After discussing this item with Nancy Rollman, City Planner, she indicated that I should talk with Mike Shirey, City Traffic Engineer, to find out the traffic volume. Mike stated that on all of the City traffic volume maps there wasn't any traffic volume count on Oak Avenue, Pine Avenue or Washington Street because the volume was too small. For and in conaideratlon of the rental and of the covenants and agreements hereinafter contained, the parties hereto agree as follows: 1. EXISTIHG FACILITIES Lessor hereby excepts and reserves the right, to be exercised by Lessor and by any others who have obtained or may obtain permission or authority from Lessor so to do, to: (a) Operate, maintain, renew and relocate any and all existing pipe, power and com- munication lines and appurtenances and other facilities of like character upon, over or under the surface of Premises; and (b) Construct, operate, maintain, renew and relocate such additional facilities of the same character as will not unreasonably interfere with Lessee's use of Premises as specified in Section 6 hereof. 3. RENTAL A!?D REKTAL ADJUSTMENTS Lessee shall pay to Lessor for the use of the Premises rental as follows: (a) Subject to Subsection 3(c) below, the base rent'shall be Two Thousand One Hundred Ninety-five and Ko/lOO Dollars ($2,195.00) per month to be adjusted Rev. 1/86 (M40m/CD4) -1- 34. BINDING All the covenants and ogreements of Lessee herein contained shall be binding upon the helrc, legal representatives, successors and assigns of Lessee, and shall inure to the benefit of the successors and assigns of Lessor. 35. IKSURANCE (a) Lessee shall, at its expense, procure and keep in force at all times during the term of this Lease, a comprehensive form of insurance covering its liability, including but not limited to. Public Liability and Property Damage, assumed by Lessee under this Lease covering bodily injury to or death of persons and property damage or destruction, in the amount of $2,000,000. Lessor shall be named as one of the insured parties. (b) All insurance shall be placed with insurance companies licensed to do business in the State in which Premises are located, and approved by Lessor. Lessee shall fumish Lessor with a certificate, or certificates evidencing such insurance. Each policy shall provide that it shall not be cancelled or materially changed unless at least thirty (30) days* prior written notice of cancellation or change shall have been mailed by the insurance company to Lessor at the address designoted on the signature page of this instrument. Lessee shall promptly fumish Lessor with certified copy of said policy or policies upon written request from Lessor. The providing or fumishing of such insurance or evidence of such insurance shall not in any manner limit the liability of Lessee under Section 15 hereof or any other provision of this Lease.
