A change from general office to a medical office is an intensification of use. Parking for medical office is one (1) space for every 200 square feet of gross floor area, for other professional offices the required parking is one (1) space for every 250 square feet. A real estate office at the 3021 Jefferson Street 'site would not be an intensification of use. As you may know, no development, building or rebuilding may occur in the redevelopment area without first obtaining a redevelopment permit from the Design Review Board pursuant to Carlsbad Municipal Code Section 21.35.070 which states: "No development, redevelopment, building or rebuilding shall occur in the area subject to this chapter without a redevelopment permit first having been issued by the housing and redevelopment commission or, for minor projects defined in Section 21.35.080, by the design review board." Please be further advised that your development requires a coastal development permit from the Design Review Board pursuant to Carlsbad Municipal Section 21.81.070. No development shall occur in the redevelopment zone without a permit having first been obtained as required by CMC Section 21.81.020. You applied for a minor redevelopment permit and coastal permit which were issued conditionally on the condition, among others, that you comply with the terms of Condition 14 requiring electrical service to meet current adopted codes. You appealed this condition and others to the City Council which appeal was denied on June 21, 1988. That decision is now final and you must comply with that condition. In that regard, following the "Notice of Municipal Code violation and Order to Remove" dated May 13, 1988 requiring you to correct the violations of Chapter 18.12 no later than May 27, 1988, you wrote a letter to Mr. Tony Mata of the Building Department -2- indicating that you would move from this location should your appeal be denied. From the information that has been provided to me, you have neither corrected these violations nor ceased occupancy as you stated. The purpose of this letter is to schedule an office hearing for you in my offices on July 14, 1988 at 9:00 a.m. to allow you to show cause why this office should not file a criminal or civil action in order to obtain your involuntary compliance. If you do not show cause why such action or actions should not be filed or if you fail to appear for this hearing, then this office will feel free to pursue any and all legal, equitable and administrative remedies available to it in order to obtain your involuntary compliance. A copy of the permit is attached. Please see note on the rear of the permit dated January 29, 1988 "not for use as a commercial building" written by Building Inspector Pat Kelly. Mr. Lubin was told that the electrical service was not sufficient for the commercial use proposed. The permit was pulled by Marshall Lubin. A letter (copy attached) was received by Pat Kelly from Mr. Lubin stating that he would rent the house out instead of going through proper channels to get everything approved. Mr. Lubin then proceeded to open his chiropractic office at 3021 Jefferson Street. Mr. Lubin has applied for and received a Redevelopment Permit, however, Mr. Lubin was not satisfied with the conditions of approval and applied for an appeal of the permit to the City Council. His appeal was denied, and he is bound by the original conditions of the Redevelopment Permit. The Design Review Board wanted to have Mr. Lubin comply immediately to the electrical code requirements of his approval. When Mr. Lubin was informed by letter to comply with the conditions of approval by May 27, 1988, he called my office for an extension. I referred him to Tony Mata and he requested an extension in writing. Mr. Mata denied his request. Mr. Lubin has not yet complied and is still operating his chiropractic practice from 3021 Jefferson Street. A. I have appealled that decision and v/ill probably move from this location should I lose the appeal. If I do move, it v/ould mean that the electrical conversion was wasted time and money on my part. A decision on a minor redevelopment project, by the Design Review Board, may be appealed to the Housing and Redevelopment Commission (Carlsbad Municipal Code, Section 21.35.110) In accordance with the Carlsbad Municipal Code, the Carlsbad Housing and Redevelopment Commission shall hold a public hearing on a redevelopment permit which has been appealed. Lubin Re: 3021 Jefferson St, Dear Council Members, On Wednesday, May 4th, the design review board mandated that a parking lot be built at the location noted above. This decision was based mainly on the point that a doctors office was an intensification of traffic at this address. I propose to show that this is not the case, and furthermore, that sufficient parking in the area is available for the needs of this office. 1) During the past 4 years two businesses have occupied this location, a travel agency and a marketing firm. Neither of these business activities were required to make accommodation for parking. 2) On the property adjacent to mine, five businesses presently are open serving the public. A. Cliffs Pantry-sees over one hundred customers per day.' No additional parking required. B. Bradleys Janitorial Supply-services approx. 50 customers per day. No additional parking required. C. Vans Shoes-sees 20-40 customers per day. No additional parking required. D. Nexus Hair Salon-sees approx. 40 clients per day. No additional parking required. E. And finally, the Video Store-Sees approx. 30 customers per day presently and expects to see 60 per day in the near future. This store opened within the last three months and no additional parking was required. My office is open from 2-7PM on Monday, Wednesday, Thursday, Friday, and Saturday by appointment, I have an agreement with Cliffs Pantry to use the parking lot behind the restaurant during the hours that they are closed, i.e. after 2:30PM. I also have an agreement with Paster Webber, which allows my patients to use the church parking lot, located at Elm and Harding Streets, if needed, Jefferson St, itself is practically deserted after cliffs closes In the early afternoon, which leaves more than enough parking for my needs. Above I noted numerically the average clients per day of the businesses adjacent to my office. My office sees approx. 