Please be aware that we have tried to cooperate with Mr. Chandler and our other neighbors regarding truck traffic in that area. We can assure you that we send our trucks around the block to wait for the approach to clear before they enter the yard so as to not block the streets, or to unload in the streets, with our equipment. However, I cannot say that it never happens. I have insisted to our truck driver, and to our management at that location, to not block the streets. We will again reinforce that company policy at this time. Our yard is very small. We do have customers that pick up and drop off rented equipment from us. To expedite the operation, we try to assist them when they do stop in the street. When this happens, it is always on Laguna Street in front of the radio station. We were renting the vacant property directly behind our facility from Mr. Chandler for some time until it was deemed as non-conforming. We would appreciate the opportunity to be able to lease that property again for whatever period of time it is vacant. In this way, we could assist the trucks which are not under our control. This would help both of us. Of course, this is contingent upon Mr. Chandler agreeing to rent the property to us again. We are very desirous of relocating our business in the City of Carlsbad, but we have not been able to acquire a piece of property either on a lease or sale basis. I think you are somewhat familiar with some of our previous efforts and applications for conditional use permits. We would like to relocate our business and then develop the property into either a two or three story office building conforming to your plan. We are presently considering different locations, and would like an opportunity to discuss those properties with you. One is at El Camino Real — just north of Palomar Airport Road. We are now in contact with the real estate people on this property. Another is Avenida Encinitas — just south of Palomar Airport Road. It is under a development plan and a zoning change. As a third possibility, we are considering a lease agreement with South Coast Asphalt Company who is redrafting their master plan for further consideration by the city. A fourth location under consideration is with SDG&E at Cannon Road. We are not able to make a commitment as to how soon we can move from the State Street location, but we will step up our search for a new location. Thank you very much for your consideration. We are trying to be good citizens to the City of Carlsbad and good neighbors to Mr. Chandler. We look forward to an opportunity to meet with you again in the near future to discuss our options. I have contacted some of the neighbors, and they share the concerns that I have about the continuing presence of Hawthorne Equipment Company on the corners of Laguna and State Streets in Carlsbad. Hawthorne has occupied this site for almost twenty years. As the surrounding neighborhood has developed into a low key office environment, Hawthorne's use of the property has become increasingly out of place. Having participated in the original Downtown Review Board and the formulation of the original Design Review Manual, I can state that the type of businesses, and the aesthetic architectural features of business and office structures, are spelled out very clearly in the Design Review Manual. Hawthorne clearly violates anyone's interpretation of this manual. But, aesthetics aside, the most important issue concerning Hawthorne's continuing presence in the downtown area involves the issue of public safety. About two years ago, I approached Hawthorne and complained about their loading and unloading of heavy equipment in front of my office building at 550 Laguna Drive. At that time they acknowledged that their practices were indeed unsafe, but remarked that they had no viable alternative. I then suggested that they lease my vacant lot at 539 Laguna for a very nominal sum in order to off-load their equipment and keep the streets open for vehicular traffic. Shortly after we made that arrangement, I received a "cease and desist" letter from Chris Salomone at the Downtown 'Redevelopment Commission. We did, in fact, honor Chris's request, and Hawthorne is now back to unloading their equipment in front of my driveways. Rather than ask you to request your police department to enforce the municipal code to protect the health and safety of the citizens of the area, let me put forth the following suggestions: 1. That you instruct your planning staff to cooperate with Hawthorne's attempts to move their rental yard to another more suitable Carlsbad location; 3. That during that twelve to eighteen month period mentioned above, I be permitted to lease my vacant property to Hawthorne in order to get their three-axle trucks and forty-foot trailers off the streets so that my staff and our customers can conduct business safely. I would appreciate your thoughts on this matter. I look forward to hearing from you at your earliest convenience. For over five years now, Hawthorne Equ:|.pment Rental has been promising me and, I believe, working diligently with the City to vacate their premises on the corner of State and Laguna. I have been following this process with great interest, and I feel I can no longer sit idly and await the wonderful day when they finally move. I have spoken with Dick McMahan and Thelma Hayes, and they both share my concerns. The three of us would like to proceed as one and work in an amicable manner to remove Hawthorne...hopefully, with the help and cooperation of your office. Can we count on your active cooperation in this effort? If so, what do you propose to do to help rid our neighborhood of this eyesore? Additionally, what steps do you think we should take to start the ball rolling? I would appreciate your comments on this at your earliest possible conveni- ence. Include discussion of actions necessary to complete the project 7) Show: Street and drainage improvements and contours ISSUES: 1) At this time the City does not have Coastal Development Permit (CDP) authority from the Coastal Commission. A Coastal Development Permit must be obtained from the Commission, however, staff will review the project for Local Coastal Program compliance. Can staff have a copy of the prior CDP for the site? This will allow easier analysis of Local Coastal Program compliance. 2) Indicate on the appropriate exhibits designs which comply with City standards and ordinances for APN's 155-221-11 and 12 and 203-101-30. Indicate any proposed variances. 3) The offsite parking lot, as presently located, appears in conflict with the Village Design Manual "pedestrian movement" on Page 10. The parking lot as located encourages pedestrian movement at a mid-block location between corners where pedestrian movement can be more safetly accommodated. Additionally, the proposed crossing is on a horizontal and vertical curve which has limited sight line visability. A study of the acceptability of an off-site parking arrangement may be necessary. A-) The parking and access design of APN 155-221 -1 1 needs modification to handle circulation movement onsite. Traffic should not back out or stack on Laguna Drive.
