RE: YOUR CONSTRUCTION AND LOCATION OF A MINI-STORAGE WAREHOUSE
ON THE REAL PROPERTY LOCATED BEHIND 2541 STATE STREET
OWNED BY ATCHESON TOPEKA AND SANTA FE RAILWAY COMPANY AND
LEASED TO YOU UNDER CONTRACT NO. 142231
Dear Mr. Robinson:
I discussed this matter with your engineer, Alton Rudin, in a
telephone conversation on Friday, November 13, 1987 in which we
agreed to a revised abatement schedule as follows:

This schedule set forth above will result in complete removal
of your mini-storage warehouse units located on the above
referenced property'.
Additionally, you will not advertise or allow advertising of
any units for occupancy on this property now or in the future
and particularly pending their removal.
You agree to reasonable inspection of the storage units and
inspection of their associated leases for verification purposes
upon prior reasonable notice.

Provided you adhere to the above schedule, the City will not
file any civil or criminal action in order to force you to
remove them or to impose fines or penalties. If, however, you
do not adhere to the schedule, the City may use any legal,
equitable or administrative remedies available to it,
including, specific performance and injunctive relief based
upon the terms of this agreement.
As Mr. Rudin explained to me, you will have an opportunity to
review and approve this agreement within the next two weeks.
Please indicate your acceptance of these terms by November 30,
1987.
