired to accommodate other requests.

Re: Variance request for Austin Pacific office building street standard (parkway)
Dear Sir:
Based upon a previous meeting attended by Chris Salamone, Walter Brown, Jim
Hirschberg and myself, we progressed to a point of approval on the above
project with plans for the widening of Arbuckle Street from 18 ft. to 20 ft.
and a parkway of 8 ft. instead of 10 ft., granting, however; a 2 ft.
easement to provide for the necessary street requirements. Even though this
one million dollar building is being constructed in the Carlsbad Redevelopment
Area, up to this point, no concessions or variances from strict city codes have
been requested or granted. We have cooperated with staff in making all
suggested changes to our original design.
Today we have just been advised that the future of our project is in danger
due to the fact that the street standard of a 20ft. street and a 10ft.
parkway is being required, a requirement that we understood to be waved per
our above mentioned meeting. We feel that because of the apparent misunderstanding,
and due to the following factors, a street standard variance (parkway) should be
accorded us for this project.
1. Other parkway variances have been granted throughout the city,
both in and out of the Redevelopment Area.
2. This variance would in no way adversely effect the neighborhood or
adjoining properties as we control all the property on the
south side of Arbuckle.
3. With the 2 ft. easement, we have already agreed to provide the city,
there will be no effect on either our property, traffic flow,
pedestrians, or the city's access to the 30ft..
4. We comply with all the requirements of the planning department
and this variance will have no effect on our designs or plans.
5. Without this variance, our entire project will be jeopardized
and considering this is within the Redevelopment Area, we feel
that the granting of such a variance would be beneficial to the city
and the neighborhood.

PR 85-4 REQUEST FOR STANDARD VARIANCE
The Austin Pacific Development Company requested a variance from City Design
Standards. In accordance with Section 18 of the Street Design Criteria of the
City Standards, the Planning Commission shall have the authority as an
administrative act to grant variances to the City Standards provided the
following findings can be met:
1. That there are extraordinary or unusual circumstances or conditions
applicable to the situation of surrounding property necessitating a
variance of the Standards.
2. That the granting of such variance will not cause substantial drainage
problems.
3. That the granting of such variance will not conflict with existing or
future traffic and parking demands or pedestrian or bicycle use.
4. That the granting of such variance will not be detrimental to the public
welfare or injurious to the property or improvements in the vicinity in
which the variance is granted.
5. That the granting of such variance will not adversely affect the
comprehensive general plan.
City staff has reviewed the variance request and is making the recommendation
that follows in this memorandum.
1. Location: Arbuckle Place between Madison Street and Jefferson
Street.
Request: To grant a two foot easement in lieu of a two foot
street dedication.
Reason: The proposed building falls within the required ten-foot
building setback area.

Explanation: Staff can make all but one of the necessary findings.

Arbuckle Place is designated as a local street with a
60-foot right-of-way and a 40-foot curb to curb street
width. The sight distance requirements at the inter-
sect ion of Arbuckle Place and Jefferson Street can be
provided with the building in its proposed location.
The 2' variance would not effect this.

A new ordinance has been adopted by the City of Carlsbad
regarding public notice procedures (Ordinance No. 9578). This
ordinance requires noticing property owners within a 600*
radius of a proposed project which is scheduled for a public
hearing. The previous requirement was a 300' radius, for which
you submitted as part of your application a list of property
owners with assessor parcel numbers and either one or two sets
of envelopes.
Although your project has been submitted already, it will be
scheduled for a public hearing after the ordinance takes effect
(June 6, 1985); therefore, it is ncessary for you to update the
public notice package that was submitted. Please submit to the
Land Use Planning Office the names, addresses and assessor
parcel numbers (on a list and on stamped envelopes) of those
property owners between the 300' and 600' radius. This should
be done by June 1.
If you have any questions, please contact the planner for your
project.

of the utilities to our project.
I understand that the City of Carlsbad has a fund to help new projects
such as ours in the redevelopment area, for the specific purpose of
undergrounding the utilities.
I am formally requesting that our new office complex (to be built) at
the corner of Jefferson St. and Arbuckle St. be considered as a very
much needed redevelopment project in that old dangerous buildings are
being replaced with one new modern one , and as such qualifies for
monies from this utility fund.

Gentlemen:
Due to the street improvements required by the City of Carlsbad, you
requested a cost estimate to relocate our electric overhead facilities at
2777 Jefferson Street in the City of Carlsbad .
SDG&E will relocate the facilities for the estimated cost of $6845.00. This
offer is contingent upon:
a) Acceptance of the offer within 60 days of the date of this letter.
b) Being able to complete our work within 120 days from the date of
acceptance of the offer. Delay of work caused by telephone or
cable T.V. companies may be reviewed by SDG&E for additional
customer billing.
c) Receipt of final improvement plans.
If the estimated cost is greater than the actual cost of the work,
SDG&E will refund the over-payment except where the amount is less
than $25.00. Any change in the physical conditions or a change
in the design on which this estimate was based will stop our
relocation work until our design is reviewed and re-estimated. If
the change results in more costly work, the additional cost must be
paid or billing arrangements negotiated and approved before work
will be resumed.
Whenever differences between the preliminary and final street improvement
plans or actual construction and final plans require a revision of the work
order or additional relocation work, the applicant agrees to pay all
engineering fees and associated construction costs incurred by SDG&E due to
such differences. Such differences may also require rescheduling of SDG&E
design and construction work provided for in this agreement.
The above cost does not include any work by the telephone company (or cable
T.V. company). Please call them for any charges they may have to relocate
their facilities.

