We request that the public facility fee requirements be waived for
this project for the following reasons:
1. No building permit is required since this
is an existing business.
2. There is no need for additional public
fecilities to serve this project.

RESPONSE TO CITIZEN COMMENT ON JOBE GAY RP/COP 88-7
At the Council Meeting of June 6, 1989, Mr. Harold Clarke spoke
in opposition to the approval of RP 88-7/CUP 88-7, Jobe Gay. The
RP/CUP, which was approved by Design Review Board on May 17,
1989, was a request td allow the continue.d operation of an
existing auto impound yard at 3267 Tyler Street.
The original permit, CUP 163, was approved in 1979. The request
for continued operation was a public hearing. Mr. Clark attended
the Design Review Board meeting but did not speak. It was clear
at the public hearing that the action was final unless appealed.
No appeals were submitted within the appeal period (ten (10) days
after the DRB action).
The staff report and Design Review Board findings were that the
continued usage as an auto impound yard at this site is in
conformance with the goals and development standards of the
Village Design Manual and the V-R Zone and that the findings
could be made to support granting the RP/CUP.
I called Mr. Clarke and discussed this issue on June 8, 1989. I
invited Harold to join in the upcoming Master Plan review
process. We will be looking at land-use, design, parking,
circulation, etc. He indicated a willingness to participate in
that review.

SUBJECT: RP.CUP 88-7 Jobe Gay Preliminary Staff Report
The preliminary staff report for the above referenced project will be available
for you to pick up on Friday, April 21, 1989, after 8 a.m. This preliminary
report will be discussed by staff at the Development Coordinating Committee
(D.C.C.) meeting which will be held on Monday, April 24, 1989. A twenty (20)
minute appointment has been set aside for you at 11:00 a.m. If you have any
questions concerning your project, you should attend the D.C.C. meeting.
It is necessary that you bring your required unmounted colored exhibit(s) with
you to this meeting in order for your project to go forward to the Planning
Commission. If you do not plan to attend this meeting, please make arrangements
to have your colored exhibit(s) here by the scheduled time above.
If you need additional information concerning this matter, please contact the
Planning Department at 438-1161.

Planning Department has reviewed your Redevelopment Permit/Conditional Use
Permit, application no. RP/CUP 88-7, as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of
your application may have already begun, the technical acceptance date is
acknowledged by the date of this communication. The City may, in the course of
processing the application, request that you clarify, amplify, correct, or
otherwise supplement the basic information required for the application. In