10 patients per day at present. Hopefully, that number will grow to 15 per day within the next year. Even with that number, I do not even come near to the traffic already generated by the existing businesses. At that meeting. Dr. Lubin stated that he does not want to make any improvements outside his leasable area. Staff was directed to contact the property owner to find out his interest in making the improvements with Dr. Lubin. Mr. Gene Siegel, the owner, has been contacted (see attached letter). His response is that he would be willing to pay half the cost of the parking lot improvements; at this time he does to want to remove the garage or pay for a block wall or the trash enclosure. He will be at the May 4th meeting to answer any questions the Board may have. The applicant's architect is out of town as of this writing (4/26). Staff will continue to try to contact him before the May 4th meeting. The Board discussed several other conditions at the meeting, including: using a block wall instead of a wood fence along the southern property line; installing a block wall around the trash container; removing the garage; providing adequate lighting in the parking lot area; and modifying the site plan to show regular sized parking spaces with 8 1/2 - foot widths. If it appears that Dr. Lubin and Mr. Siegel will agree to make the required improvements, staff will return with a Resolution with those conditions included. Dr. Lubin also requested that conditions #2,6,7,9,12 and 14 be dropped or modified. Staff continues to recommend inclusion of these conditions, as they are standard conditions, and/or necessary to ensure compliance of City requirements as part of issuing the Minor Redevelopment Permit and Coastal Permit. He has iirproved the property 100% from what it has looked like in the past. His practice will be an asset and welcomed here in our area. We have lived at 3037 Jefferson Street for forty years. Dr. Lubin's chiropractor practice will not be any bother to us. We v^lcome Dr. Lubin as our next door neighbor. My wife and I would like to mention that prior to Dr. Lubin having his practice next door, we have had a travel agency for three years that was in business at 3021 Jefferson Street. Also for a year and one-half, a marketing and tool agency was in business at 3021 Jefferson Street. This market- ing and tool agency was also in the advertising business. None of the mentioned businesses were a bother to us. The people that did business with them always had plenty of parking on both sides of the street. At no time have we ever seen any congestion during the week-day parking or on the week-ends. In closing, may say that it is a privilege to have Dr. Lubin next door with his chiropractor practice. Vitalie FAV/js MEMO March 28, 1988 TO: NANCY ROLLMAN FROM: PAT KELLY, BUILDING INSPECTOR RE: REDEVELOPMENT PERMIT FOR 3021 JEFFERSON STREET The structure at the above location was, in its previous use, an office which created little more risk than a residential occupancy. However, the change in use to a doctor's office will introduce a great deal of sophisticated equipment (ie: x-ray, ultra-sound, sterilization equipment and other physical therapy equipment) to an electrical system installed for Intermittent residential use. The Building Department's policy regarding these types of conversions is that all existing circuits may remain, as is. All new circuits and switch gear installed must comply with our current adopted code and ordinance (attached), Dr, Lubin drew a permit to add an electric circuit for the x-ray machine (attached), He then proceeded to change the entire electric service and add numerous other circuits without proper permits. At that time he was informed that the new service and additional work should conform as follows: 1, Service gear shall have a minimum AIC rating of 42000 AIC (Commercial Type) NEC 230-65 2, Conduit and switchgear mounted on the surface of the building exterior is not allowed by Ordinance (8104 Sec, 18,12,240), 3, Use of non-metallic sheathed cable (Romex) is not allowed when adding new wiring to commercial uses (8104 Sec, 18,12,255). 4, Office floor plan shall meet all requirements for Title 24, particularly handicap accesssibility requirements, 5, All other necessary permits and liscences were his responsibility, (Business, Redevelopment Permit, Coastal) Memo to Nancy Rollman March 28, 1988 page 2 He responded in writing that he was returning the business to its previous use and the Building Department accepted the work done without permits as it was. Mr. Lubin had been told by our staff that he needed a Redevelopment Permit and that if Design Review Board met on February 3rd his plan could go for review. If there was no meeting on the 3rd the next meeting date would be February 17. (Design Review Board meets the first and third Wednesday of the month, if there are items for review). Dr. Lubin brought plans into our office on Friday, January 25. Based on those plans, Dr. Lubin was told there was not adequate parking and staff would recommend denial. He could redesign the parking lot to accommodate the required parking but there was not adequate time to prepare a staff report for a meeting on February 3rd. There are no other items scheduled for a meeting on February 3rd. After consideration staff has determined that Dr. Lubin's application will be scheduled for the meeting n February 17. RE: Parking at 3201 Jefferson Street To Whom it May Concern: The owners of Cliffs Pantry and myself have entered into an agreement allowing in joint participation of the parking lot located behind their restaurant on the corner of Elm and Jefferson Streets. The parking lot which adjoins the property at 3201 Jefferson Street contains nine parking stalls for cars. Ihe hours at Cliff's Pantry are 6:30 a.m. to 2:30 in the afternoon.