Before excavating in the vicinity of gas or underground electric faciUties,
please call SDG&E Mark Out Service at 1-800-422-4133. Within 48 hours, we
can indicate the location of SDG&E facilities on the job site.
Since your improvement plans do not indicate street lights, it's important
that you contact the City of Carlsbad for their requirements prior to our
final design. This will avoid costly and unnecessary delays to your project.

Gentlemen:
You may be interested to know that design and costs have been prepared to
install underground electric facilities to 2777 Jefferson Street, Carlsbad.
Electric service will be supplied under the provisions of Electric Rule 16.
In accordance with this rule, you or your contractor are responsible for the
trench, backfill, conduit, pad grounding and concrete transformer pad. This
will include the 1-4 inch primary conduit* frcM pole 30776 to the
transformer pad, and 3-3 inch condiiits to the metering facilities. You
will also be responsible for the maintenance of the facilities you install for
the duration of your service.
To complete the service, we will install the transformer and 100 feet of
electric conductors at no cost to you. Your cost for cable in excess of 100
feet and cable pole material is $715.00.
Manufacturers' drawings of the switchboard, bus configuration, and metering
arrangement must be submitted to our Electric Meter Shop prior to fabrication.
It shall be your responsibility to thoroughly familiarize all of your Agents
with the contents of the Standards, specifications, and drawings and to
accurately advise SDG&E of your construction schedule.
SDG&E will be represented in the field by an Inspector and all work and
material shall be subject at all times to inspection by the Inspector.
* To ensure that your service is installed in a timely manner, *
* please follow instructions contained in the Standards, speciflca-*
* tions and drawings enclosed, use only SDG&E approved materials, *
* and coordinate the installation with our Inspector by calling *
* before 2:00 p.m. one work day prior to the date inspection is *
* needed. Phone: 438-6229, North Coast Operating District. *
Inspection of your work by our Inspector is required at the trenching, conduit
installation, conduit mandreling, backfill, compaction stages. (Cross out any
steps not applicable.) At each stage of construction, if SDG&E's crews are
needed, they will be dispatched as available after the Inspector has verified
that you have satisfactorily performed your portion of the work.

In the event that modification of the specification or construction drawings
is required or desired, such modification may be made by mutual agreement in
writing between Applicant and Utility. Minor changes in construction
resulting from adverse field conditions may be approved in writing at the job
site by the Inspector, when warranted to facilitate construction.
All materials, work, and work areas shall comply with the William-Steiger
Occupational Safety and Health Act, CAL-OSHA Act, and all other applicable
Federal, State, or local safety laws or rules that are necessary to protect
Appliant's and Utility's employees, the public, and workers during the time of
construction. Applicant shall take all steps to protect property adjacent to
the construction project from damage resulting from work specified and
performed hereunder.
Final acceptance by SDG&E will be made when you have satisfactorily completed
all work and Improvements as called for in the Contract Documents. You will
be required to correct all defects which become evident at any time prior to
final acceptance of your work by SDG&E. The cost of all repairs, both
material and labor, shall be borne by you. Care, custody, and control of the
work and facilities shall pass to SDG&E only upon final acceptance.
Applicant expressly represents and warrants that all the work performed and
all the materials used in meeting Applicant's obligations under this Agreement
Document are in conformity with the Contract Document and are free from
defects in workmanship. This warranty shall commence upon receipt by
Applicant of Utility's final acceptance and shall expire one year from that
date. Applicant agrees to correct to the satisfaction of the Utility and any
governmental agencies having jurisdiction, and at its expense, any breach of
this warranty such as may become apparent during the period of the warranty.
You will need an excavation permit from the City of Carlsbad prior to any
excavation work in street property.
I suggest you contact the Pacific Bell/General Telephone Company and the local
cable television company for their specifications and charges.
Please send your check for $715.00 to our District Accountant in the enclosed
envelope. Once all necessary rights of way are obtained, and your check is
received in our office, your construction order will be issued.
All costs and installation responsibilities for your project are based on
current rules and prices and are subject to change after October 15, 1985 .
If, after that date, it becomes necessary to review your project and
recalculate costs, an engineering fee may be required.

After rights of way have been obtained, and you have been notified by us that
your construction order has been issued, you or your trenching contractor must
notify our Construction Department in writing at least two wedcs prior to
having the trench ready. Confirmation by phone two days prior to our starting
our scheduled work is also necessary. You may arrange a preconstruction
conference at that time.
The meter can only be set after final acceptance of your work, completion of
our work, application for service, and receipt of City of Carlsbad building
inspection clearance. Allow approximately three working days for the meter to
be set after receipt of the inspection clearance from the City.
By proceeding with this installation, it is understood that you agree to all
the terms and conditions set forth in this letter and the Standards,
specifications and drawings indicated herein.
