RE: DESIGN REVIEW BOARD HEARING OF YOUR APPEAL REGARDING
CAROLE'S FRESH CUT FLOWERS
Dear Mr. Biltchik:
Thank you for your letter of April 4, 1991 regarding this matter.
It is unfortunate that you did not attend this hearing in which
your appeal was discussed. If you had attended this hearing you
would have heard the complete discussion of your appeal rather than
relying on a few isolated quotes in a newspaper article. At the
hearing, I advised the Design Review Board that staff recommended
denying your appeal because there were no facts to find a dangerous
condition. A dangerous condition of public property must create a
substantial risk of injury when used with due care in a reasonably
forseeable manner.
Representatives from Housing and Redevelopment, Engineering and
Police were all in attendance at this hearing in order to answer
any questions that you may have had.
As you know, an encroachment permit for this project was recently
issued by the City Council and I am advised that you were noticed
of this hearing. You could have requested additional conditions at
this hearing but you did not attend.
I recommend that you obtain the tape of the hearing and review the
minutes for a fuller explanation prior to further correspondence.
As an interested party, a decision of the Design Review Board may
be appealed to the Housing and Redevelopment Commission by filing
a written appeal with the City Clerk within ten days of the date of
that decision pursuant to Carlsbad Municipal Code Section
21.35.110.

I hereby request an above-ground encroachment
permit for tne area snown on the enclosed map,
2805 Carlsbad Blvd. The purpose of said permit is
for us to construct and use a flower stand. Permission
has already been granted by t;ie owner of t:ie adjacent
property, and the re-develop.-ient people. Tiis stand
is movable, and we ierby agree to remove it, should
tne dity deem it necessary. ;fe also carry liability
insurnace, a copy of which will be furnished when
this permit is issured.

Dear Council Members:
Re: CAROL'S FRESH CUT FLOWERS
This is the present state of my flower stand:
As I have stated before, this structure is a
temporary structure. It is moTeable and under 150 sq.ft.
At the time 8/5/85 I have halted work for a period of one
week because I received approval on another location that
we have been involved with for several months. I do in-
tend to finish this stand by the 16th of August. It will
coincide with the appearance of the "Alt Karlsbad", with
cross timbers and gray stains. There will be no obstrusive
advertisements and I feel that it will be an asset to the
community.
